The original prosecution version was that the deceased<\/p>\n<p>had gone to the house of Sarpanch late Kabir Singh, where four<\/p>\n<p>accused were present and had a drinking session. This version was<\/p>\n<p>dis-believed as the witnesses had not supported the prosecution in<\/p>\n<p>this regard. Even the witness before whom the disclosure statement<\/p>\n<p>made regarding the recovery of dead-body, did not support the<\/p>\n<p>prosecution.\n<\/p>\n<p>            Without commenting any further on the merits of the<\/p>\n<p>case, we feel that the appellants deserve the benefit of suspended<\/p>\n<p>sentence.\n<\/p>\n<p>            Appeal is not likely to be heard soon.         Sentence is<\/p>\n<p>suspended. Bail to the satisfaction of C.J.M., Amritsar.<\/p>\n<p>                                              (K. Learned Special Judge had correctly appraised the<\/p>\n<p>evidence and came to the correct conclusion in acquitting Jaswinder<\/p>\n<p>Singh. Advocate General, Haryana.<\/p>\n<p>K.S.GAREWAL, J.\n<\/p>\n<p>              Delay condoned.\n<\/p>\n<p>              State of Haryana is seeking leave to appeal to challenge<\/p>\n<p>the acquittal of Desh Raj by Additional Sessions Judge, Nuh, vide<\/p>\n<p>judgment dated November 5, 2008.<\/p>\n<p>              Desh Raj had faced trial for the murder of his infant son<\/p>\n<p>Aman, aged about 3 years. Aman had been manually strangulated<\/p>\n<p>to death.     In such a case, the best and the most natural witness<\/p>\n<p>would have been Aman&#8217;s mother and other close members of the<\/p>\n<p>family.     Aman&#8217;s mother    is   Munesh Devi (PW-1), it was on her<\/p>\n<p>complaint that      the case was registered.    She alleged that her<\/p>\n<p>husband was drunk and would beat her child.            They had been<\/p>\n<p>deserted about three months earlier to the occurrence, which took<\/p>\n<p>place on June 20, 2008. Munesh Devi had been informed by her<\/p>\n<p>brother-in-law Sant Ram that Aman had been strangulated by the<\/p>\n<p>accused.\n<\/p>\n<p> Crl. Misc. No. 399-MA of 2009                                  (2)<\/p>\n<p>            ..\n<\/p>\n<p>            At the trial, Munesh Devi and Sant Ram resiled from their<\/p>\n<p>police statements and did not support the prosecution.               The<\/p>\n<p>prosecution also failed to produce      medical evidence and did not<\/p>\n<p>examine the Medical Officer, who conducted the post-mortem<\/p>\n<p>examination. In this state of affairs, the learned Additional Sessions<\/p>\n<p>Judge, Nuh was perfectly justified in acquitting Desh Raj.<\/p>\n<p>            We have gone through the judgment of the trial Court<\/p>\n<p>and find that the same does not suffer from any irregularity,<\/p>\n<p>jurisdiction defects or perversity.<\/p>\n<p>            Leave to appeal declined.<\/p>\n<pre>\n\n\n                                           (K.S.
