He submitted that injured informant was released from the<br \/>\nhospital within short span of one day.  He further submitted that<br \/>\nother co-accused except the principal accused has been released on<br \/>\nbail by different order passed by this Court.  He further submitted<br \/>\nthat the applicant is in jail since 2.9.2010 and the trial is<br \/>\nunlikely to be over shortly.  He pointed out that the applicant has<br \/>\nno criminal antecedent.\n<\/p>\n<p>2.\t\tUnder<br \/>\nthe circumstances, this application is granted. The<br \/>\napplicant is  ordered to be released on bail<br \/>\nin connection with the offence registered with Ishanpur Police<br \/>\nStation, Ahmedabad bearing CR No.I 201 of 2010 on applicant executing<br \/>\na bond of Rs.10,000\/- (Rupees: Ten Thousand Only) with one surety of<br \/>\nlike amount to the satisfaction of the lower Court and subject to the<br \/>\nconditions that the applicant shall,<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of or abuse the liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nact in manner injurious to the interest of the prosecution.\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>(d)\tfurnish<br \/>\nthe address of his residence at the time of execution of bond and<br \/>\nshall not change the residence without prior permission of the trial<br \/>\nCourt Court.\n<\/p>\n<p>(e)\tsurrender<br \/>\nhis passport, if any, to the lower court immediately from the date of<br \/>\nthis order.\n<\/p>\n<p>3.\t\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nany other offence for the time being.\n<\/p>\n<p>4.\t\tIf<br \/>\nbreach of any of the above conditions is committed the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take any appropriate<br \/>\naction in the matter.\n<\/p>\n<p>5.\t\tBail-bond<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>6.\t\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations, which are purely prima facie, tentative and preliminary<br \/>\nnature and have been made only for the purpose of examining prayer<br \/>\nfor bail pending the trial. The Court shall arrive at its own<br \/>\nconclusion independently on the basis of the evidence and other<br \/>\naspects of the case.\n<\/p>\n<p>7.\t\tRule<br \/>\nis made absolute to the aforesaid extent.
