,0 Subseeiiiently, survey numbers were changed as 346,<\/p>\n
  Plaintiff purchased the suit schedule<\/p>\n
property “under the registered sale deed dated<\/p>\n
0 0(3.__.1n1_ttit953 for a consideration of Rs.i,500\/– from his
\n sister Sn1t.Krishnamma. Since the date of<\/p>\n
Mpurehase, the plaintiff has been in possession and;<\/p>\n
enjoyment of the suit schedule property. 15% defendant<\/p>\n
claimed his right over the suit schedule property on the<\/p>\n
$32<\/p>\n
basis of the alleged sale deed dated 30.12.1965 and in<\/p>\n
this regard, he tried to interfere with the _4.;:)1a1r1t_iffs<\/p>\n

 a suit was decreed earlier on 05.01.2000 and<\/p>\n
  the._.A1SiV”defendant T.Ramaiah filed R.F.A.No.350\/2000
\nbefore this Court interalia alleging that he had no<\/p>\n
wopportunity. This Court set aside the judgment and<\/p>\n
decree with a direction to the parties to appear before<\/p>\n
the trial court on 15.03.2004 without any notice and<\/p>\n
trial court was directed to proceed with the matter.
\nDespite of opportunity, the 15′ defendant did not contest<\/p>\n
the matter, as such the trail court decreed the,–:suit on<\/p>\n
26.07.2005.\n<\/p>\n
6. Learned Counsel for the <\/p>\n
that after remand, 15′ defe1’1d_ant.__diedH <\/p>\n
and his legal representatives were  <\/p>\n
nor his Counsel Sri.-l?\u00a7ar,t_ia f.”K_amath l”‘~–,la”ppeared;’f<\/p>\n
unfortunately, the said learncti’p_:Co’t1_1f1sellhad also died in<\/p>\n
2004 itself and it is  thist~.cloI:1ter(t:,.’\ufb01\u00a7li’ther the L.Rs. of<\/p>\n

\nthe trial.  trial court decreed the suit<\/p>\n
 on the of the evidence of the plaintiff against<\/p>\n
  As such, he submitted that the decree is<\/p>\n
 ~.one  dead person and the same is liable to be<\/p>\n
Se a$7;;.6 On the contrary, learned Counsel for the<\/p>\n
 .res’pondents submitted that, this Court has speci\ufb01cally<\/p>\n
 \ufb01directed that the deceased defendant No.1 to appear<\/p>\n
and contest the matter. However, he did not dispute
\nthe death of 13’ defendant and his Counsel.\n<\/p>\n
8. In View of the above submissions’,   <\/p>\n
arises for consideration is as toil<\/p>\n
“Whether the ju_dgment’*and  of  it<\/p>\n
the trial court requires,interference?  A<\/p>\n
9. It is not —  vrelafter the order of
\nremand in  ‘delendant died on
\n19.0 1 .2005; Vjfvas’..the”contesting defendant
\nwho   of the suit schedule
\nproperty;   dispute that the Counsel<\/p>\n
representing”theV\u00ab_ defendant was also no more. In<\/p>\n

  “suit, and the decree has been passed<\/p>\n
against  ‘dead person without bringing the L.Rs. on<\/p>\n
 reco1’d,__l* No doubt, memo could have been filed, but<\/p>\n
 “unfortunately, the Counsel was also dead. Under these<\/p>\n
 .. ,,_._eircumstances, the judgment and decree of the trial<\/p>\n
court is required to be set aside. ;<\/p>\n
10. Accordingly, appeal is allowed, the judgment<\/p>\n
