Justice A.K.BASHEER\n\n Dated :13\/05\/2010\n\n O R D E R\n                           A.K.BASHEER J.\n                           ----------------------\n                    W.P.(C) No.4311 OF 2010\n                         ---------------------------\n             Dated this the 13th day of May, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>                           ~~~~~~~~~~~<\/p>\n<p>     The two prayers in the Writ Petition read thus:<\/p>\n<blockquote><p>           &#8220;i)    Issue a writ of mandamus or other appropriate<br \/>\n           writs, orders or directions commanding the first<br \/>\n           respondent to accept the tax in respect of stage<br \/>\n           carriage KL008-R\/6625 for the present quarter<br \/>\n           without insisting for a Clearance Certificate issued by<br \/>\n           the third respondent.\n<\/p><\/blockquote>\n<blockquote><p>           ii)    Issue a writ in the nature of declaration to<br \/>\n           declare that the first respondent have no authority to<br \/>\n           refuse acceptance of tax for want of Clearance<br \/>\n           Certificate in respect of Kerala Motor Transport<br \/>\n           Workers Welfare Fund in the light of Ext.P3<br \/>\n           Clearance Certificate.&#8221;\n<\/p><\/blockquote>\n<p>     2.    When this Writ Petition came up for consideration on<\/p>\n<p>10.2.2010, this Court directed the respondents to accept the tax<\/p>\n<p>in respect of petitioner&#8217;s vehicle without insisting for Clearance<\/p>\n<p>Certificate from the Kerala Motor Transport Workers Welfare<\/p>\n<p>Fund.    It appears that pursuant to the above order, the<\/p>\n<p>respondents had accepted quarterly tax from the petitioner.<\/p>\n<p>     3.    Today, the Writ Petition is again brought up with an<\/p>\n<p>identical prayer to direct the respondents to accept the tax for<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.4311\/2010              2<\/span><\/p>\n<p>the current quarter also.        I am unable to agree with the<\/p>\n<p>contention raised by the petitioner that the respondents are not<\/p>\n<p>justified in insisting for the Clearance Certificate from the Board<\/p>\n<p>as a condition precedent to receive the quarterly tax especially<\/p>\n<p>after the amendments brought in to the Kerala Motor Vehicle<\/p>\n<p>Taxation Act and the Motor Transport Workers Welfare Fund<\/p>\n<p>Act.\n<\/p>\n<\/p>\n<p>      4.    The second prayer in the Writ Petition in my view is<\/p>\n<p>totally misconceived, in the absence of any data or material to<\/p>\n<p>substantiate the contention that the respondents have no<\/p>\n<p>authority to refuse to accept tax for want of Clearance<\/p>\n<p>Certificate.    In my view, the authority concerned is perfectly<\/p>\n<p>justified in refusing to accept the tax in the absence of a<\/p>\n<p>Clearance Certificate from the Board.\n<\/p>\n<\/p>\n<p>      5.    Anyhow, in the peculiar facts and circumstances of<\/p>\n<p>the case, petitioner is granted one more opportunity to remit the<\/p>\n<p>tax without production of the Clearance Certificate.           The<\/p>\n<p>respondents shall accept the tax from the petitioner for the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.4311\/2010             3<\/span><\/p>\n<p>current quarter. It is made clear that this indulgence is being<\/p>\n<p>shown in the peculiar facts and circumstances of this case.
