Mr. P.D.\n<\/p>\n<p>Bhate, learned Additional Public Prosecutor waives service of rule on<br \/>\nbehalf of respondents.  In view of the facts and circumstances of the<br \/>\ncase and by consent of learned advocates for both the sides, this<br \/>\nmatter is taken up for final hearing today.\n<\/p>\n<p>\tThis Revision<br \/>\nApplication under section 397 read with section 401 of the Code of<br \/>\nCriminal Procedure, 1973 is failed against the judgment and order<br \/>\ndated 4th July 2008 passed by the Sessions Judge,<br \/>\nGandhinagar in Criminal Appeal No. 27 of 2008.\n<\/p>\n<p>\tShort facts of<br \/>\nthe case are as under:\n<\/p>\n<p>\tThe applicant<br \/>\nherein is the sole proprietor of Jagat Gas Agency which was engaged<br \/>\nin the business of distributing Gas.  The applicant is duly licensed<br \/>\nto run the said gas agency and has been running the agency since<br \/>\nseveral years.   On 09.05.08, District Supply Officer  visited the<br \/>\ngas agency when he found that the applicant had made certain<br \/>\nirregularities and stock of 124 bottles of gas cylinders worth<br \/>\nRs.38,375\/- were seized under the provisions of Essential Commodities<br \/>\nAct.  It is the say of the applicant that the said seizure was<br \/>\nwithout giving any notice or opportunity of hearing. However, on<br \/>\n16.05.08, a show cause notice was issued by the District Supply<br \/>\nOfficer to the applicant to remain present on 26.05.08.  The<br \/>\napplicant remained present, and after hearing the applicant, the<br \/>\nDistrict Supply Officer passed an order dated 12.06.08 confiscating<br \/>\n124 gas cylinders worth Rs.38,375\/- and also ordered to deposit<br \/>\nRs.6000\/- towards 100% amount of the deposit of licence.  Being<br \/>\naggrieved by the said order dated 12.06.08 passed by the District<br \/>\nSupply Officer, the applicant preferred Criminal Appeal No.27 of 2008<br \/>\nwas preferred before the Sessions Court, Gandhinagar and by judgment<br \/>\nand order dated 4th July 2008, the learned Sessions Judge<br \/>\ndismissed the appeal and confirmed the order passed by the District<br \/>\nSupply Officer.  Hence the present Revision.\n<\/p>\n<p>\tOn behalf of the<br \/>\napplicant, learned advocate Mr. Vyas vehemently submitted that the<br \/>\nseizure order 09.05.08 was passed by the District Supply Officer<br \/>\nwithout issuing notice. Learned advocate has placed reliance on<br \/>\nstatement of various persons recorded by the learned Judge, viz.<br \/>\nJagdishbhai Kishanlal Bhatt. Vishnubhai Babulal Nayak, Maheshbhai<br \/>\nManilal, Kadarmiya Umarmiya, Malek Haidarbhai, Bhupatsingh Popatlal<br \/>\nDarbar in support of the submissions canvassed by him at the bar.<br \/>\nLearned advocate submitted that the order passed by the learned<br \/>\nSessions Judge is contrary to law and evidence on record of the case<br \/>\nand, therefore, the same deserves to be quashed and set aside.<br \/>\nLearned advocate placed reliance on the provisions of section 6A and<br \/>\n6B of the Essential Commodities Act and submitted that there is gross<br \/>\nviolation of the provisions of the said sections, and, therefore, the<br \/>\norder of confiscation is liable to quashed and set aside.  Learned<br \/>\nadvocate for the petitioner also relied on the judgment in the case<br \/>\nof <a href=\"\/doc\/1201498\/\">K IRAN OIL INDUSTRIES vs. DISTRICT COLLECTOR, JAMNAGAR<\/a> reported<br \/>\nin 1996 (1) GLH 614.  Learned advocate for the petitioner further<br \/>\nsubmitted that there is a clear breach of the provisions of section<br \/>\n6A(1) of the Act, and, therefore also, the impugned confiscation<br \/>\norder requires to be quashed and set aside.  In the alternative,<br \/>\nlearned advocate for the petitioner submitted that the matter may be<br \/>\nremanded to the learned Sessions Judge and the learned Sessions Judge<br \/>\nmay be directed to hear the matter afresh and pass a fresh order<br \/>\ntaking into consideration the various contentions raised by him in<br \/>\nthis Revision. He further submitted that the learned Sessions Judge<br \/>\nmay also be directed to release the goods which are confiscated upon<br \/>\nhis furnishing Bank Guarantee for an amount equivalent to the value<br \/>\nof goods or any lesser amount to the satisfaction of the learned<br \/>\nJudge.\n<\/p>\n<p>\tOn the other<br \/>\nhand, Mr. Bhate, learned Additional Public Prosecutor submitted that<br \/>\nbefore passing the order of confiscation, notice was given.  As<br \/>\nregards non-compliance of section 6A(1), the learned Judge has dealt<br \/>\nwith the same in paragraph 7 of the judgment, and, therefore, there<br \/>\nis no merit in this submission. Learned APP submitted that since<br \/>\nadequate opportunity of hearing is afforded to the petitioner before<br \/>\npassing the order of confiscation, no interference is called for and<br \/>\nthis Revision Application requires to be rejected.\n<\/p>\n<p>\tI have heard<br \/>\nlearned advocate Mr. Vyas for the petitioner and Mr. Bhate, learned<br \/>\nAPP appearing for the respondent State. I have also perused the<br \/>\nimpugned judgment and order passed by the learned Sessions Judge and<br \/>\nthe documents available on the records.\n<\/p>\n<p>\tAs regards the<br \/>\nsubmission canvassed by learned advocate for the petitioner that no<br \/>\nnotice was given to the petitioner prior to passing the seizure<br \/>\norder, section 3 of the Act does not provide for giving any notice at<br \/>\nthe time of seizure of the goods under section 3 of the Act. Hence<br \/>\nthis submission has no merit.\n<\/p>\n<p>\tHowever, the<br \/>\nother limb of submissions canvassed by the learned advocate for the<br \/>\npetitioner requires consideration.  He has submitted that as per the<br \/>\nratio laid down in the judgment in the case of  KIRAN OIL<br \/>\nINDUSTRIES [supra], at the stage of issuing show cause notice<br \/>\nunder section 6B, all material which the authority may rely upon is<br \/>\nto be again put to the person concerned to enable him to defend<br \/>\nhimself in the matter. There is nothing on the record to show that<br \/>\nall such material were put to the petitioner.  Therefore, this matter<br \/>\nrequires re-consideration by the learned Sessions Judge.\n<\/p>\n<p>\tMoreover, section<br \/>\n6A(1) of the Act clearly provides that a report of the seizure shall<br \/>\nbe made to the Collector of the District in which such essential<br \/>\ncommodity is seized.  Even in paragraph 7 [page 8] the learned<br \/>\nSessions Judge has clearly held that  no seizure report was forwarded<br \/>\nto the Collector and that the respondent No.2 has never complied with<br \/>\nsection 6A of the Act. However, the said lacuna is sought to be<br \/>\nbrushed aside on the ground of a delegation order passed by the<br \/>\nDistrict Collector considering arrears of work of the Collector.<br \/>\nUltimately, the Sessions Judge has recorded that since the post of<br \/>\nDistrict Supply Officer is upgraded and converted to Class-I post,<br \/>\nthe District Supply Officer is authorized to exercise the power of<br \/>\n6A&amp;B of the Act also. The provisions of the Act, which is<br \/>\nstatutory in nature, cannot be made nugatory by administrative<br \/>\norders. When the Act provides that a junior officer report about his<br \/>\nactions to a senior officer, there is a purpose behind it, and the<br \/>\nsame cannot be done away by an administrative order.  From a plain<br \/>\nreading of the statute, it prima facie appears that the purpose of<br \/>\nsuch a provision for reporting is a safeguard and deterrent against<br \/>\nany error, commission, omission or abuse of powers vested under<br \/>\nsection 3 of the Act by the officers of the lower cadre. Even<br \/>\notherwise, it neither stands to the test of reasoning nor does the<br \/>\nAct provide so, for vesting powers of seizure and reporting in one<br \/>\nand the same officer. That apart, there is nothing on record, atleast<br \/>\nbefore this Court, to show under what provisions of the Act the<br \/>\nCollector has passed the delegation order.\n<\/p>\n<p>\tBe that as it<br \/>\nmay,  without expressing any opinion about the legality or otherwise<br \/>\non the aforesaid questions, this Court is of the opinion that this<br \/>\nmatter is required to be remanded to the learned Sessions Judge. The<br \/>\nimpugned order passed by the learned Judge is quashed and set aside.<br \/>\nThe matter is accordingly remanded to the learned Sessions Judge who<br \/>\nshall hear the matter afresh on all the points and pass an order on<br \/>\nmerit, without being influenced by the observations made in this<br \/>\norder. This exercise shall be done within a period of two months from<br \/>\nthe date of receipt of the writ of this order. In the meanwhile, it<br \/>\nwill be open to the petitioner to file an application before the<br \/>\nlearned Sessions Judge to release the bottles which are confiscated<br \/>\nupon his furnishing Bank Guarantee for an amount equivalent to the<br \/>\nvalue of goods or any lesser amount to the satisfaction of the<br \/>\nlearned Judge and the learned Sessions Judge shall pass an<br \/>\nappropriate order in that regard.\n<\/p>\n<p>\tThis Revision<br \/>\nApplication is partly allowed.
