Justice S.S.SATHEESACHANDRAN\n\n Dated :04\/01\/2010\n\n O R D E R\n                    S.S.SATHEESACHANDRAN, J.\n                    -----------------------------------\n                    W.P.(C).No.37695 of 2009 - O\n                    ---------------------------------\n               Dated this the 4th day of January, 2010\n\n                            J U D G M E N T\n<\/pre>\n<p>      Writ petition is filed seeking the following reliefs:<\/p>\n<p>            &#8220;i)   To issue a direction to the Sub Court, North<\/p>\n<p>      Paravur to consider and dispose I.A.No.4249\/2009 and<\/p>\n<p>      I.A.No.4260\/2009     in   O.S.No.232\/2000      filed by   the<\/p>\n<p>      petitioner as early as possible within a time limit.<\/p>\n<p>            ii)   To issue a direction to the Sub Court, North<\/p>\n<p>      Paravur to keep in abeyance all the further execution<\/p>\n<p>      proceedings in E.P.No.127\/2009 in O.S.No.232\/2000 till<\/p>\n<p>      Exts.P1 and P2 are considered.&#8221;\n<\/p>\n<p>      2.    Petitioner is the 7th defendant in O.S.No.232 of 2000<\/p>\n<p>on the file of the Sub Court, North Paravur.             Suit is one for<\/p>\n<p>partition. After passing of the final decree, execution proceedings<\/p>\n<p>are now in progress.         Petitioner\/7th defendant who was set<\/p>\n<p>exparte during the trial of the case has now moved an application<\/p>\n<p>for setting aside the decree passed against her as exparte.<\/p>\n<p>Pending consideration of his application the execution be kept in<\/p>\n<p>abeyance is the grievance espoused in the writ petition invoking<\/p>\n<p>the supervisory jurisdiction vested with this Court under Article<\/p>\n<p>227 of the Constitution of India.\n<\/p>\n<p>W.P.(C).No.37695 of 2009 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>       3.  I heard the counsel for the petitioner. Having regard<\/p>\n<p>to the submissions made and taking note of the facts and<\/p>\n<p>circumstances presented, I find no notice to the respondent is<\/p>\n<p>necessary and it is dispensed with.\n<\/p>\n<p>       4.  Whatever be the ground available to the petitioner to<\/p>\n<p>seek for setting aside the decree passed against her exparte, I<\/p>\n<p>find the writ jurisdiction of this Court cannot be invoked for<\/p>\n<p>staying the execution of a decree rendered by the court after a<\/p>\n<p>full fledged trial. She had notice of the proceedings and in fact<\/p>\n<p>after appearance before the court petitioner was declared<\/p>\n<p>exparte. By filing a writ petition, petitioner now seeks to delay<\/p>\n<p>the execution of the decree granted in favour of the decree<\/p>\n<p>holder.
