Justice M.SASIDHARAN NAMBIAR\n\n Dated :08\/01\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n               Crl.M.C.No.66 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner is the accused in S.T.No.109\/2008,<\/p>\n<p>now pending as L.P.No.247\/2008, on the file of<\/p>\n<p>Judicial First Class Magistrate&#8217;s Court, Mattannur,<\/p>\n<p>taken cognizance for the offence under Section 138<\/p>\n<p>of Negotiable Instruments Act. As petitioner did<\/p>\n<p>not  appear,  the  case  was   transferred  to  the<\/p>\n<p>register of long pending cases. A non bailable<\/p>\n<p>warrant  is  pending.  Petitioner  filed  C.M.P.No.<\/p>\n<p>3940\/2009 under Section 205 of Code of Criminal<\/p>\n<p>Procedure for exemption from personal appearance.<\/p>\n<p>By Annexure-A2 order, petition was dismissed.<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>    3.  Annexure-A2   order   shows  that   learned<\/p>\n<p>Magistrate dismissed the petition on the ground<\/p>\n<p>that the case now stands included in the register<\/p>\n<p>of long pending cases and as provided under Section<\/p>\n<p><span class=\"hidden_text\">CRMC 66\/10               2<\/span><\/p>\n<p>15(2) of Criminal Rules of Practice, unless the<\/p>\n<p>accused person appears, the case cannot be removed<\/p>\n<p>from the register of long pending cases and without<\/p>\n<p>removing the same, petitioner is not entitled to<\/p>\n<p>get exemption from personal appearance.<\/p>\n<p>    4. Rule 15 of Criminal Rules of Practice deals<\/p>\n<p>with cases in which accused has absconded. Under<\/p>\n<p>sub-rule(1) of Rule 15, when process has been<\/p>\n<p>issued for the attendance of the accused and the<\/p>\n<p>case remained pending for a long time, owing to<\/p>\n<p>non-appearance of the accused and Magistrate is<\/p>\n<p>satisfied that presence of the accused cannot be<\/p>\n<p>secured within a reasonable time, Magistrate is<\/p>\n<p>empowered to remove the case from the register of<\/p>\n<p>cases and to enter it in the register of long<\/p>\n<p>pending cases. Sub-rule(2) of Rule 15 provides that<\/p>\n<p>if subsequently the accused person is apprehended<\/p>\n<p>or appears or ceases to be insane, the case against<\/p>\n<p>him  shall  be  treated  as  a  new  case,  entered<\/p>\n<p>accordingly in the register of cases received and<\/p>\n<p><span class=\"hidden_text\">CRMC 66\/10               3<\/span><\/p>\n<p>dealt with according to law.\n<\/p>\n<p>    5. It is in view of sub-rule(1) of Rule 15 of<\/p>\n<p>Criminal Rules of Practice, learned Magistrate has<\/p>\n<p>taken a view that presence of the petitioner cannot<\/p>\n<p>be exempted before his actual appearance. Sub-rule<\/p>\n<p>(2) of Rule 15 provides that after a case is<\/p>\n<p>included in the register of long pending cases, if<\/p>\n<p>the accused person is apprehended or appears or<\/p>\n<p>ceases to be insane, the case is to be entered in<\/p>\n<p>the register of cases as a new case. It does not<\/p>\n<p>mean that appearance should be personal. If the<\/p>\n<p>accused appears through counsel, when the case is<\/p>\n<p>included in the register of long pending cases, it<\/p>\n<p>cannot be said that it is not the appearance of the<\/p>\n<p>accused for the purpose of sub-rule (2) of Rule 15<\/p>\n<p>to enter it in the register of cases. If that be<\/p>\n<p>so,   learned  Magistrate  was  not  justified   in<\/p>\n<p>dismissing the petition on that ground. This Court<\/p>\n<p>has already held that even after issuance of a non<\/p>\n<p>bailable   warrant, if  the  accused  applies   for<\/p>\n<p><span class=\"hidden_text\">CRMC 66\/10                4<\/span><\/p>\n<p>exemption under Section 205 of Code of Criminal<\/p>\n<p>procedure  in  a  case   taken cognizance  for  the<\/p>\n<p>offence under Section 138 of Negotiable Instruments<\/p>\n<p>Act, Magistrate is competent to grant exemption<\/p>\n<p>under Section 205 of Code of Criminal Procedure.<\/p>\n<p>     5. In such circumstances, Annexure-A2 order is<\/p>\n<p>quashed.
