Justice K.T.SANKARAN\n\n Dated :21\/12\/2009\n\n O R D E R\n                         K.T.SANKARAN, J.\n                   ---------------------------------------------\n                          B.A.No.7636 of 2009\n                   ---------------------------------------------\n             Dated this the 21st day of December, 2009\n\n\n                                ORDER\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is accused No.2 in<\/p>\n<p>C.R.No.62 of 2006 of Pathanapuram Excise Range, Kollam<\/p>\n<p>District.\n<\/p>\n<p>      2.   The offence alleged against the petitioner is under<\/p>\n<p>Section 55(a) &amp; (i) of the Abkari Act.\n<\/p>\n<p>      3.   The prosecution case is that on 21.7.2006, the<\/p>\n<p>petitioner and the other accused transported a quantity of 3640<\/p>\n<p>litres of spirit. The first accused was arrested on the spot. The<\/p>\n<p>petitioner could not be arrested as he ran away. The petitioner<\/p>\n<p>was arrested in another case and his formal arrest was recorded<\/p>\n<p>on 6.10.2009.\n<\/p>\n<p>      4.   The learned counsel for the petitioner submitted that<\/p>\n<p>the investigating officer has not filed the final report before the<\/p>\n<p>expiry of sixty days and therefore, the petitioner is entitled to<\/p>\n<p>default bail under Section 167(2) of the Code of Criminal<\/p>\n<p>Procedure.\n<\/p>\n<p><span class=\"hidden_text\">BA No.7636\/2009                    2<\/span><\/p>\n<p>      5.    It is pointed out by the learned counsel for the<\/p>\n<p>petitioner that the petitioner moved an application under Section<\/p>\n<p>167(2) of the Code of Criminal Procedure before the lower court.<\/p>\n<p>But, it was dismissed and bail was refused on the ground that the<\/p>\n<p>case comes under Section 167(2)(a)(i) and not under Section 167<\/p>\n<p>(2)(a)(ii). It is submitted that the decision of the trial court is<\/p>\n<p>quite contrary to the decision in <a href=\"\/doc\/848494\/\">Sreerajan vs. State of Kerala<\/a><\/p>\n<p>(2001(1) KLT 827). It was held in <a href=\"\/doc\/848494\/\">Sreerajan vs. State of Kerala<\/a><\/p>\n<p>(2001(1) KLT 827) thus:\n<\/p>\n<blockquote><p>                  &#8220;To attract the proviso (a)(i) of Section 167<br \/>\n            (2), the offence must be punishable with death,<br \/>\n            imprisonment for life or imprisonment for a term<br \/>\n            not less than 10 years.      But in the case of an<br \/>\n            offence punishable with imprisonment which may<br \/>\n            extend up to 10 years, the court is competent to<br \/>\n            pass a sentence of imprisonment less than 10<br \/>\n            years.    Therefore, an offence punishable with<br \/>\n            imprisonment which may extend up to 10 years is<br \/>\n            covered by the proviso (a)(ii) to Section 167(2) and<br \/>\n            not covered by proviso (a)(i). In all cases where the<br \/>\n            offences are punishable with imprisonment which<br \/>\n            may extend up to 10 years, the legislature does not<br \/>\n            expect the imposition of sentence of imprisonment<br \/>\n            not less than 10 years. In a case covered by proviso<br \/>\n            to  (a)   (i) of  Section    167(2)    the  minimum<br \/>\n            punishment is imprisonment for 10 years where as<br \/>\n            in the case of an offence punishable with<br \/>\n            imprisonment which may extend up to 10 years the<br \/>\n            maximum punishment is imprisonment for 10<br \/>\n            years. Therefore, the two cases cannot be included<br \/>\n            in the same category. In this case, the petitioner is<br \/>\n            alleged to have committed an offence punishable<br \/>\n            with imprisonment for a term which may extend to<\/p>\n<p><span class=\"hidden_text\">BA No.7636\/2009                    3<\/span><\/p>\n<p>            10 years and with fine which shall not be less than<br \/>\n            Rs.1 lakh. As already noticed, the petitioner is in<br \/>\n            custody since 23.12.2000. Therefore, he has to be<br \/>\n            released on bail if he is prepared to and does<br \/>\n            furnish bail in view of the proviso (a)(ii) to Section<br \/>\n            167 of the Crl.P.C.&#8221;<\/p><\/blockquote>\n<p>       The view taken by the court below is against the dictum<\/p>\n<p>laid down in <a href=\"\/doc\/848494\/\">Sreerajan vs. State of Kerala<\/a> (2001(1) KLT 827).<\/p>\n<p>      6.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the fact that no charge<\/p>\n<p>is laid within 60 days, I am of the view that bail can be granted<\/p>\n<p>to the petitioner.\n<\/p>\n<p>      The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-I, Punalur, subject to the following conditions:<\/p>\n<p>a)    The petitioner shall report before the investigating officer<br \/>\n      between 9 A.M. and 11 A.M. on every Monday and<br \/>\n      Thursday for a period of two months and thereafter, on<br \/>\n      every Monday, till the final report is filed or until further<br \/>\n      orders;\n<\/p>\n<p>b)    The petitioner shall appear before the investigating officer<br \/>\n      for interrogation as and when required;<\/p>\n<p>c)    The petitioner shall not try to influence the prosecution<br \/>\n      witnesses or tamper with the evidence;<\/p>\n<p><span class=\"hidden_text\">BA No.7636\/2009                   4<\/span><\/p>\n<p>d)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed as above.<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                  JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vinod vs State Of Kerala on 21 December, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7636 of 2009() 1.
