PATTANAIK (J)\n\nCITATION:\n 1996 AIR 1045\t\t  1996 SCC  (2) 365\n JT 1996 (1)   568\t  1996 SCALE  (1)448\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     Though  notice   has  been\t served\t on  the  contesting<br \/>\nrespondents, they  have not  appeared either  in  person  or<br \/>\nthrough counsel.\n<\/p>\n<p>     We have  heard Shri  O.P. Rana,  learned senior counsel<br \/>\nfor the\t petitioner. The  acquisition of  the  land  by\t the<br \/>\nGhaziabad   Development\t   Authority   was    initiated\t  by<br \/>\nnotification of\t February 25,  1986, under  Section 4 (1) of<br \/>\nthe Land  Acquisition Act,  1894  (for\tshort,\t&#8216;the  Act&#8217;);<br \/>\nenquiry under  Section 5A  was dispensed  with under Section<br \/>\n17(4) of  the Act  and the  Declaration under  Section 6 was<br \/>\nmade on\t February  26,\t1986.  Both  the  notifications\t and<br \/>\ndeclaration were simultaneously published on April 10, 1986.<br \/>\nThe respondents\t 1 and 2 have filed writ petition No.7155\/86<br \/>\nin the\tHigh Court  of Allahabad challenging the validity of<br \/>\nthe notification under Section 4(1) on the ground that local<br \/>\npublication as required under Section 4(1) was not made. The<br \/>\nexercise of  the power\tunder Section 17(4) was also wrongly<br \/>\ninvoked, as  simultaneously notification  under Section 4(1)<br \/>\nand declaration\t under Section 6 could not be published. The<br \/>\nHigh Court  accepted the  contentions and  by impugned order<br \/>\ndated November\t3,  1987,  allowed  the\t writ  petition\t and<br \/>\nquashed\t the   notification  of\t  Section  4(1)\t  and\t the<br \/>\ndeclaration under  Section 6.  Thus this  appeal by  special<br \/>\nleave.\n<\/p>\n<p>     Section 4(1)  of the  Act envisages whenever it appears<br \/>\nto the\tappropriate Government\tthat land in any locality is<br \/>\nneeded or  is likely  to be needed for any Public purpose or<br \/>\nfor a  company\ta  notification\t to  that  effect  shall  be<br \/>\npublished  in\tthe  official\tGazette\t and  in  two  daily<br \/>\nnewspapers\t    circulating in that locality of which at<br \/>\nleast one  shall be in the regional language. This was added<br \/>\nby Amendment Act 68 of 1984. Earlier thereto under the local<br \/>\namendment  of\tU.P.,  publication   in\t one  newspaper\t was<br \/>\nsufficient. The Collector is required to cause public notice<br \/>\nof the\tsubstance  of  such  notification  to  be  given  at<br \/>\nconvenient places in the said locality. The State of UP made<br \/>\namendment to  Section 4\t by  UP\t Land  Acquisition  VIII  of<br \/>\n1974\/XXII of  1954, whereunder\tbetween the  words &#8220;and&#8221; and<br \/>\nthe word  &#8220;Collector&#8221; the following shall be inserted and be<br \/>\ndeemed always to have been inserted. The proviso thereto was<br \/>\nadded as under:\n<\/p>\n<blockquote><p>     &#8220;Except in the case of any land to which<br \/>\n     by virtue\tof a  direction of  the State<br \/>\n     Government\t under\t sub  section\t4  of<br \/>\n     Section 17\t the provision of Section 5 A<br \/>\n     shall not apply&#8221;.\n<\/p><\/blockquote>\n<p>In other words, the mandatory requirement of the publication<br \/>\nof the\tnotification in the locality was dispensed with in a<br \/>\ncase where  the Government  had opined\tthat  the  land\t was<br \/>\nurgently needed,  under Section\t 17(4). When the authorities<br \/>\nhave dispensed\twith  the  enquiry  under  Section  5A,\t the<br \/>\nrequirement  of\t  local\t  publication\tshall\tnot   apply.<br \/>\nConsequently,\tthe   finding\tof   the   High\t  Court\t  is<br \/>\nunsustainable. It  is rather unfortunate that this amendment<br \/>\nwas not\t brought to  the notice\t of the\t High Court when the<br \/>\nwrit petition  was allowed.  But operation  of the statutory<br \/>\nlocal  amendment   to  the  Act\t has  dispensed\t with  local<br \/>\npublication  in\t  two  newspapers.  The\t notification  under<br \/>\nSection 4  [1] is  not vitiated\t for non-publication  of the<br \/>\nnotification in the local newspapers.\n<\/p>\n<p>     The next  question is whether Section 17(4) applies and<br \/>\nthe action taken was inconsistent with the provisions of the<br \/>\nAct. It is seen that but for local amendment, on publication<br \/>\nof the notification under Section 4(1) and exercising of the<br \/>\npower  under   Section\t17(4),\t the  publication   of\t the<br \/>\ndeclaration under  Section 6  is mandatory pre-condition for<br \/>\ntaking possession  of  the  land.  Even\t on  publication  of<br \/>\ndeclaration under  Section 6,  notice  under  Section  9  is<br \/>\nnecessary to  the owner or person interested in the land and<br \/>\non expiry  of 15  days from  the date  of the  notice  under<br \/>\nSection 9  the Government  is entitled to take possession of<br \/>\nthe land.  By operation\t of Sub-section\t (2) of\t Section  17<br \/>\nthough award  has not  been made  under Section\t 11 the land<br \/>\nstands vested in the Government, free from all encumbrances.<br \/>\nIn the\tState of  UP  an  amendment  has  been\tmade  by  UP<br \/>\nAmendment Act  repeal 32  of 1990  and the  Land Acquisition<br \/>\n[Validation] Act  1991, (UP  Act 5  of 1991), which had come<br \/>\ninto force  w.e.f. September  24, 1984, envisaging insertion<br \/>\nof a  proviso to  sub-section (4)  of Section 17 which reads<br \/>\nthus:\n<\/p>\n<blockquote><p>     &#8220;In Section  17 of\t the Land Acquisition<br \/>\n     Act, 1894, as amended in its application<br \/>\n     to Uttar  Pradesh, hereinafter  referred<br \/>\n     to as  the principal Act, in sub-section<br \/>\n     (4)  the\tfollowing  proviso  shall  be<br \/>\n     inserted at  the end and shall be deemed<br \/>\n     to have  been inserted  on September 24,<br \/>\n     1984, namely, Provided that where in the<br \/>\n     case of  any  land,  notification\tunder<br \/>\n     Section  4,  sub-section  (1)  has\t been<br \/>\n     published in  the Official Gazette on or<br \/>\n     after  September  24,  1984  but  before<br \/>\n     January 11,  1989\tand  the  appropriate<br \/>\n     Government has  under  this  sub-section<br \/>\n     directed that  the provisions of Section<br \/>\n     5-A shall not apply, a declaration under<br \/>\n     Section 6\tin respect of the land may be<br \/>\n     made either simultaneously with or at any<br \/>\n     time  after   the\tpublication   in  the<br \/>\n     Official  Gazette\tof  the\t notification<br \/>\n     under Section 4, sub-section (1).&#8221;<\/p><\/blockquote>\n<p>     In other  words by\t operation of the proviso to Section<br \/>\n17(4) in  relation to  its application\tto the\tState of UP,<br \/>\nNotification under  Section 4(1)  and the  declaration under<br \/>\nSection 6 would simultaneously be published. The appropriate<br \/>\nAuthority is  empowered to  issue notice under Section 9 and<br \/>\ntake possession\t on expiry  of\t15  days.  The\tHigh  Court,<br \/>\ntherefore, was\tnot  correct  in  its  conclusion  that\t the<br \/>\nGovernment  would  not\thave  published\t simultaneously\t the<br \/>\nnotification under  Section 4(1)  and the  declaration under<br \/>\nSection 6  and immediately  taken possession  of the land in<br \/>\nquestion.\n<\/p>\n<p>     In that  view of  the matter,  the decision of the High<br \/>\nCourt in  the impugned\tjudgment  is  clearly  illegal.\t The<br \/>\nappeal is  accordingly allowed,\t but  in  the  circumstances<br \/>\nwithout costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ghaziabad Development &#8230; vs Jan Kaluan Samiti, Sheopuri, &#8230; on 9 January, 1996 Equivalent citations: 1996 AIR 1045, 1996 SCC (2) 365 Author: K Ramaswamy Bench: Ramaswamy, K.
