He is a candidate belonging to the Muslim<\/p>\n<p>community.    The university issued Ext.P1 notification, dated<\/p>\n<p>4.12.1999,      inviting     applications        from    qualified<\/p>\n<p>Assistants\/Sections Officers working in the Universities of Kerala<\/p>\n<p>State to the post of Section     Officer   in the scale of pay of<\/p>\n<p>Rs.6500-10550.     The number of posts advertised was 15<\/p>\n<p>(approximate). The appellant and respondents 2 to 10 were<\/p>\n<p>also candidates who applied for the said post.       The rank list<\/p>\n<p>consisting of 50 candidates     was published on 1.4.2000, as<\/p>\n<p>evidenced by Ext.P2. The appellant and respondents 2 to 10<\/p>\n<p>were included in the rank list and they were appointed to the<\/p>\n<p>post of Section Officers on 5.4.2000, applying       the rules of<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>rotation contained in Rules 14 to 17 of the Kerala State &amp;<\/p>\n<p>Subordinate Services Rules, 1958, for short &#8216;the K.S &amp; S.S.R&#8217;.<\/p>\n<p>In the rank list, there were five candidates belonging to the<\/p>\n<p>Muslim Community including the appellant and respondents 2<\/p>\n<p>and 3.       Respondents 2 and 3 were Serial Nos.6 and 10,<\/p>\n<p>whereas the appellant was Serial No.23.          However the<\/p>\n<p>appellant got appointment, as per order dated 5.4.2000,<\/p>\n<p>earlier to respondents 2 and 3, since he       was appointed<\/p>\n<p>against 6th turn as a reserved candidate.        Prior to the<\/p>\n<p>appointment, candidates eligible for community reservation<\/p>\n<p>were directed to produce non creamy layer certificates and the<\/p>\n<p>appellant produced the same and obtained the benefit of<\/p>\n<p>reservation.    The party respondents belonging to     Muslim<\/p>\n<p>Community however did not produce any such certificate and<\/p>\n<p>they were selected against open competition turns.      In the<\/p>\n<p>provisional gradation list, Ext.P6, the University assigned<\/p>\n<p>seniority   to respondents 2 and 3 above        the appellant.<\/p>\n<p>Respondents 2 and 3 were assigned serial Nos.6 and 11<\/p>\n<p>respectively and the appellant was serial No.16. The other<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>Muslim candidate who was also appointed in the reservation<\/p>\n<p>turn was assigned Serial No.19. Though the appellant filed<\/p>\n<p>objections, the same was rejected and the final gradation list<\/p>\n<p>was published, as evidenced by Ext.P8 produced in W.P.(C)<\/p>\n<p>No.1118 of 2008, confirming the provisional gradation list.<\/p>\n<p>            2.   The contention of the appellant in the writ<\/p>\n<p>petition was that the seniority position of the appellant could<\/p>\n<p>not have been disturbed at the time of preparation of the<\/p>\n<p>gradation list, extending the benefit of third proviso to Rule 14<\/p>\n<p>(c) of the K.S. &amp; S.S.R, in so far as the other two Muslim<\/p>\n<p>candidates, respondents 2 and 3, were not eligible to claim<\/p>\n<p>any reservation, as they did not produce the non creamy layer<\/p>\n<p>certificate. According to him, after the decision of the Apex<\/p>\n<p>Court in <a href=\"\/doc\/1394696\/\">Indra Sawhney v. Union of India<\/a> (1992 Suppl (3)<\/p>\n<p>SCC 217), the inequity, if any,    to be remedied by virtue of<\/p>\n<p>the third proviso to Rule 14(c) of K.S. &amp; S.S.R. should be<\/p>\n<p>confined among the candidates eligible for reservation from<\/p>\n<p>the same community. According to him, in so far as the other<\/p>\n<p>two persons were not eligible to be considered against the<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>reservation turns, the Rule has no application in fixing the<\/p>\n<p>seniority.\n<\/p>\n<\/p>\n<p>            3.   Per contra, it is  contended by the learned<\/p>\n<p>counsel appearing for the University      as also the learned<\/p>\n<p>counsel for the contesting respondents that the inequity<\/p>\n<p>sought to be remedied by the third proviso to Rule 14(c) of the<\/p>\n<p>K.S. &amp; S.S.R is between the candidate appointed on merit, vis-<\/p>\n<p>a-vis, the candidate appointed against the reservation turn<\/p>\n<p>from the same community and in a situation where a<\/p>\n<p>candidate who is selected on merit in the open competition<\/p>\n<p>turn  is pushed down      to accommodate a candidate of the<\/p>\n<p>same community selected in the reservation turn, the<\/p>\n<p>resultant inequity is sought to be remedied by the third<\/p>\n<p>proviso to Rule 14(c) of K.S. &amp; S.S.R. We will consider the<\/p>\n<p>said contention in detail later.\n<\/p>\n<\/p>\n<p>            4. A few more facts are necessary to be stated for<\/p>\n<p>the disposal of this writ appeal. The selection of the appellant<\/p>\n<p>and the party respondents was          the subject matter of<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>challenge in O.P.No.8571 of 2002 and connected cases and<\/p>\n<p>this Court by a common judgment rendered in those cases<\/p>\n<p>quashed the selection and appointment.           Writ Appeals<\/p>\n<p>preferred therefrom were also dismissed by a Division Bench<\/p>\n<p>of this Court. Thereafter, a Special Leave Petition was filed<\/p>\n<p>against the common judgment in W.A.No.1760 of 2005 and an<\/p>\n<p>interim order was passed by the Apex Court, a copy of which<\/p>\n<p>is produced as Ext.P12, by which the Apex Court stayed the<\/p>\n<p>judgment of this Court. Based on the interim order of stay<\/p>\n<p>passed by the       Apex Court, the University subsequently<\/p>\n<p>effected promotions and the selected          candidates were<\/p>\n<p>promoted to higher posts up to the level of Joint Registrar.<\/p>\n<p>Therefore,     as far as the selection and appointment is<\/p>\n<p>concerned, the same having been quashed by a co-ordinate<\/p>\n<p>bench of this Court, except for the order of stay granted by<\/p>\n<p>the Apex Court and because of the pendency of the SLP, the<\/p>\n<p>question regarding the interpretation to be placed on the third<\/p>\n<p>proviso to Rule    14(c) of the    K.S. &amp; S.S.R. would have<\/p>\n<p>become academic.     It is to be noticed that the appellant had<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                  6<\/span><\/p>\n<p>filed an earlier writ petition before this Court as O.P.No.16945<\/p>\n<p>of 2002 challenging Ext.P8 seniority list.        This Court by<\/p>\n<p>Ext.P11 judgment rendered in the said case and another<\/p>\n<p>connected case       left the contention of the petitioners to be<\/p>\n<p>considered in appropriate proceedings, subject to the outcome<\/p>\n<p>of the appeal, if any, filed against the judgment in<\/p>\n<p>O.P.No.26486     of   2003.       The    said  Original  Petition,<\/p>\n<p>O.P.No.26486 of 2003, was one among the group of cases<\/p>\n<p>disposed of by this Court by a common judgment quashing the<\/p>\n<p>entire selection     to the post of Section Officer in the first<\/p>\n<p>respondent University and has become final, by virtue of the<\/p>\n<p>subsequent Division Bench decision, stated supra.        Ext.P11<\/p>\n<p>judgment is binding as far as the appellant is concerned and<\/p>\n<p>has become final in so far as no appeal has been preferred<\/p>\n<p>therefrom. Now that the common judgment rendered by this<\/p>\n<p>Court quashing the selection having been confirmed in appeal<\/p>\n<p>by a Division Bench, the effect of Ext.P11 judgment is that the<\/p>\n<p>appellant could opt to challenge the gradation list only after<\/p>\n<p>final judgment is rendered by the Apex Court in the SLP now<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                  7<\/span><\/p>\n<p>pending,    since, as far as this Court is concerned, the matter<\/p>\n<p>has become final in the light of the Division Bench decision of<\/p>\n<p>this Court. But this was not seen brought to the notice of the<\/p>\n<p>learned single Judge while deciding the preset writ petition. In<\/p>\n<p>view of Ext.P11, the appellant could not have filed any writ<\/p>\n<p>petition, until the validity of the selection is upheld by the<\/p>\n<p>Apex Court.\n<\/p>\n<\/p>\n<p>            5. Be that it may, since the issue regarding the<\/p>\n<p>validity of the gradation list was challenged and rejected by<\/p>\n<p>the learned single Judge, after interpreting the third proviso to<\/p>\n<p>Rule 14(c) of the K.S. &amp; S.S.R and since the appellant did not<\/p>\n<p>chose either to    withdraw the appeal and the writ petition<\/p>\n<p>reserving    his right, as per the judgment in Ext.P11,      we<\/p>\n<p>proceeded to hear the respective counsel on the issue<\/p>\n<p>regarding the interpretation to be placed on the third proviso<\/p>\n<p>to Rule 14(c) of K.S. &amp; S.S.R. and the correctness of the<\/p>\n<p>judgment under appeal.\n<\/p>\n<\/p>\n<p>            6.     The crux of the argument raised by<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 8<\/span><\/p>\n<p>Sri.Kaleeswaram Raj, appearing on behalf of the appellant, is<\/p>\n<p>that persons from the backward classes who come within the<\/p>\n<p>category of creamy layer are not entitled for reservation. He<\/p>\n<p>placed reliance on <a href=\"\/doc\/1394696\/\">Indra Sawhney v. Union of India<\/a> (1992<\/p>\n<p>Suppl (3) SCC 217) and second decision in <a href=\"\/doc\/1394696\/\">Indra Sawhney v.<\/p>\n<p>Union of India (AIR<\/a> 2000 SC 498).       It is his contention that<\/p>\n<p>by granting the benefit of inter change to persons who are<\/p>\n<p>appointed in the open competition turns, unequals are treated<\/p>\n<p>equally.   According to him, only persons who are entitled for<\/p>\n<p>reservation can be grouped together and only among them,<\/p>\n<p>an interchange can be made, as provided in the third proviso<\/p>\n<p>to Rule 14(c) of the K.S. &amp; S.S.R. Before we consider the<\/p>\n<p>above contention, it will be useful to refer to the provisions<\/p>\n<p>contained in Rule 14(c) to the extent they are relevant for our<\/p>\n<p>purpose. Rule 14 of the K.S.&amp; S.S.R. is extracted below:-<\/p>\n<blockquote><p>           &#8220;14. Reservation of appointments:- Where<br \/>\n     the Special Rules lay down that the principle of<br \/>\n     reservation of appointments shall apply to any<br \/>\n     service , class or category, or where in the case of<br \/>\n     any service, class or category for which no Special<br \/>\n     Rules have been issued, the Government have by<br \/>\n     notification in the Gazette declared that the principle<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 9<\/span><\/p>\n<p>     of reservation of appointments shall apply to such<br \/>\n     service, class or category shall be made on the<br \/>\n     following basis:-\n<\/p><\/blockquote>\n<blockquote><p>                 (a)   The unit of appointment for the<br \/>\n     purpose of this rule shall be 20, of which 2 shall be<br \/>\n     reserved for Scheduled Castes and Scheduled Tribes<br \/>\n     and 8 shall be reserved for the Other Backward<br \/>\n     Classes and the remaining 10 shall be filled on the<br \/>\n     basis of merit:\n<\/p><\/blockquote>\n<blockquote><p>                 [Provided that out of every five posts<br \/>\n     reserved for Scheduled Castes and Scheduled<br \/>\n     Tribes, one shall go to Scheduled Tribe candidate<br \/>\n     and the remaining four shall go to Scheduled Caste<br \/>\n     candidates and in the absence of a candidate to fill<br \/>\n     up the post reserved for Scheduled Tribe candidates,<br \/>\n     it shall go to a Scheduled Caste candidates and vice<br \/>\n     versa.]<\/p>\n<\/blockquote>\n<blockquote><p>                 (b)  The    claims   of   members      of<br \/>\n     Scheduled Castes and the Scheduled Tribes and<br \/>\n     Other Backward Classes shall also be considered for<br \/>\n     the appointments which shall be filled on the basis<br \/>\n     of merit and where a candidate belonging to a<br \/>\n     Scheduled     Caste,  Scheduled    Tribe  or   Other<br \/>\n     Backward Class is selected on the basis of merit,<br \/>\n     the number of posts reserved for Scheduled Castes,<br \/>\n     Scheduled Tribes or for Other Backward Classes as<br \/>\n     the case may be, shall not in any way be affected.\n<\/p><\/blockquote>\n<blockquote><p>                 (c)  Appointments under this rule shall<br \/>\n     be made in the order of rotation specified below in<br \/>\n     every cycle of 20 vacancies.<\/p><\/blockquote>\n<p>           1.    Open competition\n<\/p>\n<p>           2.    Other Backward Classes<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                10<\/span><\/p>\n<p>           3.   Open competition\n<\/p>\n<p>           4.   Scheduled Castes and Scheduled Tribes\n<\/p>\n<p>           5.   Open competition\n<\/p>\n<p>            6.   Other Backward Classes\n<\/p>\n<p>            7.   Open competition\n<\/p>\n<p>            8.   Other Backward Classes\n<\/p>\n<p>            9.   Open competition\n<\/p>\n<p>            10. Other Backward Classes\n<\/p>\n<p>            11. Open competition\n<\/p>\n<p>            12. Scheduled Castes and Scheduled Tribes\n<\/p>\n<p>           13.   Open competition\n<\/p>\n<p>           14.   Other Backward Classes\n<\/p>\n<p>            15. Open competition\n<\/p>\n<p>            16. Other Backward Classes\n<\/p>\n<p>            17. Open competition\n<\/p>\n<p>            18. Other Backward Classes\n<\/p>\n<p>            19. Open competition\n<\/p>\n<p>            20. Other Backward Classes<\/p>\n<p>         [Provided that the fourth turn in the third<br \/>\n     rotation and the twelfth turn in the fifth rotation<br \/>\n     shall go to Scheduled Tribe candidates and the<br \/>\n     fourth and twelfth turns in the first, second and<br \/>\n     fourth rotations, the twelfth turn in the third<br \/>\n     rotation and the fourth turn in the fifth rotation shall<br \/>\n     go to Scheduled Caste candidate and in the absence<br \/>\n     of a candidate for appointment against the turn<br \/>\n     allotted for Scheduled Tribe candidates, it shall go<br \/>\n     to a Scheduled Caste candidate and vice versa.]<\/p>\n<p>            [Provided that the rule shall not apply in the<br \/>\n     following cases:-\n<\/p>\n<p>         (i)     appointment of near relatives of military<br \/>\n     personnel killed, permanently disabled or reported<br \/>\n     to be missing in action, and near relatives of<br \/>\n     Government servants dying in harness, if they are<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 11<\/span><\/p>\n<p>     or have been wholly dependent on such military<br \/>\n     personnel or Government servants, as the case may<br \/>\n     be, subject to the condition that priority in the<br \/>\n     matter of appointment shall be given only to one<br \/>\n     relation in the case of each such personnel or<br \/>\n     Government servant.\n<\/p>\n<p>         (ii)    appointment of disabled jawans who are<br \/>\n     to be rehabilitated on completion of their medical<br \/>\n     treatment.\n<\/p>\n<p>         Persons referred to in items (i) and (ii) above<br \/>\n     shall be given priority in the matter of appointment<br \/>\n     to Government service provided they possess the<br \/>\n     prescribed qualifications.\n<\/p>\n<\/p>\n<p>            [Provided also that in preparing the list of<br \/>\n     eligible candidates to be appointed under this rule<br \/>\n     applying the rotations specified above in every cycle<br \/>\n     of 20 vacancies, the candidates eligible to be<br \/>\n     selected on open competition basis, that is, turns<br \/>\n     1,3,5,7,9,11,13,15, 17 and 19 shall be selected first<br \/>\n     and then the candidates for the reservation turns,<br \/>\n     out of those available      in the ranked list in the<br \/>\n     particular groups having regard to their ranks. In<br \/>\n     finalising the select list any candidate of the same<br \/>\n     community selected on open competition turns if<br \/>\n     found to be below in the order of the candidates<br \/>\n     selected from the same community on the basis of<br \/>\n     reservation, for the fixation of ranks as per rule 27<br \/>\n     of these rules, candidates of the same community<br \/>\n     obtaining higher marks shall be interchanged with<br \/>\n     the candidates of the same community in the<br \/>\n     reservation turn for the purpose of ranking.]<br \/>\n     &#8221; (emphasis supplied)<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 12<\/span><\/p>\n<p>             7. As per Rule 27(a) of the K.S. &amp; S.S.R., seniority<\/p>\n<p>of a person in a service, class, category or grade shall, unless<\/p>\n<p>he has been reduced to a lower rank as punishment,            be<\/p>\n<p>determined by the date of the order of his first appointment to<\/p>\n<p>such service, class, category or grade. Rule 27(c) states that<\/p>\n<p>notwithstanding anything contained in clauses (a) and (b)<\/p>\n<p>thereof, the seniority of a person appointed to a class,<\/p>\n<p>category or grade in a service on the advice of the Commission<\/p>\n<p>shall, unless he has been reduced        to a lower rank      as<\/p>\n<p>punishment, be determined by the date of first effective advice<\/p>\n<p>made for his appointment to such class, category or grade and<\/p>\n<p>when two or more persons are included in the same list of<\/p>\n<p>candidates advised,     their relative seniority shall be fixed<\/p>\n<p>according to the order in which their names are arranged in<\/p>\n<p>the advice list.\n<\/p>\n<\/p>\n<p>            8. Therefore, on a combined reading of Rule 27(c)<\/p>\n<p>read with the third proviso to Rule 14(c), before finalising the<\/p>\n<p>select list, if a candidate of the same community selected in<\/p>\n<p>the open competition turn is found to be below the order of<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                               13<\/span><\/p>\n<p>candidates selected from the same community on the basis of<\/p>\n<p>reservation, then the candidate of the same community<\/p>\n<p>obtaining higher marks shall be interchanged with the<\/p>\n<p>candidates of the same community in the reservation turn for<\/p>\n<p>the purpose of ranking.\n<\/p>\n<\/p>\n<p>            9. Admittedly, the appellant, respondents 2 and<\/p>\n<p>3, and two others belonging to the Muslim community were<\/p>\n<p>included in the rank list. The   appellant and another were<\/p>\n<p>selected against reservation turns. It is also not disputed that<\/p>\n<p>in the rank list published, they are lower in the rank. The<\/p>\n<p>appellant and the other candidate selected against reservation<\/p>\n<p>turns were Rank Nos.23 and 28, whereas respondents 2 and 3<\/p>\n<p>were   Rank Nos.6 and 10 in Ext.P2 rank list.    It was against<\/p>\n<p>the 6th turn that the appellant was selected.           Though<\/p>\n<p>respondents 2 and 3 had obtained higher marks and were<\/p>\n<p>assigned higher ranks in the select list, they were selected<\/p>\n<p>only against the   open competition turns, viz., turns 11 and<\/p>\n<p>19.<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                14<\/span><\/p>\n<p>            10. On a plain reading of the third proviso to Rule<\/p>\n<p>14(c) of the K.S.&amp; S.S.R., extracted above, there cannot be<\/p>\n<p>any doubt that the inequity sought to be remedied is between<\/p>\n<p>a candidate selected in the open competition turn having<\/p>\n<p>higher marks and a candidate of the same community having<\/p>\n<p>lesser marks and a lower rank in the rank list, on the latter<\/p>\n<p>superceding the former, by virtue of the reservation to which<\/p>\n<p>he is entitled.  The contention of the appellant is that the<\/p>\n<p>expression &#8220;candidate of the same community&#8221; should be<\/p>\n<p>understood as a person belonging to the same community<\/p>\n<p>who is eligible for reservation but was selected in the open<\/p>\n<p>competition turn. In other words, the appellant wants us to<\/p>\n<p>restrict the benefit of the third proviso only to remedy the<\/p>\n<p>inequity, if at all, arising between  two candidates selected<\/p>\n<p>against reservation turns.     We find no force in the said<\/p>\n<p>contention.\n<\/p>\n<\/p>\n<p>            11.   On a plain reading of the Rule, the inequity<\/p>\n<p>sought to be remedied is between a candidate selected in the<\/p>\n<p>open competition turn who is pushed down by another<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 15<\/span><\/p>\n<p>candidate of the same community, the latter being appointed<\/p>\n<p>in the reservation turn. In other words, it is not to remedy the<\/p>\n<p>situation among the equals as contended by the appellant, but<\/p>\n<p>it is to remedy a situation of inequality arising on account of a<\/p>\n<p>reserved candidate superceding       another candidate of the<\/p>\n<p>same community, but who has got higher marks and             had<\/p>\n<p>been assigned higher rank in the select list. The Honourable<\/p>\n<p>Apex Court in Indra Sawhney&#8217;s case only held that in order to<\/p>\n<p>claim reservation, a candidate should not only belong to the<\/p>\n<p>particular community entitled for reservation, but should also<\/p>\n<p>be a candidate in the non creamy layer category. Even after<\/p>\n<p>Indra Sawhney&#8217;s case, the       Rule making authority did not<\/p>\n<p>choose to amend the Rule. The Rule as such is not under<\/p>\n<p>challenge. We do not find, in such circumstances, any reason<\/p>\n<p>to accept the interpretation confining the benefit of the third<\/p>\n<p>proviso only among the candidates eligible for reservation. In<\/p>\n<p>the case of a Scheduled Caste or Scheduled Tribe candidate,<\/p>\n<p>there is no creamy layer concept for claiming reservation.<\/p>\n<p>Therefore, if this Rule has to be interpreted in case of a<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 16<\/span><\/p>\n<p>Scheduled     Caste\/Scheduled    Tribe  candidate,  the   word<\/p>\n<p>&#8220;Community&#8221;       has necessarily to be understood as the<\/p>\n<p>community to which the candidate belongs, irrespective of<\/p>\n<p>whether they belongs to the non creamy layer or not. But in<\/p>\n<p>the case of Other Backward Classes communities, to say that<\/p>\n<p>very same expression should be understood in a different way,<\/p>\n<p>virtually interpreting the Rule in two different ways in two<\/p>\n<p>different contingencies is not permissible under law.<\/p>\n<p>            12.     Even though      learned counsel   for the<\/p>\n<p>appellant placed reliance    on Ext.P9 circular issued by the<\/p>\n<p>Kerala Public Service Commission,      we do not find it fit or<\/p>\n<p>proper to comment on the same, since they are not in the<\/p>\n<p>party array. Further, a guideline issued by the Kerala Publis<\/p>\n<p>Service Commission is not a guideline to be followed by us<\/p>\n<p>while interpreting a statutory rule.    In case we accept the<\/p>\n<p>interpretation placed on the third proviso to Rule 14(c) of the<\/p>\n<p>K.S.&amp; S.S.R. by the appellant, we will be virtually re-writing<\/p>\n<p>the rule which is the function of the Rule making authority and<\/p>\n<p>is in    the field of subordinate legislation.   Nair Service<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                  17<\/span><\/p>\n<p><a href=\"\/doc\/739596\/\">Society v. Beermasthan<\/a> (2009 (2) KLT 123 (SC) was a case<\/p>\n<p>where the interpretation placed by this Court on Rules 14 to<\/p>\n<p>17 of the K.S.&amp; S.S.R. was not accepted by the Apex Court.<\/p>\n<p>In that context, in paragraphs 41 and 42, it was held as<\/p>\n<p>follows:-\n<\/p>\n<\/p>\n<blockquote><p>            &#8221; 41.      It may be mentioned that<br \/>\n            there is no challenge to the validity of<br \/>\n            these Rules. Hence we have to read the<br \/>\n            Rules as they are. In our opinion, the so-<br \/>\n            called purposive interpretation sought to<br \/>\n            be placed on the Rules by the High Court<br \/>\n            was misconceived and is, therefore, not<br \/>\n            acceptable.\n<\/p><\/blockquote>\n<blockquote><p>                  42.     The    High    Court     in   its<br \/>\n            observation quoted above has sought to<br \/>\n            find out the intention of Rr.14 to 17. In<br \/>\n            our opinion the question of finding the<br \/>\n            intention arises only when a statute is not<br \/>\n            clear. If the statute is clear as it is in this<br \/>\n            case, it has to be read as it is, and the<br \/>\n            literal rule of interpretation is to be<br \/>\n            applied. In our opinion intention seeking<br \/>\n            is ordinarily to be done only when the<br \/>\n            statute is not clear.&#8221;\n<\/p><\/blockquote>\n<p>Further, in paragraph 46, the Apex Court has stated as<br \/>\nfollows:-\n<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                 18<\/span><\/p>\n<p>            &#8220;46. In our opinion the High Court was<br \/>\n            in error in directing the Commission to<br \/>\n            ignore the express mandate of R.14(a).\n<\/p>\n<p>            The High Court was wrong in holding that<br \/>\n            the said Rule only applies when the<br \/>\n            vacancies are less than 20. In fact the<br \/>\n            direction of the High Court in the<br \/>\n            impugned judgment really amounts to<br \/>\n            treating the entire number of vacancies<br \/>\n            which in the present case is 250 as one<br \/>\n            unit, which is against       the  express<br \/>\n            mandate of R.14(a).        Thus the High<br \/>\n            Court has really amended R.14(a) and\n<\/p>\n<p>            (c)  of the Rules, which was not in its<br \/>\n            jurisdiction. It is only the legislature<br \/>\n            which can amend the law, and not the<br \/>\n            Court.&#8221;\n<\/p>\n<\/p>\n<p>             13. As we have already held, the object of the<\/p>\n<p>third proviso to Rule 14(c) of K.S. &amp; S.S.R. is to remedy the<\/p>\n<p>inequity flowing from the supercession of a candidate selected<\/p>\n<p>in the   open competition turn by a candidate of the same<\/p>\n<p>community selected in the reservation turn, the former<\/p>\n<p>admittedly being ranked higher to the latter. The Rule<\/p>\n<p>envisages that though the       turn for appointment against a<\/p>\n<p>reserved vacancy may arise       first, that shall not affect the<\/p>\n<p>seniority of the meritorious candidate having obtained higher<\/p>\n<p>rank, and it is with a view to protect such seniority that third<\/p>\n<p>W.A.No.2055\/2009<\/p>\n<p><span class=\"hidden_text\">                                19<\/span><\/p>\n<p>proviso was inserted in Rule 14(c) of the K.S.&amp;S.S.R.<\/p>\n<p>            The   learned   Single   Judge     has   elaborately<\/p>\n<p>considered the various aspects of the matter and after<\/p>\n<p>referring to various authorities, held that the interpretation<\/p>\n<p>sought to be placed on the third proviso to Rule 14(c) of the<\/p>\n<p>K.S. &amp; S.S.R., as contended by the appellant, cannot be<\/p>\n<p>accepted. We are in complete agreement with the view taken<\/p>\n<p>by the learned single Judge. We find no merit in this writ<\/p>\n<p>appeal.
