SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/07\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 227 of the Constitution of India,<br \/>\n\tthe petitioner ?  original plaintiff\/respondent has prayed for<br \/>\n\tappropriate writ, order and\/or direction, for  quashing  and setting<br \/>\n\taside the order dtd.31\/12\/2007 passed by the learned Additional<br \/>\n\tDistrict Judge, Bhavnagar in Misc.Civil Appeal No.112 of 2006, in<br \/>\n\tallowing the said appeal preferred by the original defendant and<br \/>\n\tquashing and setting aside the order dtd.5\/7\/2006 passed by the<br \/>\n\tlearned Additional Senior Civil Judge, Bhavnagar below application<br \/>\n\tEx.5 in Special Civil Suit No.73 of 2004.\n<\/p>\n<p>The<br \/>\n\tpetitioner ?  original plaintiff filed Special Civil Suit No.73 of<br \/>\n\t2004 in the court of learned Civil Judge (SD), Bhavnagar for<br \/>\n\tmandatory injunction\/relief directing the defendant to restore the<br \/>\n\tpossession. In the said suit, the petitioner ?  original plaintiff<br \/>\n\tsubmitted an application at Ex.5 and prayed for interim injunction<br \/>\n\tdirecting the respondent ?  original defendant to restore the<br \/>\n\tpossession and in the alternate to pay mesne profit. It is to be<br \/>\n\tnoted that in the said suit, the defendant also submitted counter<br \/>\n\tclaim at Ex.13.\n<\/p>\n<p>The<br \/>\n\ttrial court vide order dt.5\/7\/2006 allowed the application Ex.5 and<br \/>\n\tby way of interim injunction directed the defendant to restore the<br \/>\n\tpossession to the plaintiff and further directed that till the<br \/>\n\tpossession is handed over as per the order passed below application<br \/>\n\tEx.5, the defendant to pay Rs.4000=00 towards mesne profit. Being<br \/>\n\taggrieved by and  dissatisfied with the said order passed below<br \/>\n\tapplication Ex.5, the respondent ?  original defendant preferred<br \/>\n\tMisc. Civil Appeal No.112 of 2006 before the appellate court, which<br \/>\n\tcame to be heard, decided and disposed of by the learned Additional<br \/>\n\tSessions Judge, Bhavnagar  vide judgement and order dtd.31\/12\/2007,<br \/>\n\tin  allowing the appeal and quashing and setting aside the order<br \/>\n\tpassed below application Ex.5, by observing that such a mandatory<br \/>\n\trelief could not have been granted by the learned trial court while<br \/>\n\tdeciding the application Ex.5, more particularly when the main<br \/>\n\trelief itself is for restoring the possession. The learned appellate<br \/>\n\tcourt also observed that  at the state of deciding application Ex.5,<br \/>\n\tthere is no question of paying any mesne profit. Being aggrieved by<br \/>\n\tthe impugned judgement and order passed by the learned appellate<br \/>\n\tcourt in allowing he appeal by quashing and setting aside the order<br \/>\n\tpassed below application Ex.5, the petitioner ?  original plaintiff<br \/>\n\thas preferred the present Special Civil Application under Article<br \/>\n\t227 of the Constitution of India.\n<\/p>\n<p>Mr.J.D.\n<\/p>\n<p>\tAjmera, learned advocate appearing on behalf of the  petitioner ?<br \/>\n\toriginal plaintiff has submitted that considering the fact that the<br \/>\n\toriginal plaintiff has been duped  and the possession has been taken<br \/>\n\tover by the respondent ?  defendant without paying any<br \/>\n\tconsideration, the trial court was justified in allowing the<br \/>\n\tapplication Ex.5 and the same could not have been interfered with by<br \/>\n\tthe learned appellate court.\n<\/p>\n<p>Considering<br \/>\n\tthe fact that the learned trial court while deciding the application<br \/>\n\tEx.5 has granted the relief which was final relief prayed by the<br \/>\n\tplaintiff in the suit and even granted mesne profit while deciding<br \/>\n\tthe application Ex.5 and the appellate court has reversed the said<br \/>\n\torder, it cannot be said that the learned appellate court has<br \/>\n\tcommitted any error. Mesne profit can be awarded only at the time of<br \/>\n\tpassing final judgement and decree and if it is found that the<br \/>\n\tdefendant was in illegal possession of the suit property. Under the<br \/>\n\tcircumstances, no illegality has been committed by the learned<br \/>\n\tappellate court while allowing the appeal and quashing and setting<br \/>\n\taside the order passed by the trial court  below application Ex.5.<br \/>\n\tNo interference of this court, in exercise of the powers under<br \/>\n\tArticle 227 of the Constitution of India, is called for and hence<br \/>\n\tthe petition is required to be dismissed and is accordingly<br \/>\n\tdismissed.\n<\/p>\n<p>It<br \/>\n\twill be open for the petitioner ?  original plaintiff to move<br \/>\n\tappropriate application for expeditious hearing of the suit and in<br \/>\n\tcase of filing such application, the same may be considered by the<br \/>\n\ttrial court keeping in mind the fact that the suit is of the year<br \/>\n\t2004.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[M.R.\n<\/p>\n<p>SHAH, J.]<\/p>\n<p>rafik<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court M\/S vs Antubhai on 28 July, 2008 Author: M.R.
