No. 2205 of 2008\n           -------------------------------------------------\n           Dated this the 12th day of June, 2008\n\n                              ORDER\n<\/pre>\n<p>      The petitioner faces indictment in a prosecution for<\/p>\n<p>offences punishable under the Kerala Abkari Act. The crime<\/p>\n<p>was registered long back.       Investigation was completed and<\/p>\n<p>the final report was filed.      Cognizance was taken and the<\/p>\n<p>committal proceeding was registered in the year 2002.             The<\/p>\n<p>petitioner was not available.      The case against him was split<\/p>\n<p>up and transferred to the list of Long Pending Cases in 2003.<\/p>\n<p>The petitioner is the sole accused in the case.         The petitioner<\/p>\n<p>has not entered appearance so far.         Coercive processes have<\/p>\n<p>been issued against the petitioner by the learned Magistrate.<\/p>\n<p>The petitioner apprehends imminent arrest in execution of<\/p>\n<p>such processes.\n<\/p>\n<p>      2. The petitioner had moved the learned Sessions Judge<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 2205 of 2008 -: 2 :-<\/span><\/p>\n<p>for anticipatory bail.  The same was turned down by Annexure-<\/p>\n<p>A1 order. According to the petitioner, he is absolutely innocent.<\/p>\n<p>His absence earlier was not wilful or deliberate. The petitioner,<\/p>\n<p>in these circumstances, wants to surrender before the learned<\/p>\n<p>Magistrate and seek regular bail.      The petitioner apprehends<\/p>\n<p>that his application for regular bail may not be considered by the<\/p>\n<p>learned Magistrate on merits, in accordance with law and<\/p>\n<p>expeditiously. It is, in these circumstances, that the petitioner<\/p>\n<p>has come to this Court for a direction to the learned Magistrate<\/p>\n<p>to release him on bail when he appears before the learned<\/p>\n<p>Magistrate.\n<\/p>\n<p>       3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate    and   explain   to  the   learned   Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned   Magistrate    would    not  consider   the   petitioner&#8217;s<\/p>\n<p>application for regular bail on merits, in accordance with law<\/p>\n<p>and expeditiously.     No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2205 of 2008 -: 3 :-<\/span><\/p>\n<p>     4.   In the result, this Crl.M.C. is dismissed; but with the<\/p>\n<p>observation that if the petitioner surrenders before the learned<\/p>\n<p>Magistrate and seeks bail, after giving sufficient prior notice to<\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself. Needless to say,<\/p>\n<p>the application for bail will have to be considered in the light of<\/p>\n<p>the decision in <a href=\"\/doc\/1158859\/\">Sukumari v.
