at 50% to determine the corn-pensatyiori <\/p>\n
towards ‘loss of future earningps_’__,V@__ <\/p>\n
4. Perppvcontra,  appearing for
\nthe    support of the
\nJudgment   Tribunal.\n<\/p>\n
5. Jcornpany has not disputed the
\nfacturn of  involvement of goods Tempo bearing<\/p>\n

its’? coverage of insurance policy.<\/p>\n
 of the Tribunal that the accident in<\/p>\n
question; to rash and negligent driving of the driver<\/p>\n
the offending vehicle remain un–chal1enged. Thus, the<\/p>\n

‘there-Vis”v.no:fsiil:i_stance in the contention of the learned<\/p>\n
and effective license to drive the vehicle and that the
\n  l’i-risnrlance company is not liable t.o pay the compensation.<\/p>\n
K :ll.c__c5:ordingly, i answer point No.[i) against the appellant.<\/p>\n
4<\/span>\n<\/p>\n
i) Whethei’ the driver of the offending vehicle had<\/p>\n
valid and effective license to drive the vehicle as
\non the date of accident?.\n<\/p>\n
ii) Whether Tribunal is justified in taking 50%
\npermanent physical disability to deterniilnepthe
\ncompensation payable towards
\nearnings’ of the injured’?     0<\/p>\n
6. Point No.    of  the
\nattested copy opfpvihe   driver of the
\noffending   had obtained
\nlicense   up to 21.11.2014 to
\ndrive  vvell as ‘heavy goods vehicle’<\/p>\n
from  to’el._17f05.2003 and once again it is<\/p>\n
coiinsel  driver of the offending vehicle had no valid<\/p>\n
vi-iv’<\/p>\n
5<\/span>\n<\/p>\n
7. Point No. (ii): In so far as the determination<\/p>\n
of compensation towards ‘loss of future earnings’ and other
\nheads is concerned, the wound certificate Ex.P.4 reveals<\/p>\n
that the claimant had sustained as many as four ‘i.njiiries<\/p>\n
out of which one injury is grievous in natur_e;T””–.Fn:rthe1:g<\/p>\n

assessed the disability with reference<\/p>\n

ll1_a:s._:. injured–claimant had suffered 50%<\/p>\n
  permanent ipliynsical disability. Having regard to the fact<\/p>\n
 thevalceident had occurred in the year 2006 and the<\/p>\n
  was aged 18 years, the Tribunal has rightly took<\/p>\n
 income of the injured at Rs.3000\/– per month and<\/p>\n
W<\/p>\n

applying appropriate multiplier determined the
\nCompensation of Rs.1,92.000\/~ towards ‘loss of future
\nearnings’. On roappreciation of entire material on
\nrecord, I do not find any reason to interfere
\nfinding. Accordingly, I answer point No.
\nthe appellant–ir1surance companyandpasshthpelifolllovfingi”.1.’ll V<\/p>\n
