SHAH\n\t\t\n\t\n\n \n\nDate\n: 16\/07\/2010 \n\n \n\n \n \n\n\n \n\nCOMMON\nORAL ORDER<\/pre>\n<p>1.\tHaving<br \/>\nheard Shri Dhaval D. Vyas, learned advocate appearing on behalf of<br \/>\nthe applicant   original petitioner and Shri Prashant G. Desai,<br \/>\nlearned senior advocate appearing on behalf of the respondent<br \/>\nSurat Municipal Corporation.  It appears that the dispute was with<br \/>\nrespect to the parcel of land on which there is a samadhi which is<br \/>\nforming part of the Final Plot allotted to the original petitioner.\n<\/p>\n<p>2.\tShri<br \/>\nDhaval Vyas, learned advocate appearing on behalf of the applicant<br \/>\noriginal petitioner, under the instructions from one Shambhugiri<br \/>\nGanpatgiri, Trustee and Administrator of the applicant   original<br \/>\npetitioner Somnath Mahadev Mandir Trust, has stated at the bar that<br \/>\nthe applicant   original petitioner are waiving their right to<br \/>\nclaim possession of that portion of the plot \/ Final Plot which is<br \/>\nalloted to the original petitioner on which there is existing<br \/>\nconstruction of samadhi and even four feet of land on three sides,<br \/>\nonly with a view to see that the feelings of other persons may not<br \/>\nget hurt.  However, he has submitted that the entry to the said<br \/>\nsamadhi shall be from the main road.\n<\/p>\n<p>3.\tShri<br \/>\nPrashant G. Desai, learned senior advocate appearing on behalf of the<br \/>\nCorporation has submitted that as such the Corporation has already<br \/>\nhanded over the possession of entire final plot alloted to the<br \/>\npetitioner inclusive of the area occupied by samadhi.  However, he<br \/>\nhas submitted that to avoid further complications in future and to<br \/>\navoid any further confusion\/dispute, Corporation is ready and willing<br \/>\nto segregate\/separate that portion of the land occupied by samadhi<br \/>\nand four feet of land on three sides and construct the compound wall<br \/>\nso that the land occupied by samadhi is separated permanently and<br \/>\nthere may not be any further dispute.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, both these applications are disposed of.  Let the<br \/>\nCorporation put up a compound wall at their own cost on the land<br \/>\noccupied by samadhi and leaving four feet on three sides, which can<br \/>\nbe used by those persons who are using samadhi and that their entry<br \/>\nshall be from the main road.
