C. Sharma appearing on behalf of petitioner<br \/>\nand learned AGP Mr. Maulik Nanavati appearing on behalf of respondent<br \/>\nno.1.\n<\/p>\n<p>2.\tLeave<br \/>\nto amend respondent no.1.\n<\/p>\n<p>3.\tIn<br \/>\npresent case, application made by petitioner for compassionate<br \/>\nappointment has been rejected by order dated 4\/3\/2009 only on ground<br \/>\nthat at the relevant time when application was made by petitioner,<br \/>\nfamily of petitioner was not in pitiable condition as per policy<br \/>\ndated 10\/3\/2000.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr. Sharma submitted that pension amount as well as death<br \/>\nretirement benefits has been taken into account while rejecting such<br \/>\napplication but respondent has not considered that how many family<br \/>\nmembers are there in petitioner&#8217;s family and whether any debt has<br \/>\nbeen occurred after death of petitioner&#8217;s father and other<br \/>\ncircumstances that whether any regular income is received by<br \/>\npetitioner&#8217;s family per month from any source or not.  These are<br \/>\nfactors that have not been taken into account by respondent.\n<\/p>\n<p>5.\tTherefore,<br \/>\nit is directed to respondent no.1 Panchayat, Rural Housing and Rural<br \/>\nDevelopment Department to reconsider earlier decision dated 4\/3\/2009<br \/>\nand examine whether family of petitioner is in pitiable condition or<br \/>\nnot and also inquire that how many members are residing with<br \/>\npetitioner and whether any debt has been occurred because of death of<br \/>\nfather and whether any other income regularly received by family of<br \/>\npetitioner monthly or not or any other source of regular income and<br \/>\nthereafter pass appropriate reasoned order considering aforesaid<br \/>\nfactual background as per policy dated 10\/3\/2000 within a period of<br \/>\nthree months from date of receiving copy of present order and<br \/>\ncommunicate decision immediately to petitioner.\n<\/p>\n<p>6.\tIn<br \/>\nview of above, present petition is disposed of by this Court without<br \/>\nexpressing any opinion on merits.
