This appeal is \ufb01led under Section 173 (1) of Isl’:\/.\u00bb Act
\nagainst the judgment and award dated 16.05.2005 pas-sed, in
\nMVC No.29\/2002 on the \ufb01le of the learned Civil Judge,(iS\u00abr_’.\ufb01Dn..)<\/p>\n
and JMFC, Hangal, partly allowing the claim_.\u00a7i_petit_1’on__” 1″-arm<\/p>\n
compensation and seeking enhancement of compe~nsait’ion1 0<\/p>\n
This appeal coming on for hea’r’ing,\u00ab ithis ‘.thieVc’ouirt
\ndelivered the following: 2   Y X   ..\n<\/p>\n
JUDGMENT:.\n<\/p>\n
Heard the learned counsel_’i:i’for the appelilantiiand also<\/p>\n
learned counsel for the 20″-“ill._rf;gpo_ndVen.t\u00a5’I.nsurance Company.\n<\/p>\n
2. This appeal–i;s’—by the _cliaiInanit’_*seek’i:ng enhancement of
\ncompensa\ufb01on. thfe”–groun.d th’at'”ithe MACT erred in not<\/p>\n
awardingi”‘-adequate  under the head of medical<\/p>\n
expenses  to:ya1:d\u00a7;;1oss of amenities of life although the<\/p>\n
.-‘v.appel_’i”eir1t: had suiferesc1___45% limb disability as per the medical<\/p>\n
iii-.\u00a73V’i(i:iC’1″l.C\u20ac \u00bbandi’ha’vi.r1g suffered 8 injuries out of which injuries 3<\/p>\n
to  are   nature. The MACT ought to have awarded<\/p>\n
jcompensatiyonii adequately under the above heads and further<\/p>\n
 :subi’riission made is that though Insurance Policy was<\/p>\n
 and also was in force MACT had put the liability on<\/p>\n
 owner of the vehicle but not on the Insurance Company<\/p>\n
and hence the said error also requires to be rectified and<\/p>\n
liability be put on the Insurance Company.<\/p>\n
3. Learned counsel for the respondent~Insurance_<\/p>\n
argued that while the policy is admitted and   <\/p>\n
force as on the date of the accident, themliability be   the<\/p>\n
Insurance Company. However, as V’f.ar’;as the.<\/p>\n
compensation is concerned, subfni,ssion’..made~_. is; that the’<\/p>\n
Tribunal did not accept: the medieal llbills prod-uced by the
\nappellant because the bills didl’co–ny.ii1ce–.the Tribunal as
\nhaving not weighed’in_   tofgthe bills the names
\nof different personsiiways’fou.n;d.._an–d thesaid names was struck
\noff and the ‘apl1’ellaTl1’ti,lSli r1ame”—was written and as such MACT<\/p>\n
was justi\ufb01ed, “in  l Rs.10,000\/– towards medical<\/p>\n
 expenses. ‘As far aspdisability is concerned, submission is that<\/p>\n
 ‘dopctor viexairnined before the Tribunal did not speak about<\/p>\n
any .sabil __  ‘ ‘ <\/p>\n
-,4. Tal<:ing"'into account the above submission, as far as<\/p>\n
liiiabiliity is\ufb02concerned in View of the policy being said to be in<\/p>\n
I_t;\u00a3oi+.~.pVe"a\u00e9 on the date of the accident, the liability will fall on the<\/p>\n

Insurance Company and to the said extend the order of the<\/p>\n
Tribunal requires to be modi\ufb01ed. As far as the quantum of<\/p>\n
compensation is concerned, having examined the on.'<\/p>\n
record by the Tribunal, I am of the View that theVicomp::_e'nsatior:_p <\/p>\n
does not require any enhancement uncle": the: heads ._loss of<\/p>\n
income, pain and suffering and mediCal"–eXpensesf " Howetverl,'-..g<\/p>\n
towards loss of amenities of life, in View of the inreclical eyidence<\/p>\n
indicating shortening of 'the right'  cm and
\nwasting of calf mussals by _thigh.rr1'ussals by 4 cms
\nand the appellantdiaviril\u00e9  out of which<\/p>\n
injuries 3 to  pn'ature.V.taking all these factors
\ninto account iAan}'rl_.r   fracture of the upper 1\/ 3rd of
\nright \ufb01bula pp and  shaft of right tibia and the<\/p>\n
disability percentage hvmentiioned by the doctor, towards loss of<\/p>\n
' 'amerii–tiles3..I?s.''15,000 V-"iimiore is awarded.<\/p>\n
 if  therefore allowed by enhancing the<\/p>\n
  compensation' Rs.l5,000\/– which shall carry interest at 6%<\/p>\n
 Tlie.li'ability is on the Insurance Company to satisfy the<\/p>\n
if   amount as also the enhanced amount and the liability<\/p>\n
