JUSTICE MAHESH BHAGWATI<\/p>\n<p>Mr. Vishwajeet Mantri, for the petitioner.\n<\/p>\n<p>Mr. Amit Punia, Public Prosecutor for the State.\n<\/p>\n<p>\t\tThis order governs the disposal of  bail application filed under Section 439 of Cr.P.C. by Mr. Vishwajeet Mantri Advocate on behalf of the applicant Zakir pertaining to F.I.R. No. 246\/2007 of police station Kekri, Ajmer, in the offences under Sections 363, 366 and 120-B of IPC.\n<\/p>\n<p>2.\t\tHeard learned counsel for the petitioner as also learned Public Prosecutor appearing for the State and perused the relevant material available on record.\n<\/p>\n<p>3.\t\tLearned counsel for the petitioner has canvassed that the co-accused Ahajad Khan @ Ballu has already been enlarged on bail by the co-ordinate Bench and the case of the petitioner is rather on a better footing than that of the co-accused person, hence, the petitioner may also be granted indulgence of bail on the ground of parity.\n<\/p>\n<p>4.\t\tLearned Public Prosecutor has opposed the bail petition.\n<\/p>\n<p>5.\t\tHaving considered the submissions made at the bar and carefully scanned the relevant material available on record, I, without expressing any opinion on the merits of the case, do feel inclined to grant indulgence of bail to the accused petitioner.\n<\/p>\n<p>6.\t\tIt is, therefore, ordered that the accused petitioner Zakir S\/o. Farukh Musalman in F.I.R.
