      The   petitioner              is      the        claimant in<\/p>\n
LAR.112\/05 on the file of the Sub Court,<\/p>\n
Attingal which is being jointly tried with<\/p>\n
LAR. Nos.114\/05 and 115\/05. It is the case of<\/p>\n
the petitioner that when summons was taken out<\/p>\n
to the witnesses it was returned stating that<\/p>\n
witness Nos.1 and 2 could not be found and<\/p>\n
that therefore, petitioner filed I.A.2167\/08<\/p>\n
(Ext.P6) to issue summons to witness Nos.1 and<\/p>\n
2  and  also     to      accept          additional         witness<\/p>\n
schedule but the court below vide Ext.P7 order<\/p>\n
dt.11\/12\/08 dismissed the same. The petitioner<\/p>\n
therefore, prays that direction be issued to<\/p>\n
the  court  below         to      allow        Ext.P6      petition<\/p>\n
quashing Ext.P7 order.\n<\/p>\n
W. P. C. No.2255 of 2009           -2-<\/span><\/p>\n
              2. The court below vide Ext.P7 order has<\/p>\n
      observed          that two  official witnesses one<\/p>\n
      Special Tahsildar and an Assistant Executive<\/p>\n
      Engineer of K.S.T.P were already examined on<\/p>\n
      application of the claimant, but no relevant<\/p>\n
      materials could be brought out in the evidence<\/p>\n
      of those witnesses; that what the claimant<\/p>\n
      wants        now    is to  examine  another Special<\/p>\n
      Tahsildar without stating the points to be<\/p>\n
      proved that therefore, the additional witness<\/p>\n
      schedule is not accepted and however, that if<\/p>\n
      the counsel wants to get any private person<\/p>\n
      examined he can produce them or take summons<\/p>\n
      to them “by party” after closing of evidence<\/p>\n
      of       the      respondents   which  has  already<\/p>\n
      commenced. This shows that the court has made<\/p>\n
      a very lenient approach in permitting the<\/p>\n
      petitioner to adduce evidence though summons<\/p>\n

      was      refused    to be issued afresh to the<\/p>\n
      witnesses to whom summons issued were returned<\/p>\n
      unserved.\n<\/p>\n
              3. It is submitted that the LAR is one<\/p>\n
      included in the Special List. Exts.P3 and P4<\/p>\n
      depositions of two witnesses produced before<\/p>\n
      court by the petitioner does not show the date<\/p>\n
      on which they were examined. Obviously they<\/p>\n
      were being examined prior to 06\/12\/08 on which<\/p>\n
      day was Ext.P5 filed. Ext.P2 is dt.01\/09\/08.<\/p>\n
      This shows that in September or October, 2008<\/p>\n
      the trial of the LAR started. However, we are<\/p>\n
      in January, 2009. The court below has given<\/p>\n
      permission to the petitioner to produce those<\/p>\n
      witnesses and to examine them if he wants. In<\/p>\n
      a suit or other proceeding which is already<\/p>\n
      listed, parties cannot protract the trial by<\/p>\n
      taking steps repeatedly like this after trial<\/p>\n
W. P. C. No.2255 of 2009    -4-<\/span><\/p>\n
      has started disabling the court in disposing<\/p>\n
      of the proceedings before it. I see no merit<\/p>\n
      in this Writ Petition and this Writ Petition<\/p>\n
      is dismissed.\n<\/p>\n<\/p>\n
