PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.RS Mankad, for the appellants.<br \/>\nMr.Sandeep Saruparia, for the respondents.\n<\/p>\n<p>                             &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>      Heard learned counsel for the parties.\n<\/p>\n<p>      The   trial     court    decreed          the    suit    of    the<br \/>\nrespondents\/plaintiffs\/landlords                 for    eviction      of<br \/>\nthe   appellants\/tenants           vide      judgment    and       decree<br \/>\ndated   16.5.2006       on   the       ground    of    the    personal<br \/>\nbonafide necessity of the plaintiffs and because<br \/>\nof committing default in payment of rent by the<br \/>\nappellants\/tenants and further because of making<br \/>\nmaterial    alteration        in       the   suit     premises.      The<br \/>\ntrial court&#8217;s judgment and decree dated 16.5.2006<br \/>\nwas upheld by the appellate court vide judgment<br \/>\nand   decree    dated    18.1.2010.          Hence,     this       second<br \/>\nappeal.\n<\/p>\n<p>      Learned counsel for the appellants vehemently<br \/>\nsubmitted      that   the     plaintiffs         filed       the    suit<br \/>\n<span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>without there being any necessity of theirs for<br \/>\nthe suit premises and so far as the default is<br \/>\nconcerned, according to learned counsel for the<br \/>\nappellants, they deposited the rent subsequently<br \/>\nand that was withdrawn by the plaintiffs\/landlord,<br \/>\ntherefore, the plaintiffs waived their right to<br \/>\nget decree for eviction on the ground of default.<br \/>\nLearned counsel for the appellants also tried to<br \/>\nassail the finding with regard to the allegation<br \/>\nof   material          alteration in             suit     premises      by   the<br \/>\nappellants.\n<\/p>\n<p>       I     considered           the       submissions          of     learned<br \/>\ncounsel for the parties and perused the facts of<br \/>\nthe case as well as the impugned judgments.\n<\/p>\n<p>       So far as default in payment of rent by the<br \/>\nappellants          is      concerned,           that     fact    cannot     be<br \/>\ndenied      and,       therefore,         the      appellants         took   the<br \/>\nplea that the respondents waived their right to<br \/>\nevict the appellants from the suit premises on the<br \/>\nground of default. However, the said plea has not<br \/>\nbeen       taken    by      the    appellants           before    the     trial<br \/>\ncourt      or    before      the    first         appellate court.           The<br \/>\norder       of     striking         off          the    defence       attained<br \/>\nfinality         and     legality           of     that    is     not     under<br \/>\nchallenge in view of the fact that the appellants<br \/>\nare only challenging that the respondents waived<br \/>\ntheir       right      to    evict      the        appellants         from   the<br \/>\npremises in question on the ground of default. In<br \/>\n<span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>view    of   the    fact     of      attaining     finality,       the<br \/>\nappellants     cannot      be     heard       on   the   issue      of<br \/>\ncommission of default. Furthermore, there is no<br \/>\nconscious waiver of the respondents so far as the<br \/>\nappellant&#8217;s        default      in       payment    of      rent    is<br \/>\nconcerned    nor     there      is       implied   waiver    in    any<br \/>\nmanner.\n<\/p>\n<p>       The other questions are pure questions of fact<br \/>\nand which have been assailed only on the basis of<br \/>\nappreciation of evidence which is not permissible<br \/>\nunder Section 100 CPC.
