APP (DB) No.1225 of 2010\n                            MUKESH YADAV\n                                  Versus\n                            STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>02\/   12.10.2010                 Admit the appeal.<\/p>\n<p>                                 Call for the Lower Court Records.<\/p>\n<p>                                 Appellant Mukesh Yadav has been convicted<\/p>\n<p>                   under Section 302\/34 of the Indian Penal Code and 27(1)<\/p>\n<p>                   of the Arms Act.\n<\/p>\n<p>                                 Counsel for the appellant submits that there is<\/p>\n<p>                   only one eye witness PW 2, son of the deceased, even he<\/p>\n<p>                   has not deposed on the point of killing of his father by<\/p>\n<p>                   any of the accused.
