It is submitted that the petitioners were initially<br \/>\n\tappointed for a period of six months. However, vide Government<br \/>\n\tResolution dated 03rd March 2009, the appointment of the<br \/>\n\tpetitioners was further extended for a period of six months by<br \/>\n\tgiving retrospective effect since the petitioners were already<br \/>\n\tcontinuing in their service and posts on the date when the said<br \/>\n\tGovernment Resolution was passed.\n<\/p>\n<p>It<br \/>\n\tis further the case of the petitioners that after the said extension<br \/>\n\twas granted, as per their joining dates in ordinary course<br \/>\n\tpetitioners&#8217; services were required to be terminated on completion<br \/>\n\tof one year. However, general enmasse termination order was passed<br \/>\n\tby the respondent Nos.5 and 6 and the petitioners were issued<br \/>\n\ttermination letters dated 19th August 2009 by giving<br \/>\n\teffect of the said termination retrospectively though the<br \/>\n\tpetitioners have already served with respondent Nos.5 and 6 upto<br \/>\n\t19th August 2009, which was made on the basis of the<br \/>\n\tcommunication dated 17th August 2009 issued by respondent<br \/>\n\tNo.1 to respondent Nos.5 and 6.\n<\/p>\n<p>It<br \/>\n\tis further the case of the petitioner that thereafter the respondent<br \/>\n\tNo.1 issued Government Resolution dated 29th August 2009<br \/>\n\tby further extending services of the petitioners and other similarly<br \/>\n\tsituated persons for a period of one year. Since the petitioners did<br \/>\n\tnot get any clarification from respondent No.1 and since appointment<br \/>\n\tof the petitioners pursuant to the resolution\/ circular dated 29th<br \/>\n\tAugust 2009 was treated  as fresh appointments, the petitioners<br \/>\n\talong with other similarly situated appointees made representation<br \/>\n\tdated 25th September 2009 to the respondent No.2 to<br \/>\n\tconsider their services as continuous from the date of their<br \/>\n\tappointment. Thus, the petitioners are put to a disadvantageous<br \/>\n\tsituation in respect of service benefits. Hence, the present<br \/>\n\tpetition.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned<br \/>\n\tcounsel appearing for the petitioners<br \/>\n\tand on perusal of the documents on record, it clearly transpires<br \/>\n\tthat the petitioners<br \/>\n\tare appointed as ad-hoc lecturers for a specified period of 11<br \/>\n\tmonths, subject to a rider that if prior thereto, regularly selected<br \/>\n\tcandidates through the process of selection to be undertaken by the<br \/>\n\tGPSC were available, the services of the petitioners<br \/>\n\tas lecturers would be put an end to before the expiry of the said<br \/>\n\tperiod of 11 months.\n<\/p>\n<p>It<br \/>\n\tis pertinent to note that the very first relief claimed by the<br \/>\n\tpetitioners is with respect to regularizing their services. It is<br \/>\n\trequired to be noted that such a relief cannot be granted to the<br \/>\n\tpetitioners since the petitioners are not appointed by following due<br \/>\n\tprocess of law by the GPSC. Further, it is the prerogative of the<br \/>\n\trespondent-employer to extend the service tenure of the petitioners<br \/>\n\tand the same cannot be availed as a right.\n<\/p>\n<p>During<br \/>\n\tthe course of hearing today, an endeavour is made by the learned<br \/>\n\tadvocate for the petitioner by pointing out the decision of the<br \/>\n\tDivision Bench of this Court rendered in Letters Patent Appeal<br \/>\n\tNo.1053 of 2010 in Special Civil Application No.4651 of 2010 with<br \/>\n\tCivil Application No.4801 of 2010, whereby the order passed by this<br \/>\n\tCourt in Special Civil Application No.4651 of 2010 has been quashed<br \/>\n\tand set aside. It would be beneficial to reproduce the said order as<br \/>\n\tunder :\n<\/p>\n<p> On<br \/>\ninstructions of Mr. G.H.Upadhaya, Dy. Director, Technical Education,<br \/>\nGandhinagar, who is present in the Court, learned AGP, Mr. N.J.Shah,<br \/>\nstated that service of the appellants herein will not be terminated<br \/>\ntill the regular process of recruitment for filling up the posts in<br \/>\nquestion is carried out and the candidates pursuant to said selection<br \/>\nprocess are available for regular appointment. Upon that statement<br \/>\nbeing made and recorded, the appeal was not pressed for any further<br \/>\nrelief except to formally set aside the impugned order dated<br \/>\n19.04.2010 of learned Single Judge in Special Civil Application No.<br \/>\n4651 of 2010. That order is however, already set aside in Letters<br \/>\nPatent Appeal No. 991 of 2010. Accordingly, the appeal is allowed.<br \/>\nThe impugned order already is set aside and the respondents are<br \/>\ndirected to abide by the statement recorded hereinabove. It is<br \/>\nclarified that the appellants would be at liberty to participate in<br \/>\nthe process of regular recruitment, if they fulfill the conditions<br \/>\ntherefor.\n<\/p>\n<p>\tCivil<br \/>\nApplication would not survive in view of the above order disposing<br \/>\nthe appeal. Accordingly, the application is disposed and rule is<br \/>\ndischarged with no order as to costs.\n<\/p>\n<p>Looking<br \/>\n\tto the above cited order passed by the Division Bench of this Court,<br \/>\n\tit transpires that the order passed by the learned Single Judge has<br \/>\n\tbeen quashed and set aside on the statement made by the officer of<br \/>\n\tthe respondent-State and the said matter has not been decided on<br \/>\n\tmerits of the matter. The statement made therein cannot be taken as<br \/>\n\thaving general application in all the cases including the present<br \/>\n\tone since no such statement is made in the present case.\n<\/p>\n<p>Further<br \/>\n\tin view of the observations made and directions issued by this Court<br \/>\n\t(Coram : M.R. Shah, J) while dealing with Special Civil Application<br \/>\n\tNo.5797 of 2009 and allied matters, vide judgment dated 30th<br \/>\n\tJune 2009, while dealing with an identical issue in respect of<br \/>\n\tsimilarly situated employees, the present petitioners have no right<br \/>\n\tto continue on the post of lecturers. It is pertinent to note that<br \/>\n\twhen the similar issue has already been decided by this Court, they<br \/>\n\thave no right to continue on the post in question  beyond the<br \/>\n\tstipulated date. Further, even as per the ratio laid down in the<br \/>\n\tcase of <a href=\"\/doc\/1591733\/\">Secretary, State<br \/>\n\tof Karnataka and others v. Umadevi and others<\/a>, reported in (2006) 4<br \/>\n\tSCC 1,<br \/>\n\tthe petitioners are not entitled to the post in question beyond<br \/>\n\tstipulated period. Thus, I am of the opinion that the present<br \/>\n\tpetition is misconceived and the same is devoid of any substance and<br \/>\n\tmerit.
