OF INDIA UNDERTAKING) - Defendant(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nVIJAY N RAVAL for\nAppellant(s) : 1, \nMR JAL SOLI UNWALA for Defendant(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 12\/05\/2010  \nORAL ORDER<\/pre>\n<p>\tThe<br \/>\napplicant of captioned Civil Application (for stay) No.1026 of 2010,<br \/>\nwho is the appellant in First Appeal No.175 of 2010, has preferred<br \/>\nthis application seeking an order staying the operation and execution<br \/>\nof the judgment and decree dated 22nd<br \/>\nSeptember, 2009 passed by the 2nd<br \/>\nAdditional Senior Civil Judge, Surendranagar in Special Civil Suit<br \/>\nNo.6 of 2000 whereby the learned trial court has directed present<br \/>\nappellant (original defendant) to pay a sum of Rs.7,40,336.97 to<br \/>\npresent opponent (original plaintiff) with interest at the rate of<br \/>\n6%. The above mentioned First Appeal arises from the said judgment<br \/>\nand decree.\n<\/p>\n<p>\tSo<br \/>\nas to consider the prayer made in the application, it is necessary<br \/>\nand appropriate to take into account certain factual aspects, which<br \/>\ngave rise to the suit proceedings and thereby to present Appeal and<br \/>\nthis Civil Application.\n<\/p>\n<p>\tThe<br \/>\nopponent herein-Food Corporation of India [hereinafter referred to as<br \/>\n FCI ], had after following procedure of inviting and evaluation<br \/>\nof tenders, awarded a contract viz.  handling and transport<br \/>\ncontract  to present applicant.\n<\/p>\n<p>\tAs<br \/>\nper the case of present opponent-FCI i.e. the original plaintiff, the<br \/>\nappellant (contractor, and original opponent) abandoned the contract<br \/>\nwithout completing the execution of the contract work and thereby<br \/>\ncommitted breach of the contract awarded to it.\n<\/p>\n<p>\tHence,<br \/>\non the ground that the present appellant had committed breach of the<br \/>\nterms of the contract, the opponent herein terminated the contract by<br \/>\nits communication dated<br \/>\n18th<br \/>\nMarch, 1997.\n<\/p>\n<p>\tAfter<br \/>\nterminating the contract, the opponent-FCI claimed damages from the<br \/>\nappellant contractor which, as per its claim, it had suffered on<br \/>\naccount of the acts of omission viz. abandoning the contract, by the<br \/>\nappellant contractor.\n<\/p>\n<p>\tSince<br \/>\nthe applicant herein-failed to respond to the demand notice, the<br \/>\nopponent-FCI filed the aforesaid Special Civil Suit No.6 of 2000.\n<\/p>\n<p>\tThe<br \/>\nopponent-FCI quantified its damages at Rs.11,18,598.92\/- but claimed<br \/>\ndecree for a sum of Rs.7,40,336.97 after giving credit of<br \/>\nRs.3,78,261.95, which was available in its hands in form of security<br \/>\ndeposit.\n<\/p>\n<p>\tAfter<br \/>\nhearing the opponent and upon considering the material available on<br \/>\nrecord, the learned trial Court passed the judgment and decree dated<br \/>\n22.9.2009  whereby the court partly allowed the suit in favour of the<br \/>\nplaintiff FCI-present opponent and directed the opponent i.e. present<br \/>\nappellant to pay Rs.7,40,336.97 ps with interest at the rate of 6%<br \/>\nfrom the date of the presentation of the suit.\n<\/p>\n<p>\tThe<br \/>\nappellant is aggrieved by the judgment and decree. Hence, the appeal.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Pandya, learned advocate, has appeared for Mr. V.N. Raval, learned<br \/>\nadvocate for the appellant and Mr. Jal Soli Unwala, learned advocate<br \/>\nhas appeared for the respondent   FCI.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Pandya, learned advocate for the appellant has raised diverse<br \/>\ncontentions against the impugned judgment and decree. He has, inter<br \/>\nalia, submitted that though the opponent had claimed set off and<br \/>\nspecifically pleaded set off in the written statement itself, the<br \/>\nlearned trial court has not recorded any finding with regard to the<br \/>\nappellant&#8217;s plea of set off. He has also assailed the findings and<br \/>\nconclusions of the learned trial court holding the appellant in<br \/>\ndefault in making the due and payable payment and in directing the<br \/>\nappellant to pay the sum of Rs.7,40,336.97 ps. While Mr. Pandya,<br \/>\nlearned advocate urged other contentions e.g. that the learned trial<br \/>\ncourt has taken into consideration such documents which were not duly<br \/>\nproved by the plaintiff and\/or that the learned trial court has based<br \/>\nthe conclusions on material, which cannot be construed as evidence in<br \/>\nthe eye of law and that the learned trial Court has failed to take<br \/>\ninto account the grounds urged by the appellant-opponent in its<br \/>\ndefence, he has, mainly and essentially assailed the judgment on the<br \/>\nground that though plea of set off was raised, it has been completely<br \/>\ndisregarded.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Unwala, learned advocate for the opponent has resisted the suit<br \/>\nraising various objections e.g. it is not open to the appellant to<br \/>\nraise contentions with regard to set off and the same has rightly not<br \/>\nbeen considered by the learned trial court inasmuch as the appellant<br \/>\ni.e. original opponent had not paid court fees qua the plea of set<br \/>\noff and that therefore, the learned trial court was not obliged to<br \/>\nconsider the said plea. He has further submitted that for the<br \/>\naforesaid reasons as well as for the reason that the plea was not<br \/>\npressed in service even any issue with regard to the plea of set off<br \/>\nwas not raised until the final decree came to be passed. This aspect<br \/>\nof the matter gets substantiated by the fact that even in such<br \/>\nsituation the opponent i.e. present appellant had never raised any<br \/>\nobjection on the ground that any issue was not framed, and that<br \/>\ntherefore, at this stage, now it is not permissible to the appellant<br \/>\nto assail the judgment on the said ground. As regards, the contention<br \/>\nwith reference to documents and its proof is concerned, the learned<br \/>\nadvocate Mr. Unwala has referred to the evidence of the witness,<br \/>\nwherein, reference pertaining to the documents in question has been<br \/>\nspecifically made. He has also referred to the oral evidence<br \/>\nincluding cross examination in support of his submission that the<br \/>\ndocuments were duly placed on record and were referred to in the oral<br \/>\nevidence and not only the documents but the contents including the<br \/>\nsignature\/s and other related aspects have been duly proved before<br \/>\nthe learned trial court and any error in relying on the said<br \/>\ndocuments has not been committed by the court.\n<\/p>\n<p>\tHaving<br \/>\nregard to the rival contentions, the appeal requires to be<br \/>\nconsidered. Earlier by order dated 19th March, 2010, the<br \/>\nRecords &amp; Proceedings was called for. Considering the aforesaid<br \/>\naspects, ADMIT.\n<\/p>\n<p>\tIn<br \/>\nview of the facts and circumstances of the case and considering the<br \/>\nrequest of the appellant, the appeal will be listed for final hearing<br \/>\nin the week beginning from 30th August, 2010.\n<\/p>\n<p> ORDER<br \/>\nIN CIVIL APPLICATION.\n<\/p>\n<p>\tIn<br \/>\nview of the aspects pertaining to the appeal mentioned in the order<br \/>\npassed in the appeal today, so far as the prayer for interim relief<br \/>\nis concerned, it deserves to be noted that the appellant herein has<br \/>\npreferred the appeal against the judgment and decree dated 22nd<br \/>\nSeptember, 2009 which requires the appellant to pay a sum of<br \/>\nRs.7,40,336.97 ps. along with interest at the rate of 6% from the<br \/>\ndate of the presentation of the suit. Differently put, the impugned<br \/>\njudgment and decree is a money decree. Hence, any unconditional<br \/>\ninterim relief cannot be granted. It would not be out of place to<br \/>\ntake into account the fact that the suit was made on the ground that<br \/>\nthe opponent i.e. present appellant had abandoned the contract<br \/>\nwithout executing the contract work which resulted into damages. The<br \/>\nappellant appears to have given some explanation with regard to his<br \/>\nconduct, however, there is no denial of the fact that the contract<br \/>\nwork was abandoned. While considering the prayer for interim relief,<br \/>\nthe said factual aspect and the appellant&#8217;s conduct, interwoven in<br \/>\nthe impugned judgment, cannot be overlooked, besides the fact that in<br \/>\nview of the provisions contained under Order 41 Rule 1(3) and 5 as<br \/>\nwell as 5(5) and also in view of the well settled legal position, a<br \/>\nmoney decree ought not be stayed without requiring the judgment<br \/>\ndebtor to deposit the amount.
