DENESAN, J.\n\n\n\n                = = = = = = = = = = = = = = =\n\n                  W.P.(C) No. 3195 OF 2007 E\n\n                = = = = = = = = = = = = = = =\n\n\n\n              Dated this the 31st January, 2007\n\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioner has retired from service.   D.C.R.G.\n<\/p>\n<p>as   determined  by  the  respondent-Board  has  been  paid  to<\/p>\n<p>him pursuant to directions issued by this Court in Ext.\n<\/p>\n<p>P2   judgment.     Thereafter,   Ext.   P5   notice   has   been<\/p>\n<p>issued by the 3rd respondent directing the petitioner to<\/p>\n<p>remit the amount of liability fixed by the Board within<\/p>\n<p>7   days.     He   is   informed   that   if   the   amount   is   not<\/p>\n<p>remitted   appropriate   action   to   deduct   the   said   amount<\/p>\n<p>will   be   taken.     The   petitioner   submits   that   Ext.   P5<\/p>\n<p>notice   is   not   in   conformity   with   the   findings   made   by<\/p>\n<p>this   Court   in   the   judgment   or   the   freedom   given   to<\/p>\n<p>the respondents.\n<\/p>\n<p>     2. In my view, it will be too early for this Court<\/p>\n<p>to   consider   the   merits   of   the   contentions   of   the<\/p>\n<p>petitioner   since   what   is   challenged   is   only   a   notice<\/p>\n<p>issued   by   the   3rd  respondent.     The   petitioner,   if   so<\/p>\n<p>advised,   can   send   a   reply   to   Ext.   P5   taking   up   the<\/p>\n<p>contentions   available   to   him.     If   final   decision   is<\/p>\n<p>taken to the prejudice of the petitioner, at that stage<\/p>\n<p><span class=\"hidden_text\">WPC No. 3195\/2007               -2-<\/span><\/p>\n<p>only   he   need   invoke   the   jurisdiction   of   this   Court.\n<\/p>\n<p>Therefore,   without   prejudice   to   the   right   of   the<\/p>\n<p>petitioner to file reply to Ext. P5, this writ petition<\/p>\n<p>is disposed of.\n<\/p>\n<p>                                                K.K.
