Please provide the name and designation of the officer from As above<br \/>\n        the office or the employer who submitted the proposal for<br \/>\n        appointment of the insured person i.e. workman Sri Om.\n<\/p>\n<p>  7. Please supply the list of other insured workmen of the As above<br \/>\n        present employer with the respective dates of appointment.<br \/>\n Grounds for the First Appeal:\n<\/p>\n<p>Not received information form CPIO.\n<\/p>\n<p>First Appellate Authority (FAA) order:\n<\/p>\n<p>The information sought is third party information and is barred under the RTI Act.\n<\/p>\n<p>Grounds for the Second Appeal:\n<\/p>\n<p>Not satisfied with the decision of FAA.\n<\/p>\n<p>Relevant Facts emerging during Hearing:<br \/>\nThe following were present<br \/>\nAppellant : Absent;\n<\/p>\n<p>Respondent : Mr. Yograj, Public Information Officer &amp; Branch Manager;\n<\/p>\n<p>       The Respondent states that he received the RTI application after the transfer on 16\/11\/2009 and<br \/>\nhe replied to the appellant on 28\/01\/2010. This was incomplete and finally the details wee given on<br \/>\n10\/03\/2010 effectively saying that most of the information was not available with the public authority.<br \/>\nThe respondent states that the then Branch Manager Mrs. Neelam Khanna was responsible for the delay<br \/>\nin providing the information.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>       The information appears to have been provided to the appellant.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the then PIO<br \/>\nMrs. Neelam Khanna within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the PIO is guilty of not furnishing information within<br \/>\nthe time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the requirement of<br \/>\nthe RTI Act. It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A show cause notice<br \/>\nis being issued to her, and she is directed give her reasons to the Commission to show cause why penalty should<br \/>\nnot be levied on her.\n<\/p>\n<p>Mrs. Neelam Khanna will present herself before the Commission at the above address on 03 August 2010 at<br \/>\n3.00pm alongwith her written submissions showing cause why penalty should not be imposed on her as<br \/>\nmandated under Section 20 (1).\n<\/p>\n<p>If there are other persons responsible for the delay in providing the information to the Appellant the PIO is<br \/>\ndirected to inform such persons of the show cause hearing and direct them to appear before the Commission<br \/>\nwith him.\n<\/p>\n<p>This decision is announced in open chamber.<br \/>\nNotice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                                             Shailesh Gandhi<br \/>\n                                                                                                   Information Commissioner<br \/>\n                                                                                                                07 July 2010<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
