            Aggrieved by a judgment dated 14th June, 2010 in W.P.<\/p>\n
(C) No.18438 of 2010 the partially successful petitioner preferred<\/p>\n
the instant writ appeal.\n<\/p>\n
            2. The appellant is a holder of FL-3 licence under the<\/p>\n
provisions of the Kerala Abkari Act read with the Foreign Liquor<\/p>\n
Rules,1972. The said licence authorises the holder of such a licence<\/p>\n
to serve liquor at the hotel run by the appellant. The liquor which is<\/p>\n
to be sold in such an establishment, it appears, is purchased by the<\/p>\n
appellant from the Kerala State Beverages (M&M) Corporation<\/p>\n
Limited.\n<\/p>\n
            3. Under sub-rule (5) of Rule 35 of the Rules of the High<\/p>\n
Court of Kerala, 1971 read with Rule 159 of the said Rules, a<\/p>\n
memorandum of appeal would require to contain a synopsis<\/p>\n

containing the “dates and events chronologically arranged, points to be<\/p>\n
urged, Acts\/Rules to be referred and authorities to be cited”. Rule 35<\/p>\n
of the Rules of the High Court of Kerala reads as follows:<\/p>\n
                     “35. Form of Proceedings.– (1) All petitions,<\/p>\n
            Affidavits, Memoranda of appeal and other proceedings<\/p>\n
            presented to the court shall be typewritten or printed on one<\/p>\n
            side, fairly and legibly, on stamp paper or on white foolscap<\/p>\n
            folio paper, with an outer margin of about 4 c.m. and an<\/p>\n
            inner margin of about 1.5 cm. Numbers shall be expressed<\/p>\n
            in figures.\n<\/p><\/blockquote>\n
                   (2) All main proceedings such as Writ Petitions, Writ<\/p>\n
            Appeals, Contempt Petitions, Civil and Criminal Appeal<\/p>\n
            Memoranda, Revision Petitions, etc., shall be presented to<\/p>\n
            the Court with thick covering sheets of thick durable paper<\/p>\n
            bearing protected holes at the top and bottom left hand<\/p>\n
            corner one inch apart from the outer edges, placed at the top<\/p>\n
            and bottom.<\/p><\/blockquote>\n
                   (3) All proceedings shall be presented in book form<\/p>\n
            without folding, neatly stitched in one bunch on the left<\/p>\n
            margin and the pages therein shall be consecutively<\/p>\n
            numbered.     In the main proceedings, the thick covering<\/p>\n
            sheets at the top and bottom shall be left unstitched and<\/p>\n
            shall be tied together with other papers by passing<\/p>\n
            removable tags through the holes at the top and bottom left<\/p>\n

            hand corners. The entire case file proceedings shall further<\/p>\n
            be tied across using white tape.\n<\/p>\n
                    (4) All main proceedings shall contain an index sheet<\/p>\n
            placed immediately below the covering sheet, setting forth<\/p>\n
            the brief description of the contents therein with reference<\/p>\n
            to the respective page numbers. One blank sheet shall be<\/p>\n
            placed below the index sheet for making further entries.<\/p>\n
                    (5) A synopsis containing the dates and events<\/p>\n
            chronologically arranged, points to be urged, Acts\/Rules to<\/p>\n
            be referred and authorities to be cited shall be filed along<\/p>\n
            with all main proceedings and shall be placed below the<\/p>\n
            blank sheet.\n<\/p>\n
                    (6) Miscellaneous petitions filed along with main<\/p>\n
            proceedings shall be placed immediately before the<\/p>\n
            covering sheet at the bottom of the main proceedings and<\/p>\n
            shall be flagged noting “I.A.No….”\n<\/p>\n
                    (7) Miscellaneous petitions and pleadings filed in<\/p>\n
            pending cases shall be flagged noting thereon “IA<\/p>\n
            No….”\/brief description of pleading such as “Counter by<\/p>\n
            R……. Reply by R………\/Statement by …………”etc.”<\/p>\n
            4. Memorandum of the instant writ appeal does not contain<\/p>\n
any information whatsoever as to what are the basic facts which<\/p>\n
provided the cause of action for the writ petition.                The pleadings are<\/p>\n
wholly unsatisfactory. Obviously the learned counsel for the appellant<\/p>\n

believes that it is the responsibility of the Judges to wade through all<\/p>\n
the papers filed to make out a case and decide very ‘wisely’ in favour<\/p>\n
of the appellant. We are afraid that the law is otherwise. We have<\/p>\n
already noticed the relevant provision governing the pleadings in this<\/p>\n
Court.\n<\/p>\n
            5. Unfortunately, the memorandum of grounds does not<\/p>\n
disclose the period for which the appellant’s tax liability was<\/p>\n
determined except a bald statement at paragraph 2 that “However a<\/p>\n
best judgment assessment was made by the 2nd respondent determining<\/p>\n
a total tax liability at Rs.33,97,779\/-“. Confronted with the question,<\/p>\n
the learned counsel for the appellant submits that the details are<\/p>\n
contained in the writ petition and he is of the opinion that since what is<\/p>\n
questioned is a garnishee order passed against the appellant pursuant<\/p>\n
to the assessment, the appellant need not disclose the further details of<\/p>\n
the assessment. We are afraid that such an understanding of the nature<\/p>\n
of the pleadings is wholly inconsistent with the law or the practice. In<\/p>\n
the circumstances, we decline to exercise our jurisdiction under Article<\/p>\n

            The writ appeal is therefore dismissed at the admission<\/p>\n
