Mr.S.Muthu Venkatesan\n\n\n\n:JUDGMENT\n<\/pre>\n<p>\tThis appeal is focussed as against the judgment and decree dated<br \/>\n27.04.2006, passed in M.C.O.P.No.2025 of 2004, on the file of the Motor<br \/>\nAccidents Claims Tribunal\/III Additional Sub Judge, Trichy.\n<\/p>\n<p>\t2. Heard both sides.\n<\/p>\n<p>\t3. The challenge in this Civil Miscellaneous Appeal is relating to the<br \/>\nquantum of compensation awarded by the Tribunal, vide judgment dated 27.04.2006,<br \/>\nto a tune of Rs.1,39,500\/-(Rupees One Lakh Thirty Nine Thousand and Five Hundred<br \/>\nonly) on the following sub-heads:<\/p>\n<pre>\n\t(i)  For Permanent Disability\t   \t- Rs.   67,500.00\n\t(ii) For Pain and Sufferings\t   \t- Rs.   25,000.00\n\t(iii) For Medical Expenses and\n\t\t Transport and food expenses\n\t\t for the attendants \t\t- Rs.    5,000.00\n\t(iv) For Loss of income during\n\t\ttreatment period and\n\t\tconvalescent period\t   \t- Rs.    5,000.00\n<\/pre>\n<p>\t(v)  For Future Medical Expenses \t&#8211; Rs.   25,000.00\n<\/p>\n<p>\t(vi) For Mental Agony\t\t   \t&#8211; Rs.   10,000.00\n<\/p>\n<p>\t(vii)For taking nutritious food  \t&#8211; Rs.    2,000.00\n<\/p>\n<p> \t\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>\t\t\t \t         Total  &#8211; Rs. 1,39,500.00\n<\/p>\n<p>\t\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>\t4. Being aggrieved by and dissatisfied with the said award, the appellant<br \/>\ninsurance company filed this appeal on the grounds inter-alia thus:<br \/>\n\tThe Tribunal in addition to having awarded a sum of Rs.25,000\/- towards<br \/>\npain and sufferings also awarded Rs.10,000\/- towards mental agony, over and<br \/>\nabove in awarding a sum of Rs.25,000\/- towards future medical expenses.<br \/>\nAccordingly, the appellant prays for modifying the quantum of compensation.\n<\/p>\n<p>\t5. During trial, on the side of the claimants P.W.1 and P.W.2 were<br \/>\nexamined and Exs.P.1 to 7 were marked.  There was no oral or documentary<br \/>\nevidence adduced  on the side of the respondents.\n<\/p>\n<p>\t6. The Point for consideration is as to whether the compensation  awarded<br \/>\nis just and proper?\n<\/p>\n<p>\t7.Point: The learned counsel for the appellant\/insurance company by<br \/>\ndrawing the attention of this Court to memorandum of appeal would develop his<br \/>\nargument to the effect that there should not be duplication of award of<br \/>\ncompensation under various sub heads.  The learned counsel for the claimant<br \/>\nwould submit that this is not a simple case of fracture of right Femur, but the<br \/>\nclaimant underwent serious laparotomy and in that process his muscle also got<br \/>\nincapacitated to some extent.  Consequently, the Doctor assessed the permanent<br \/>\ndisability at 45% and as such the compensation awarded is  moderate.\n<\/p>\n<p>\t8. The Tribunal towards permanent disability awarded a sum of Rs.67,500\/-,<br \/>\nwhereas under various other sub heads the Tribunal awarded compensation ignoring<br \/>\nthe well established norms.  Considering the fact that the claimant being an<br \/>\nyoung man of 32 years, working as electrical supervisor sustained injuries<br \/>\nduring the year 2004, a sum of Rs.2,000\/- for each percentage of permanent<br \/>\ndisability could be awarded. Accordingly, it comes to 45 x 2 = Rs.90,000\/-<br \/>\n(Rupees Ninety Thousand only). Under the sub-head pain and sufferings a sum of<br \/>\nRs.15,000\/- (Rupees Fifteen Thousand only) could be awarded.  For loss of income<br \/>\nduring the treatment period and the convalescent period a sum of Rs.5,000\/- as<br \/>\nawarded by the Tribunal, could be confirmed, because such  period there would<br \/>\nhave been no possibility of himself working and earning.  Towards taking<br \/>\nnutritious food a sum of Rs.2,000\/- was awarded, which also could be confirmed.<br \/>\nEven though he might have taken medical treatment in Government Hospital,<br \/>\nnonetheless he might have incurred some medical expenses, for which a sum of<br \/>\nRs.3,000\/- (Rupees Three Thousand only) could be awarded in addition to awarding<br \/>\na sum of Rs.2,000\/- (Rupees Two Thousand only) towards transport charges.<br \/>\nAccordingly,  the  compensation awarded, is modified as under:<\/p>\n<pre>\n\t(i)  For Permanent Disability\t   - Rs.   90,000.00\n\t(ii) For Pain and Sufferings\t   - Rs.   15,000.00\n\t(iii) For Medical Expenses \t   - Rs.    3,000.00\n\t(iv) For Loss of income during\n\t\ttreatment period and\n\t\tconvalescent period\t   - Rs.    5,000.00\n\t(v)  For Transport Expenses\t   - Rs.    2,000.00\n\t(vi) For taking nutritious food    - Rs.    2,000.00\n \t\t\t\t\t\t---------------\n\t\t \t         Total     - Rs. 1,17,000.00\t\t\t\t\n\t\t\t\t\t\t---------------\n\n<\/pre>\n<p>\t11. In the result, this appeal is partly allowed and  the compensation<br \/>\nawarded is reduced from Rs.1,39,500\/-(Rupees One Lakh Thirty Nine Thousand and<br \/>\nFive Hundred) to Rs.1,17,000\/- (Rupees One Lakh and Seventeen Thousand only).<br \/>\nIn other aspects the award shall hold good.  Consequently, connected M.P.(MD)<br \/>\nNo.2 of 2007 and 1 of 2008 are closed.
