UPADHYAYA\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 14\/08\/2008 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE THE ACTING CHIEF JUSTICE MR. M.S.SHAH)<\/p>\n<p>\tMr. B.B. Naik,<br \/>\nlearned counsel for the appellant states that the show cause notice<br \/>\nimpugned in the present proceedings is issued on the basis of<br \/>\nconviction of late Mohanlal Karsandas Amin, by judgment and order<br \/>\ndated 4th May, 1991, passed by the learned Chief Judicial<br \/>\nMagistrate, Mehsana for violation of Foreign Exchange Regulations<br \/>\nAct, 1973, that Mohanlal Karsandas Amin expired on 8th<br \/>\nJuly, 1997 and thereafter, the impugned notice has been issued on<br \/>\n15th October, 2007 to the widow of the deceased (appellant<br \/>\nNo.1), 92 year old Partner of the deceased (appellant No.2) and<br \/>\nnephew of the deceased (appellant No.3), who joined the Partnership<br \/>\nfirm in the year 1996.\n<\/p>\n<p>2.  It is therefore,<br \/>\nsubmitted by Mr. Naik that the above facts are sufficient to show the<br \/>\nprejudice to the appellants on account of the gross delay of 16 years<br \/>\nin issuing the notice under Foreign Exchange Manipulators (Forfeiture<br \/>\nof Property) Act, 1976.  Mr. Naik has placed reliance on the decision<br \/>\nof the Apex Court in State of Punjab and ors. Vs. Bhatinda District<br \/>\nCo-operative Milk Producers&#8217; Union Limited ?  2007 (11) SCC 363.<br \/>\nMr. Naik further submits that Special Civil Application is already<br \/>\nadmitted and, therefore, in view of the above peculiar facts, the<br \/>\nlearned Single Judge ought not to have vacated the ad-interim relief<br \/>\nand ought to have confirmed the ad-interim relief as interim relief,<br \/>\ntill final disposal of the petition.\n<\/p>\n<p>3.\tNotice for final<br \/>\ndisposal returnable on 16th September, 2008.\n<\/p>\n<p>4.\tDirect service is<br \/>\npermitted to the respondents.\n<\/p>\n<p>5.\tTill the next date<br \/>\nof hearing, the ad-interim relief granted  by the learned Single<br \/>\nJudge on 26.11.2007 shall continue to operate.\n<\/p>\n<p>\t\t\t\t\t\t(M.S.
