He has<br \/>\nsubmitted that if we look at the FIR it becomes clear that it is<br \/>\nPrakashbhai, who was and who is personally known to the complainant<br \/>\nand the transaction in question is between Prakashbhai and the<br \/>\ncomplainant. It is submitted that even the bills in question were<br \/>\nprepared in the name of Prakashbhai and the cheques in question have<br \/>\nalso been issued by Prakashbhai. It is Prakashbhai who may be said to<br \/>\nhave committed the offence as has been alleged in the FIR and not the<br \/>\npresent applicant. He has submitted that no prima facie case is made<br \/>\nout against the present applicant.  He has submitted that present<br \/>\napplicant will be available during interrogation and investigation.<br \/>\nHe has therefore, prayed that present applicant may be granted<br \/>\nanticipatory bail.\n<\/p>\n<p>3.\tHeard<br \/>\nMr.K.L.Pandya, learned APP for the respondent State. Mr.Pandya has<br \/>\nvehemently opposed the present application.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, I am<br \/>\ninclined to grant anticipatory bail to the applicant. This Court has<br \/>\nalso taken into consideration the law laid down by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors.,<\/a> reported in (2011) 1 SCC 694,<br \/>\nwherein the Apex Court reiterated the law laid down by the<br \/>\nConstitutional Bench in the case of Shri Gurubaksh Singh<br \/>\nSibbia &amp; Ors., reported in (1980) 2 SCC 565.\n<\/p>\n<p>5.\tThe application is<br \/>\nallowed. The applicant is granted anticipatory bail in the event of<br \/>\nhis arrest in connection with CR No. I-229 of 2011 registered<br \/>\nwith  Ghatlodia Police Station, Ahmedabad for the offences as alleged<br \/>\nin FIR on his executing a bond of Rs.10,000\/- [Rupees Ten thousand<br \/>\nonly] with one surety of the like amount on the following conditions<br \/>\nthat he shall:\n<\/p>\n<p>[a]\tco-operate with the<br \/>\ninvestigation and make himself available for interrogation whenever<br \/>\nand wherever required.\n<\/p>\n<p>[b]\tshall remain present<br \/>\nat the concerned Police Station on 14.11.2011 at 11.00 AM ;\n<\/p>\n<p>[c]\tshall not hamper the<br \/>\ninvestigation in any manner nor shall directly or indirectly make any<br \/>\ninducement, threat or promise to any person acquainted with the facts<br \/>\nof the case so as to dissuade him from disclosing such facts to the<br \/>\nCourt or to any police officer;\n<\/p>\n<p>[d]\tat the time of<br \/>\nexecution of bond, furnish him residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot leave State of<br \/>\nGujarat without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot obstruct or hamper<br \/>\nthe police investigation and not play mischief with the evidence<br \/>\ncollected or yet to be collected by the police;\n<\/p>\n<p>6.\tIt would be open to the<br \/>\nInvestigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just;
