Whether judgment should be reported in Digest?\n\n                            J U D G M E N T (ORAL)\n<\/pre>\n<p>: REVA KHETRAPAL, J.\n<\/p>\n<p>      By way of this appeal, the appellant seeks to assail the award<\/p>\n<p>dated 07.10.1998 passed by the Motor Accident Claims Tribunal,<\/p>\n<p>New Delhi.\n<\/p>\n<p>\n<span class=\"hidden_text\">FAO 45\/1999                                              Page 1 of 3<\/span>\n<\/p>\n<p> 2.    The sole grievance of the appellant is with regard to the<\/p>\n<p>findings rendered by the Tribunal on Issue No.1, which read as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>              &#8220;Issue no.1<br \/>\n                     The law is well settled that it is for the<br \/>\n              Insurance company to firstly establish that<br \/>\n              there was a condition in the Insurance policy<br \/>\n              regarding the plying of vehicle by a duly<br \/>\n              licensed driver, and secondly to prove that this<br \/>\n              condition was violated. In this case, I do not<br \/>\n              find any evidence of the driving licence of the<br \/>\n              driver being seized by police nor it has been<br \/>\n              placed on record in original in the court, by the<br \/>\n              Insurance company. It has also not produced<br \/>\n              the original insurance policy to prove the<br \/>\n              condition which was violated. The company<br \/>\n              has examined RW1 a clerk from the<br \/>\n              Department of Transport, to say that driving<br \/>\n              licence no.81\/1680, was not in the name of<br \/>\n              driver but in the name of one Subash Chander.<br \/>\n              In the absence of any evidence, as to seizure of<br \/>\n              this very licence by the police, or its production<br \/>\n              by respondent no.1, as his licence, the evidence<br \/>\n              of RW1, has no feet to stand and it proves<br \/>\n              nothing. In the light of these facts and state of<br \/>\n              evidence, I hold that respondent has failed to<br \/>\n              prove its plea of driving of the offending vehicle<br \/>\n              by Respondent no.1 without licence. This issue<br \/>\n              is, therefore, decided against the respondent<br \/>\n              Insurance company and in favour of<br \/>\n              petitioner.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">FAO 45\/1999                                                 Page 2 of 3<\/span><\/p>\n<p> 3.    At the time of hearing, a specific query was put to Mr. Pankaj<\/p>\n<p>Seth, the learned counsel for the appellant to demonstrate from where<\/p>\n<p>driving licence No.81\/1680 had been procured by the Insurance<\/p>\n<p>Company, since it was apparent from the record that no driving<\/p>\n<p>licence had been seized by the police at the time of the accident. Mr.<\/p>\n<p>Seth has not been able to give any cogent answer to the query and is<\/p>\n<p>unable to say as to how the number of this driving licence was<\/p>\n<p>procured by the Insurance Company and as to why the clerk from the<\/p>\n<p>Department of Transport was called upon to produce this particular<\/p>\n<p>licence. This being the situation, it is apparent that there was no<\/p>\n<p>justification for the Insurance Company to presume that driving<\/p>\n<p>licence No.81\/1680 was that of the driver of the offending vehicle in<\/p>\n<p>this case, namely, Satyavir Singh.\n<\/p>\n<p>4.
