(ORAL)\n<\/pre>\n<p>               Present petition has been filed under Articles 226\/227 of the<\/p>\n<p>Constitution of India seeking quashing of impugned order (Annexure P-1).<\/p>\n<p>               Notice of motion.\n<\/p>\n<p>               Mr. Ashish Kapoor, appearing for the Caveator, accepts<\/p>\n<p>notice. Copy of the petition has been handed over to him.<\/p>\n<p>               Mr. Ashish Kapoor states that the matter is squarely covered<\/p>\n<p>by the ratio of judgment rendered in &#8216;<a href=\"\/doc\/816508\/\">Munish Gupta v. Union of India&#8217;<\/a><\/p>\n<p>2009 (1) RCR (Civil) 365. The judgment has been perused by the counsel<\/p>\n<p>for the petitioners. He very fairly states that the matter is covered by the<\/p>\n<p>ratio of law laid in said judgment. However, he makes an alternative prayer<\/p>\n<p>that in terms of Clause 61 of the agreement, respondent corporation has<\/p>\n<p>to appoint an Arbitrator.
