Meena for respondent no.2.\n<\/p>\n<p>By<br \/>\n\tfiling this appeal, appellant is challenging award made by claims<br \/>\n\ttribunal, Rajkot in claim petition no.305 of 1995 dated 10th<br \/>\n\tNovember, 2006 wherein claims tribunal has awarded total<br \/>\n\tcompensation  of Rs.79,670.00, out of which Rs.6000.00 were to be<br \/>\n\tpaid jointly and severally by opponents no.1 and 2 and rest of the<br \/>\n\tamount of Rs.73670.00 is payable by opponent NO.1 to claimant with<br \/>\n\tproportionate costs of the application.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Gidiya for appellant submitted that the insurance<br \/>\n\tcompany is liable to pay the compensation for damages caused to<br \/>\n\tAmbassador Car by the truck. He submited that the claims tribunal<br \/>\n\thas committed gross error in not appreciating evidence Exh. 26<br \/>\n\twherein evidence of the driver Mangilal Bhuralal was recorded on<br \/>\n\tbehalf of the applicants. He submitted that the reasoning given by<br \/>\n\tthe claims tribunal is contrary to the evidence on record.\n<\/p>\n<p>On<br \/>\n\tthe other hand, Ms. Narsinghani, learned AGP for the respondent<br \/>\n\tState Authority has made submissions while supporting impugned<br \/>\n\taward.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by learned advocate Mr. Gidia for<br \/>\n\tappellant as well as learned AGP Ms. Narsinghani for respondent<br \/>\n\tState Authority. I have also perused impugned award made by claims<br \/>\n\ttribunal.\n<\/p>\n<p>\tBefore<br \/>\n\tclaims tribunal, present appellant has appeared in person and no<br \/>\n\tadvocate was engaged by appellant. Facts of claim petition filed by<br \/>\n\tclaimant were to the effect that the Government Ambassador Car<br \/>\n\tbearing  Registration No. GJ.1527.89 dashed with truck no.<br \/>\n\tGJ.11.T.8694 on 5.10.1994 near Patiya of village Ratanpur within the<br \/>\n\tlimits of Rajkot Taluka Police Station. Therefore, on 6.10.94,<br \/>\n\tbefore Rajkot Taluka Police Station, offence was registered at CR<br \/>\n\tNO.494 of 1994. In connection with said accident, claim petition was<br \/>\n\tfiled by claimant contending inter alia that the aforesaid truck of<br \/>\n\topponent was coming towards Rajkot from Ratanpar Patiya and the<br \/>\n\tvehicle of the claimant was behind said truck and opponent no.1 had,<br \/>\n\tall of a sudden, without giving any type of signal, stopped said<br \/>\n\ttruck on road by making lights off and therefore, said vehicle of<br \/>\n\tclaimant had dashed with said truck and thus it was alleged that the<br \/>\n\taccident has taken place because of the negligence on the part of<br \/>\n\tthe opponent no.1.\n<\/p>\n<p>Before<br \/>\n\tclaims tribunal, reply was filed by present appellant at Exh. 15 and<br \/>\n\tat exh. 17, reply was filed by insurance company wherein it was<br \/>\n\tdenied that the accident had taken place as alleged. It was<br \/>\n\tcontended by insurance company that there has been breach of the<br \/>\n\tterms and rules of insurance policy and in this matter, if it is<br \/>\n\tbelieved that there has been any negligence of the truck operator,<br \/>\n\tthen, policy of the truck being Act Policy, their responsibility<br \/>\n\tcannot exceed the statutory liability to pay compensation.\n<\/p>\n<p>Issues<br \/>\n\twere framed by the claims tribunal at Exh. 18 wherein issue no.1 was<br \/>\n\trelating to negligence. For deciding issue no.1, claims tribunal<br \/>\n\tconsidered documents namely FIR Exh. 46, Panchanama Exh. 47, RC Book<br \/>\n\tof truck Exh. 49, driving licence of truck operator Exh. 49,<br \/>\n\tinsurance policy of truck Exh.33 and 43, extract of tariff of<br \/>\n\tinsurance policy Exh. 43, policy of ambassator Exh.55, letter of<br \/>\n\testimate of damage to ambassator Exh. 50, letter cancelling<br \/>\n\tregistration Exh. 51, statement of pool vehicles Exh. 52, letter<br \/>\n\tregarding repairing of vehicle Exh.54, letter of auction of damaged<br \/>\n\tvehicle Exh.56 and driving licence of driver of ambassador Exh. 27.<br \/>\n\tFor deciding negligence amongst two vehicles, claims tribunal<br \/>\n\tconsidered panchanama Exh. 47 and observed that the accident has<br \/>\n\ttaken place on 24 ft. road and both the vehicles are on the edge of<br \/>\n\tthe road and truck was at the distance of one and half ft. from road<br \/>\n\twhereas ambassador car was at the distance of two and half ft. away<br \/>\n\tfrom road and truck was ahead by eight and half ft. from ambassador<br \/>\n\tand there is Nala 12 ft. away from there and as per panchanama,<br \/>\n\tindicator of truck were not on nor any boundary wall was made around<br \/>\n\tit and considering panchanama, it was also observed by the claims<br \/>\n\ttribunal that operator of ambassador car applied brake upto<br \/>\n\tseventeen and half ft. and made attempt to avoid accident and on<br \/>\n\tthat basis, observed that at the time of accident, ambassador car<br \/>\n\tmust be in speed and, therefore, looking to the time of accident,<br \/>\n\tnature of vehicles and position on the site as per panchanama and<br \/>\n\tnon examination of the driver of truck on behalf of the opponent in<br \/>\n\tparticular, claims tribunal held that the driver of the truck was<br \/>\n\tnegligent to the extent of 70 per cent and driver of ambassador car<br \/>\n\twas negligent to the extent of 30 per cent and claims tribunal<br \/>\n\tdecided issue of negligence accordingly.\n<\/p>\n<p>While<br \/>\n\tconsidering issue no.2 and 3, claims tribunal considered deposition<br \/>\n\tof Mangilal Bhuralal Exh. 26 wherein it was deposed by him that<br \/>\n\tbecause of the accident, too much damage has been caused to the<br \/>\n\tAmbassador car and the damages were assessed through Police MT<br \/>\n\tSection Workshop at Gandhinagar and as per the said assessment,<br \/>\n\tdamage worth Rs.1,38,815.00 was caused to the said car which was<br \/>\n\tchallenged during the course of his cross examination. Claims<br \/>\n\ttribunal also considered deposition recorded on behalf of the<br \/>\n\tapplicant at Exh. 30 given by employee of Ahmedabad ATS Shri<br \/>\n\tHasmukhbhai Keshavbhai who deposed that the assessment of damages<br \/>\n\tcaused to the car in accident was done through Police MT Section at<br \/>\n\tGandhinagar and car had suffered damages worth Rs.1,38,815.00 and<br \/>\n\tfrom his cross examination, it was disclosed that the said<br \/>\n\tAmbassador car was of the year 1991 but he is not having the<br \/>\n\tevidence about purchase price thereof and from the Government<br \/>\n\tvehicle, depreciation is being deducted every year and prior to<br \/>\n\taccident, what was the value thereof on the books of the Government,<br \/>\n\the is not having idea. Thereafter, after considering the FIR Exh. 46<br \/>\n\tand panchanam Exh. 47 as well as leter of the Police Commissioner<br \/>\n\tExh. 50 dated 17.2.1995, claims tribunal observed that the<br \/>\n\tGovernment vehicle of the claimant had suffered more damages than<br \/>\n\twhat was shown in the panchanama and then after considering the<br \/>\n\tletter of the Police Commissioner Exh. 56, after accident, said<br \/>\n\tambassador was not repaired and it was opined by concerned authority<br \/>\n\tto cancel the same and after it was placed in public auction, it was<br \/>\n\tnot sold at the price less than 20 per cent and therefore, by making<br \/>\n\tlot of total five vehicles, with 75% less, they were sold in public<br \/>\n\tauction on 11.7.2001 at Rs.1,08,672.00 and estimated scrap price of<br \/>\n\tthe said vehicle of Rs.25000.00 and then held that deducting the<br \/>\n\tsaid amount of salvage of Rs.25,000.00 from Rs.1,38,815.00, claimant<br \/>\n\thas suffered loss of Rs.1,13,815.00  and then deducted 30 per cent<br \/>\n\tamount therefrom towards contributory negligence of the driver of<br \/>\n\tclaimant and held that the claimant is entitled for Rs.79670.00 from<br \/>\n\topponents. Then, considering the submissions made on behalf of the<br \/>\n\tinsurance company of the truck and policy of the truck Exh. 42 which<br \/>\n\twas an Act Policy wherein additional premium was not paid in respect<br \/>\n\tof third party damage and then claims tribunal considered extract of<br \/>\n\tinsurance premium tariff Exh. 43  and held that therefore, as per<br \/>\n\tsection 147(2)(B) of the MV Act, statutory liability of the<br \/>\n\tinsurance company to pay compensation cannot  exceed than Rs.6000.00<br \/>\n\tand, therefore, held that out of total amount of compensation<br \/>\n\tavailable to claimant of Rs.79670.00, opponents no. 1 and 2 are<br \/>\n\tliable to pay Rs.6000.00 jointly and severally and remaining amount<br \/>\n\tis payable by opponent NO.1 alone i.e. Present appellant with<br \/>\n\tinterest thereon at the rate of 9 per cent per annum and answered<br \/>\n\tissue no.2 accordingly.\n<\/p>\n<p>Considering<br \/>\n\tthe award, appellant was not remaining present before the claims<br \/>\n\ttribunal at the time of making submissions and claims tribunal has<br \/>\n\trightly examined matter and has rightly decided negligence between<br \/>\n\tambassador car driver and truck driver after considering panchanama<br \/>\n\tExh. 47 and claims tribunal has rightly came to the conclusion that<br \/>\n\tthe truck driver is liable to the extent of 70 per cent and driver<br \/>\n\tof ambassador car is liable to the extent of 30 per cent and in<br \/>\n\tdoing so, no error has been committed by the claims tribunal. Claims<br \/>\n\tTribunal has also rightly considered insurance policy in respect of<br \/>\n\tthe truck as well as extract of insurance premium tariff and has<br \/>\n\trightly  held that the insurance company  of the truck is liable<br \/>\n\tonly for Rs.6000.00 and appellant opponent no.1 is liable for<br \/>\n\tpayment of remaining amount with interest as awarded by claims<br \/>\n\ttribunal. Such findings recorded by the claims tribunal are based on<br \/>\n\tappreciation of oral and documentary evidence on record and same are<br \/>\n\tnot contrary to  evidence on record and learned Advocate Mr. Gidiya<br \/>\n\tfor appellant has not been able to point out that such findings are<br \/>\n\tperverse and contrary to evidence on record. Therefore, there is no<br \/>\n\tsubstance in this appeal and same is required to be dismissed.\n<\/p>\n<p>In<br \/>\n\tresult, this petition is dismissed.\n<\/p>\n<p>Today,<br \/>\n\tthis Court has dismissed appeal and, therefore, civil application<br \/>\n\tfor stay is disposed of accordingly.
