RAMACHANDRAN NAIR\n                                       &amp;\n                        HARUN-UL-RASHID, JJ.\n             ---------------------------------------------------------\n                       M.A.C.A.NO. 1167 OF 2006\n             ---------------------------------------------------------\n               Dated this the 27th day of November, 2008\n\n                                JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<\/p>\n<p>       Appeal is filed for enhancement of compensation for the injuries<\/p>\n<p>sustained by the appellant who was a medical student preparing for the<\/p>\n<p>first year M.B.B.S. examination under the old scheme at the time of the<\/p>\n<p>accident on 10.3.1996. The offending vehicle was a motorbike driven by<\/p>\n<p>the second respondent. The Motor Accidents Claims Tribunal,<\/p>\n<p>Pathanamthitta granted compensation against the third respondent-insurer.<\/p>\n<p>The appellant&#8217;s case is that the notional income fixed at Rs.1,500\/- per<\/p>\n<p>month is very low when compared to the prospects of a doctor in his<\/p>\n<p>career.\n<\/p>\n<p>       2. We have gone through the award and we find force in the<\/p>\n<p>contention that the income fixed is very low because the appellant was<\/p>\n<p>academically brilliant and he was a medical student at the time of the<\/p>\n<p><span class=\"hidden_text\">M.A.C.A. NO.1167\/2006                  2<\/span><\/p>\n<p>accident. It is stated in the award that the appellant lost almost three years<\/p>\n<p>of his studies on account of the accident. Counsel appearing for the<\/p>\n<p>appellant submitted that on account of the delay in studies caused by the<\/p>\n<p>accident, the appellant could complete the M.B.B.S. course only at the age<\/p>\n<p>of 35 and consequently he was not eligible to apply for Government job.<\/p>\n<p>However, it is seen that the disability certified by the Medical Board is<\/p>\n<p>only 15%.      Substantial compensation       was granted at the rate of<\/p>\n<p>Rs.1,00,000\/- for pain and suffering and for loss of enjoyment in life.<\/p>\n<p>Therefore, modification is called for only with regard to the compensation<\/p>\n<p>granted for disability. Loss of opportunities to apply for Government job<\/p>\n<p>does not appear to be a ground for enhancement of compensation because<\/p>\n<p>qualified doctors get decent employment and remuneration in private<\/p>\n<p>sector and large number of        self employed doctors are earning good<\/p>\n<p>income.    The appellant had not pursued higher studies even though he<\/p>\n<p>had not suffered any brain injury or injury affecting his faculty of studies.<\/p>\n<p>Considering the income of graduate doctors at the time of the accident, we<\/p>\n<p>feel the appellant is entitled to a notional income of Rs.60,000\/- per year.<\/p>\n<p>Applying this as the notional income and by applying the same multiplier,<\/p>\n<p>we enhance the compensation for disability from Rs.40,500\/- to<\/p>\n<p>Rs.1,62,000\/-. Additional compensation granted by us will carry interest<\/p>\n<p><span class=\"hidden_text\">M.A.C.A. NO.1167\/2006               3<\/span><\/p>\n<p>at the rate of 7.5% per annum from the date of application till date of<\/p>\n<p>payment.\n<\/p>\n<p>      Appeal is allowed to the extent indicated above.<\/p>\n<p>                              (C.N.
