Maharashtra State  Board of  Secondary and  Higher\nSecondary Education,  Pune and another, AIR 1981 Bombay 895,\ndeclared clauses  (1) and  (2) of  Rule 37 of Goa, Daman and\nDiu Secondary  and Higher  Secondary Education\tRules,\t1975\ninsofar as  they prohibit  inspection and\/or  revaluation of\nanswer books,  as invalid.  Hence these\t appeals by  special\nleave,\n     Allowing the appeals.\n^\n     HELD: The\tdecision followed  by the  Bombay High Court\nhas been  overruled by this Court in Maharashtra State Board\nof Secondary  and Higher  Secondary Education and another v.\nParitosh Bhupesh  Kumarsheth and  others [1985] 1 S.C.R. 29.\nThe present  case is fully covered by the dicta laid down in\nthe said ruling. Hence the judgment of the High Court is set\naside and  the validity\t of clauses(1) and (2) of Rule 37 is\nupheld. Paritosh  Bhupesh,\nKumarsheth and\tothers, decided\t by Supreme  Court [1985]  1\nS.C.R. 29.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CIVIL APPELLATE JURISDICTION: Civil Appeal Nos. 4152 to<br \/>\n4157 of 1982.\n<\/p>\n<p>     Appeals by\t Special leave\tfrom the  Judgment and Order<br \/>\ndated the  2nd November,  1982 of  the\tBombay\tHigh  Court,<br \/>\nPanaji Bench,<br \/>\n<span class=\"hidden_text\">431<\/span><br \/>\n(Goa), in Special Civil Application Writ Petitions Nos. 129,<br \/>\n110, 103, 101, 102 and 10 of 1980.\n<\/p>\n<p>     Soli J. Sorabjee, Mrs. A. K. Verma and O. C. Mathur for<br \/>\nthe Appellant.\n<\/p>\n<p>     The Judgment of the Court was delivered by<br \/>\n     BALAKRISHNA ERADI,\t J. These  appeals by  special leave<br \/>\nare directed  against the  Judgment of\tthe  High  Court  of<br \/>\nBombay (Panaji\tBench) dated  2.11.1982 whereby\t a  Division<br \/>\nBench of  the High  Court allowed  a batch of Writ Petitions<br \/>\nfiled by  some students who had appeared in the XII standard<br \/>\nexamination conducted  by the  Goa, Daman  and Diu  Board of<br \/>\nSecondary and  Higher Secondary\t Education and\tdeclared the<br \/>\nprovisions of  clauses (1)  and (2)  of Rule 37 of the rules<br \/>\nframed by the Administrator of Goa, Daman and Diu under Goa,<br \/>\nDaman and Diu Secondary and Higher Secondary Education Board<br \/>\nAct as\tultra vires  and invalid  insofar as  they  prohibit<br \/>\ninspection and\/or  revaluation of  answer books. In reaching<br \/>\nthe said  conclusion on\t the validity  of the impugned rules<br \/>\nthe High  Court followed  its earlier  Judgment in  Paritosh<br \/>\nBhupesh Kumarsheth  and others v. Maharashtra State Board of<br \/>\nSecondary and  Higher Secondary Education, Pune and another-<br \/>\nAIR 1981 Bombay 895-wherein Regulation 104 (3) framed by the<br \/>\nMaharashtra State  Board of  Secondary and  Higher Secondary<br \/>\nEducation  which   is  an  identical  provision\t prohibiting<br \/>\ninspection and\/or  revaluation of  answer books was declared<br \/>\nillegal\t and  ultra  vires.  The  correctness  of  the\tsaid<br \/>\nJudgment (AIR  1981 Bombay  895) came  in for examination by<br \/>\nthis Court  in Maharashtra  State  Board  of  Secondary\t and<br \/>\nHigher Secondary  Education and\t another v. Paritosh Bhupesh<br \/>\nKumarsheth and\tOthers. By  Judgment dated  17th July  1984,<br \/>\nthis Court  reversed the view taken by the Bombay High Court<br \/>\nand upheld  the validity of the impugned clauses (1) and (3)<br \/>\nof Regulation  104. The present case is fully covered by the<br \/>\ndicta laid  down in  the said ruling. Hence we set aside the<br \/>\nJudgment of  the High  Court  and  upheld  the\tvalidity  of<br \/>\nclauses (1) and (2) of Rule 37 of the rules framed under the<br \/>\nGoa, Daman  and Diu Secondary and Higher Secondary Education<br \/>\nBoard Act.  These appeals are allowed and the writ petitions<br \/>\nfiled in  the High Court will stand dismissed.
