Vi by the II Addl. Family Court at Bangalore passed on I.A.5<\/p>\n

2. Husband has filed a petition for divorce on the ground<\/p>\n
of mental cruelty. Parties have a child who is aged about<\/p>\n
four and half years. Both the husband and; wife are
\nengineers. In the petition filed for divorce wife filed a<\/p>\n

\npetition for grant of interim nmintenance under Sec.24 of<\/p>\n
the Hindu Marriage Act claimin\u00e9=~interi\u00a2Ef3\u00a2@ntenance.kof

\nRs . 25, 000\/" per month . In  of   ' filed
\nin support of the application she has clai\ufb01ed maintenance
\nnot only for her but a1\u00a7o.\u00a3;g{r\u00e9\u00a3r\u00a2\u00a7i1a. According to the<\/p>\n
respondent–wife, =Vher,""husbandgp is T7getting salary of<\/p>\n
Rs.75,000\/~ per month as he is working as Senior Software
\nEngineer .\u00a70r. M\/s'*\u00a2;\u00e9:$eith at Peenya. At the time of<\/p>\n
filing the application. child was aged two years old. She<\/p>\n
_Fclaim[jaaintonancef en~ the ground. that even though she is<\/p>\n
earning. the same is not sufficient to maintain herself and<\/p>\n

“tff3.v Husband filed objections contending that wife is also<\/p>\n
x’earningfand her net income is Rs.50,000\/~. Therefore he<\/p>\n
x\u00b0~contended ‘that she is not entitled to claim separate<\/p>\n
it’-_\ufb01aintenance and he further contends that maintenance of the<\/p>\n

4. Before the trial court, respondent-wife,'”.he,s’-veiaroduced
\nher salary certificate which discloses
\na gross salary of Rs.49,000\/–_mand
\nRs.40,000\/-‘~. Though the
\nsince he has not denied ,h5r._5 \u00e9’e.1_ei~_v 6.00 per
\nmonth, even though he  notiie any salary
\ncertificate trial court”‘v~pas_siedtorder directing to pay a<\/p>\n
sum of Rs.5000\/* per month  maintenance to the<\/p>\n

 maintenance. He further contends that<\/p>\n
   is also earning, same has to be shared equally by<\/p>\n

\npoint to be considered by this court in these two petitions
\nis that whether the order dpassed. by_ the \ufb02court below is<\/p>\n
required to be confirmed or to be reversed\u00a7Ad<\/p>\n
8. Counsel for_ the mrespondentinhas\ufb01 relied upon the
\njudgment reportagini\ufb01n Agn\ufb01hhh\ufb01l\ufb01\ufb01mh MURTHY Vs. AKKELA
\nSITALAXMI (\u00e990\u00a7(%;\ufb01_ci}il\ufb02El}di?8941) relying upon the
\njudgment or the Andhrai\ufb01radesh high Court he contends that
\nwhile dranting:iinaintenance under Sec.24 of the<\/p>\n
Hindu Marriace Actgxmaintenance payable to the child cannot<\/p>\n
Xbe_QoQ\u00a7id9\u00a7ed as t e same has to be claimed either under<\/p>\n
the ;provisions ‘of Hindu Adoption and. Maintenance Act or<\/p>\n
:d’_v under “Sectl\ufb01\ufb01 def Cr.P.C.. So far as this judgment is<\/p>\n
concernedfn same will not appeal to this court for the<\/p>\n
, simple reason that interim maintenance payable to the wife<\/p>\n
includes the maintenance of a child. It is no doubt true<\/p>\n
-thatl a course is open for the minor children either to<\/p>\n
d*niclain1 maintenance under Sec.125 of Cr.P.C. or under the<\/p>\n

\nit—–a’;.-s specific under these two acts that child of two years<\/p>\n

\ncannot be driven to file a separate suit. Since custody<\/p>\n
and maintenance of the child has to be in a
\ndivorce petition in the larger interpe_\u00a7:i;.,::.
\nSince it is a judgment of  his
\nonly a persuasive value. Both the:”partie_:.-spaere enginepersllby
\nprofession. Husband is earr.-ing month. It
\nwould be unfair for a-‘.\u00a7athp.e’r’  thatwhiis child has to
\nbe driven to file a  maintenance when<\/p>\n
his earning  month. Considering the<\/p>\n
background of.ithis::\ufb02case..:’_’and _considering the averments made
\nin pra–lCi–. of Vthe”‘iAa\u00a3\u00bbfidVavi.t in support of the application<\/p>\n
filed _under”‘~ SecV.’v24,:_  am of the view that interim<\/p>\n
 ma_int.e_nance include-s–\u00aba minor child  rs. &=-*3″<\/p>\n
 {Sou fa;1Ves’~the earnings are concerned, counsel for the<\/p>\n
 wifeA’–~contend.s_A that in view of recession in IT Industry,<\/p>\n
 is getting a salary of Rs.40,000\/– and the same is<\/p>\n
it redu.ced to Rs.20,000\/-. Since the trial court was required<\/p>\n
 consider the post and income on the date of disposal of<\/p>\n
 application, I am of the opinion that wife does not<\/p>\n
require maintenance payable by her husband in View of her
\nincome as on the date of filing of the application and on
\nthe date of disposal of the applica\u20aciQn;m,\u00a2iaoweyer,
\nconsidering the background of the=case; though garages age
\nwell to do persons and are earning eao\u00a3m\u00a7g;;#;f;\u00a7\ufb01a;de\u00a7ing
\ntheir status in the society as the child is required to be
\nbrought up by providing all_anenitiesL 1 am bf the opinion
\nthat a sum of Rs.9000\/4 awarded by the Family Court towards
\nthe maintenance Of the wi\ufb01e and child can be considered as
\nmaintenance payabieg by\ufb01 the gfathe$_m$o the child .till the
\ndisposal of the case)’ it is a\u00a3ga\u00a2d by the counsel for the
\nwife that i\ufb01”v\u00e9\u00a7g \u00e9g the reduction in her income on account
\nof recession, naintenancewawarded by the trial court has to<\/p>\n
be increased; ” .lf dreally there is any change in the<\/p>\n
;circumstances after the disposal of the application, it is<\/p>\n
always .open ~\u00a35:_ the wife to file a fresh application<\/p>\n
considering gene” subsequent developments and if such an<\/p>\n
application is filed it is for the trial court to dispose<\/p>\n

opportunity to the husband to defend the said application.<\/p>\n
\ufb02ln the circumstances, order passed by the family court is<\/p>\n
Vd”mbdified by holding that maintenance awarded in a sum of<\/p>\n
at<\/p>\n
Rs.9000\/- shall be treated as maintenance payable to the
