The petitioners  were the original registrants<br \/>\n     under  the Hudco Registration Scheme for allotment  of<br \/>\n     MIG  flat.  The petitioners registered in 1979 and  in<br \/>\n     the  year1994 applied for conversion of registration<br \/>\n     from  MIG to  SFS VI-B Scheme  which  conversion was<br \/>\n     accepted. Subsequently SFS scheme IX was announced in<br \/>\n     1996  which  was  open  to general public as  also  to<br \/>\n     registrants  of  VI-B  SFS  scheme.   The petitioners<br \/>\n     applied for the said IX SFS scheme but the applications<br \/>\n     of the petitioners were defective for the reason that<br \/>\n     the  column No.10 was left blank. Column No.10 require<br \/>\n     the  parties  to  disclose about the ownership  of any<br \/>\n     other lease hold or free hold property in their name or<br \/>\n     in the  name  of their wife\/husband,  minor  children,<br \/>\n     dependent parents etc.  In December 1996 the petitioner<br \/>\n     applied  to  DDA  for  removal  of the  objections  in<br \/>\n     pursuance to  a  public notice issued  on 18.12.1996.<br \/>\n     However,  when  the list of successful applicants were<br \/>\n     announced on 1.1.1997, the name of petitioner did not<br \/>\n     figure in the list.\n<\/p>\n<p> 2.    Certain  other  parties   filed  writ  petitions<br \/>\n     before  this  Court  including  CW No.911\/1997  Keshav<br \/>\n     Munjal  Vs.  DDA decided on 20.4.2000.  A decision was<br \/>\n     taken  by the respondent that all eligible registrants<br \/>\n     of SFS VI-B scheme would be given another opportunity<br \/>\n     for   consideration   of  their   names  and  a   fresh<br \/>\n     computerised draw of lots were held later on 23.1.2001.<br \/>\n     The  name of the petitioner did not even figure in this<br \/>\n     list.\n<\/p>\n<p> 3.    The principal contention advanced on behalf  of<br \/>\n     the  respondent in their counter affidavit is that the<br \/>\n     application  was required to be complete in all respect<br \/>\n     and  in  view  of the incomplete  applications  of the<br \/>\n     petitioners,  they could not be included in the draw of<br \/>\n     lots.   It is further stated that the orders passed  by<br \/>\n     this  Court were only in respect of the petitioners who<br \/>\n     had  filed those writ petitions and cannot be  extended<br \/>\n     to other petitioners.\n<\/p>\n<p> 4.    The original  record  have also  been  produced<br \/>\n     before  this  Court  which show that  this aspect was<br \/>\n     considered and a conscious decision was taken that  it<br \/>\n     will  not be  desirable  to  take cognizance  of the<br \/>\n     objections filed by the ineligible applicants  because<br \/>\n     other  ineligible applicants  may not  have  read the<br \/>\n     advertisement  or may not be located in  Delhi. This<br \/>\n     position  was also based on the fact that the  brochure<br \/>\n     itself provided that incomplete applications were to be<br \/>\n     rejected summarily.\n<\/p>\n<p> 5.    Learned   counsel for   the  petitioners has<br \/>\n     contended that  under the category of the applicants,<br \/>\n     there  were  only eight applicants and  these  persons<br \/>\n     could have been easily accommodated.\n<\/p>\n<p> 6.    It may  be noticed that on the  last  date  of<br \/>\n     hearing,  it was recorded that learned counsel for the<br \/>\n     petitioners  did not dispute the position that in case<br \/>\n     the  applications of the petitioners were not complete,<br \/>\n     the petitioners shall not be entitled to be included in<br \/>\n     the draw of lots though the counsel had relied upon the<br \/>\n     issue  of correction  of the mistake in terms  of the<br \/>\n     letter of December, 1996.\n<\/p>\n<p> 7.    It has been stated before me by learned counsel<br \/>\n     for the respondent that IX SFS scheme stands closed now<br \/>\n     and  the petitioners also did not approach the Court in<br \/>\n     1997  when other persons had  approached the  Court,<br \/>\n     though they were also slightly differently situated.\n<\/p>\n<p> 8.    I  am  of the considered view that a  conscious<br \/>\n     decision  having been taken in this behalf, taking into<br \/>\n     consideration  the over all facts and circumstances  of<br \/>\n     such  cases  as  also  by reason of  the  fact that<br \/>\n     admittedly the  applications filed by the petitioners<br \/>\n     were  incomplete  and were thus liable to be  rejected<br \/>\n     summarily, no  case  has been made out  to  grant the<br \/>\n     relief  as prayed in this writ petition in exercise  of<br \/>\n     jurisdiction  under Article 226 of the Constitution  of<br \/>\n     India.\n<\/p>\n<p> 9.    Learned counsel for the petitioner at this stage<br \/>\n     makes  a further request that taking into consideration<br \/>\n     that  the petitioners were all registrants under1979<br \/>\n     scheme  who  could not be allotted flats due  to  large<br \/>\n     number   of   applications  received  and  thereafter<br \/>\n     converted into SFS VI-B scheme and even applied  under<br \/>\n     IX SFS  scheme,  they should not be totally  left out<br \/>\n     having  waited  for  almost 23 years for  allotment  of<br \/>\n     flat.   It is  further  stated  that  the process  of<br \/>\n     allotment of MIG flats are going on at present and the<br \/>\n     senioirty of   the  petitioners in   the   original<br \/>\n     registration should have reached by now.\n<\/p>\n<p> 10.    I  find some force in the contention of  learned<br \/>\n     counsel  for  the petitioners.  I thus direct that the<br \/>\n     case  of the petitioners be considered  sympathetically<br \/>\n     by the  respondent for allotment of a MIG flat as per<br \/>\n     their   original  registration,   seniority  number  as<br \/>\n     registered under 1979 scheme specially in view of the<br \/>\n     fact  allotments  are still being made under  the said<br \/>\n     category. A decision be taken in this behalf within a<br \/>\n     period  of six  weeks from today which would  be duly<br \/>\n     communicated to the petitioner.\n<\/p>\n<p> 11.
