JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 02\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\n\tpetition has been filed with a prayer to quash and set aside order<br \/>\n\tdated 17.05.2010 passed by the Gujarat Civil Services Tribunal in<br \/>\n\tAppeal No.245 of 2007\/911, whereby the Tribunal has directed that<br \/>\n\tthe matter be remanded to respondent No.1 (petitioner No.1 herein)<br \/>\n\tfrom the stage of holding a fresh inquiry against the applicant.\n<\/p>\n<p>\tThe<br \/>\n\tpetitioner is the District Development Officer, District Panchayat,<br \/>\n\tPanchmahals, Godhara. Respondent No.1 was serving as Senior Accounts<br \/>\n\tClerk in the office of Taluka Panchayat, Jhalod, from 27.02.1987 to<br \/>\n\t04.07.1987. During office inspection, it came to light that the<br \/>\n\trespondent No.1 herein had allegedly embezzled a sum of Rs.22,120=22<br \/>\n\tps. A criminal case was registered against him, which is pending<br \/>\n\tTrial. Respondent No.1 was placed under suspension and thereafter<br \/>\n\treinstated. Chargesheet dated 13.03.1989 was served on respondent<br \/>\n\tNo.1 for misappropriation of Rs.22,120=22 ps. and temporary<br \/>\n\tmisappropriation of Rs.20,500\/-. A Departmental Inquiry was held<br \/>\n\tagainst him. As mentioned in the Inquiry Report, respondent No.1 did<br \/>\n\tnot remain present during the hearing of the said inquiry but asked<br \/>\n\tfor certain records, which demand was not accepted by the Inquiry<br \/>\n\tOfficer. Finally, the Inquiry Officer gave his findings by way of<br \/>\n\tthe Inquiry Report on the basis of the brief submitted by the<br \/>\n\tPresenting Officer and the written statement of respondent No.1<br \/>\n\tdated 03.09.1998. The Inquiry Officer found that the charges<br \/>\n\tlevelled against respondent No.1 stood proved. A second show cause<br \/>\n\tnotice was issued by the Disciplinary Authority. After considering<br \/>\n\tthe reply to the show cause notice along with the Inquiry Report,<br \/>\n\tthe Disciplinary  Authority imposed the punishment of reversion to<br \/>\n\tthe cadre of Junior Clerk from the rank of Senior Accounts Clerk<br \/>\n\t(which post respondent No.1 held at the relevant point of time).<br \/>\n\tRespondent No.1 filed an appeal before the Additional Development<br \/>\n\tCommissioner (respondent No.2) which came to be rejected. Being<br \/>\n\taggrieved by the said order, respondent No.1 filed the<br \/>\n\tabove-mentioned appeal before the Tribunal which came to be<br \/>\n\tremanded, as above, by impugned order dated 17.05.2010, after<br \/>\n\tsetting aside the order dated 20.06.2005 passed by the District<br \/>\n\tDevelopment Officer (petitioner No.1) and order dated 23.05.2007<br \/>\n\tpassed by the Additional Development Commissioner (respondent No.2).<br \/>\n\tHence, this petition.\n<\/p>\n<p>\tMs.Jyoti<br \/>\n\tMehta, learned advocate for M\/s.H.L.Patel Advocates, learned counsel<br \/>\n\tfor the petitioner, has submitted that:\n<\/p>\n<p>\t(a)\tRespondent<br \/>\n\tNo.1 has already retired from service and if the matter is remanded<br \/>\n\tand a fresh Departmental Inquiry is initiated, as directed by the<br \/>\n\tTribunal, it would be difficult to gather the necessary documents<br \/>\n\tafter so many years. The necessary documents regarding the<br \/>\n\tDepartmental Inquiry and charges framed against respondent No.1 have<br \/>\n\tbeen submitted to the Trial Court as the criminal case is pending,<br \/>\n\tand the petitioner will not be in a position to retrieve the same<br \/>\n\tfor use in the Departmental Inquiry.\n<\/p>\n<p>\t(b)\tThe<br \/>\n\tcharge of misappropriation has been proved against respondent No.1<br \/>\n\tand he has chosen not to remain present before the Inquiry Officer.<br \/>\n\tHe has, therefore, been rightly reverted to the post of Junior<br \/>\n\tClerk.\n<\/p>\n<p>\t(c)<br \/>\n\t\tThe Tribunal has erred in coming to the conclusion that respondent<br \/>\n\tNo.1 is not proved guilty and that the Departmental Inquiry should<br \/>\n\tnot be conducted as a criminal case is pending, which finding is<br \/>\n\tagainst the settled legal position that departmental proceedings and<br \/>\n\ta criminal case are altogether different and can go on<br \/>\n\tsimultaneously.\n<\/p>\n<p>\t(d)\tThe<br \/>\n\torder of remand passed by the Tribunal is erroneous and<br \/>\n\tunsustainable in law, therefore, deserves to be quashed and set<br \/>\n\taside.\n<\/p>\n<p>\tMr.A.S.Supehia,<br \/>\n\tlearned advocate for contesting respondent No.1, has submitted that<br \/>\n\tthe order of the Tribunal does not suffer from any legal error or<br \/>\n\tinfirmity and is supported by cogent reasons. Referring to<br \/>\n\tParagraph-9 of the impugned judgment of the Tribunal, it is<br \/>\n\tsubmitted that it is clearly mentioned therein that there is no<br \/>\n\tjustification for the grounds raised by respondent No.1 in the reply<br \/>\n\tto the show cause notice, in the order impugned before the Tribunal.<br \/>\n\tIt is submitted that respondent No.1 had raised numerous grounds in<br \/>\n\tthe reply to the show cause notice, none of which have been dealt<br \/>\n\twith in the order impugned before the Tribunal. In these<br \/>\n\tcircumstances, the Tribunal has rightly remanded the matter on the<br \/>\n\tground that there is a violation of the principles of natural<br \/>\n\tjustice, as reasonable opportunity has not been granted to<br \/>\n\trespondent No.1. It is further contended that the finding of the<br \/>\n\tTribunal that before taking a final decision, the disciplinary<br \/>\n\tauthority should analyze the grounds and give its reasons for not<br \/>\n\taccepting the same before arriving at a conclusion, is in accordance<br \/>\n\twith the settled legal principles and, under these circumstances,<br \/>\n\tthe order of the Tribunal remanding the matter to the District<br \/>\n\tDevelopment Officer for holding a fresh inquiry, does not warrant<br \/>\n\tinterference of this Court.\n<\/p>\n<p>\tI<br \/>\n\thave heard the learned advocates for the respective parties, perused<br \/>\n\tthe averments made in the petition, contents of the impugned order<br \/>\n\tand other documents on record.\n<\/p>\n<p>\tThe<br \/>\n\tmain ground on which the learned advocate for the petitioner has<br \/>\n\tchallenged the order of the Tribunal is that it would be difficult<br \/>\n\tto gather the necessary documents after such a long period of time,<br \/>\n\tfor fresh hearing before the District Development Officer, upon<br \/>\n\tremand of the matter by the Tribunal. It has been submitted that the<br \/>\n\tnecessary documents have been submitted to the Trial Court and the<br \/>\n\tpetitioner will not be in a position to retrieve the same for use in<br \/>\n\tthe Departmental Inquiry. This submission carries no weight, as it<br \/>\n\tis for the petitioners to make an application to obtain certified<br \/>\n\tcopies of the documents that are necessary for use in the<br \/>\n\tDepartmental Inquiry. In any case, this difficulty in gathering the<br \/>\n\tnecessary documents, per se, does not render the order of the<br \/>\n\tTribunal illegal.\n<\/p>\n<p>\tA<br \/>\n\tsubmission has been advanced on behalf of the petitioner that<br \/>\n\trespondent No.1 did not remain present before the Inquiry Officer,<br \/>\n\ttherefore he has been rightly reverted to the post of Junior Clerk.<br \/>\n\tIt has also been contended that the Tribunal has erroneously come to<br \/>\n\tthe conclusion that respondent No.1 has not been proved guilty. The<br \/>\n\tquestion whether the respondent No.1 has been rightly reverted, or<br \/>\n\tnot, is not under the scrutiny of this Court as, at present; it is<br \/>\n\tthe order of remand of the Tribunal that has been challenged. On<br \/>\n\tperusal of the impugned order of the Tribunal, the submission of the<br \/>\n\tlearned advocate for the petitioner, that the Tribunal has come to a<br \/>\n\tconclusion that respondent No.1 has not been proved guilty, is not<br \/>\n\tborne out. In fact, the reason for remand, as stated in the order of<br \/>\n\tthe Tribunal, is that the respondent No.1 has filed a detailed reply<br \/>\n\tto the second show cause notice received by him, but none of the<br \/>\n\tgrounds raised by him in the reply have been dealt with in the order<br \/>\n\tdated 20.06.2005. It is clearly mentioned in the said order of the<br \/>\n\tTribunal that while taking a final decision, the Disciplinary<br \/>\n\tAuthority ought to have recorded its reasons for not accepting the<br \/>\n\tgrounds raised by respondent No.1, and in the absence of any<br \/>\n\tdiscussion regarding the same, the said order is vitiated as it is<br \/>\n\tnot a reasoned order. The submission advanced by the learned<br \/>\n\tadvocate for the petitioner to the effect that the Tribunal has<br \/>\n\tconcluded that a Departmental Inquiry cannot take place during the<br \/>\n\tpendency of the criminal case is also misconceived, and is not borne<br \/>\n\tout from the impugned order.\n<\/p>\n<p>\tThe<br \/>\n\tTribunal has further held that the Departmental Inquiry has been<br \/>\n\theld without following the prescribed norms, which vitiates the<br \/>\n\tInquiry Report and renders the order impugned before it, arbitrary.<br \/>\n\tIt is in the above circumstances that the Tribunal has set aside the<br \/>\n\torder passed by petitioner No.1 dated 20.06.2005 and the order<br \/>\n\tpassed by respondent No.2 dated 23.05.2007, while remanding the<br \/>\n\tmatter from the stage of holding a fresh inquiry against respondent<br \/>\n\tNo.1. In my considered view, there is no illegality or infirmity in<br \/>\n\tthe order of the Tribunal.\n<\/p>\n<p>\tNo<br \/>\n\tconvincing or cogent grounds have been advanced by the learned<br \/>\n\tcounsel for the petitioner to make good the challenge to the<br \/>\n\timpugned order.\n<\/p>\n<p>\tIn<br \/>\n\tthe above circumstances and for reasons stated hereinabove, as the<br \/>\n\timpugned order of the Tribunal does not suffer from any illegality,<br \/>\n\tinfirmity or perversity, the petition must fail.\n<\/p>\n<p>\tIt<br \/>\n\tis, accordingly, rejected.
