I have heard S1*i,.V_S.G\ufb02ajendrat-Reddyillearned counsel<br \/>\nfor appellant \/ Lokayulital police:&#8217;baI&#8217;1dlV&#8217;S;.:iv1S_;K.Venkata Reddy,<\/p>\n<p>learned cou,n\u00abse:l &#8216;for :31&#8217; Zjfaccused 1 (&#8216;Sr 2.<\/p>\n<p>3. In brief; the .c&#8217;a..sbee\u00bbofprosecution is as follows:&#8211;<\/p>\n<p>Ijuring the of January 2000, leasehold rights of<\/p>\n<p> shops&#8221;&#8216;si.tuate in Town Municipality Complex at Sira<\/p>\n<p>~ V:V&#8221;wvere.V_sold.V:i\ufb01 public auction. PW7&#8211;Mohamrned Ibrahim was a<\/p>\n<p> 2:&#8217;succVessfu1_.&#8217;pbidder of shop No.14 of the Town Municipal<\/p>\n<p>that Sira. He had agreed to pay monthly rent of<\/p>\n<p>it &#8216;A :R.s.2V,VO0O\/&#8211; and security deposit of Rs.4,25,000\/&#8211;. Accused<\/p>\n<p> &#8216;No.1, who was the Chief Officer of Town Municipality at Sira,<\/p>\n<p>IL?)  &#8220;&#8216;\u00a7}&#8217;v&#8221;~*&#8221;-\ufb01\ufb02rx &#8216;<\/p>\n<p>an 3<br \/>\nhad to execute agreement of lease in favour of ___PW7 in<\/p>\n<p>respect of aforestated shop.\n<\/p>\n<p>It is the case of prosecution that on  1&#8242;:  <\/p>\n<p>had approached accused No.1 a;.id&#8221;requA_ested&#8217; _to_&#8217;e\u00a7tecu,te 7.<\/p>\n<p>the agreement of lease. Accuseld.__N&#8217;oJ1 islalleged &#8220;~hav,;<\/p>\n<p>demanded a sum of Rs.15;0f)&#8217;0\/&#8211; as &#8216;illegal&#8217;_:gratification to<br \/>\nexecute the agreement of l.eas&#8217;eVo_:&#8217;and._.on the*sa&#8217;me day, he<br \/>\nreceived Rs.7,500\/&#8211; to bring Rs.7,500\/-<\/p>\n<p>and assured to execute pthe a.gre,e:r_1ent&#8217;:of lease in respect of<\/p>\n<p>aforevstatedisliliop,lOri&#8221;2i3&#8242;.v0_6*.2001, PW&#8221;\/&#8217; had visited the office<br \/>\nof Tovsm\u00bb.Mu.nicipality&#8217;.. and met accused No.1. At that<\/p>\n<p>time&#8217;; accused. again demanded PW&#8217;? to pay remaining<\/p>\n<p>   amount of Rs.7&#8242;,500\/&#8211;. PW? not willing to bribe<\/p>\n<p> &#8216;V thepx lodged first information as per Ex.P.13<\/p>\n<p>and set criminal law into motion. PW12&#8211;H.S.Mar1junath, the<\/p>\n<p> _ then*.P;olice Inspector of Lokayukta at Tumkur secured<\/p>\n<p> mpacnch witnesses namely PWi&#8211;Ramadasappa and PW9&#8211;<\/p>\n<p>.:lM.H.Mahesh, explained contents of first information to them<\/p>\n<p>and made preparations to trap accused No. 1. PWl2 smeared<\/p>\n<p>1\/U &#8212; (&#8216;\\  .\n<\/p>\n<p>phenolphthalein powder to currency notes of Rs.&#8221;\/,500\/&#8211; (one<br \/>\ncurrency note of Rs.1,000\/~ denomination, f1VeVe\u00bb.c&#8217;urrency<\/p>\n<p>notes of Rs.500\/&#8211; denomination, 38 Curr-e&#8217;ncy;_~&#8221;\u00abof<\/p>\n<p>Rs.100\/&#8211; denomination and four currency.,n:oites=1.of._Rs.5&#8217;O.\/<\/p>\n<p>denomination) and entrusted to&#8217; ax<\/p>\n<p>speci\ufb01c instruction to pay to accuse-d~No.1yp viszdemdanded<br \/>\nby him. The Police Inspec&#8217;ito:ri~ (PW12~}._ &#8216;had demonstrated<br \/>\nphenolphthalein test to   reiterated<\/p>\n<p>instructions to PW7. 1 to accompany<\/p>\n<p>PW?&#8217; to&#8221;L&#8217;;bs&#8217;Vc:i&#8217;veJwhat &#8220;ufdovuldv\u00e9transpire between PW7 and<br \/>\naccused   1 &#8216;entered the chamber of accused<br \/>\nNo.1 an&#8217;c:i=.PbW7V enqAuired~&#8217;b1Vaccused No.1 about the execution of<\/p>\n<p>eeinent oifhlea-S_e,..Accused No.1 enquired PW7 about bribe<\/p>\n<p>&#8216;  paid bribe amount to accused No.1. Accused<\/p>\n<p>H * ANO&#8217;.  to keep the same beneath a tray on the table<\/p>\n<p> fprovnthvof accused No.1. PW7 kept tainted currency notes<\/p>\n<p> , 1&#8242; &#8216;ibeneath the tray. Accused No.1 called accused No.2 and told<\/p>\n<p>  to keep tainted currency notes. When accused No.2 kept<\/p>\n<p>11 tainted currency notes in his shirt pocket and proceeding<\/p>\n<p>{\\f.  ,<\/p>\n<p>&#8212;5<\/p>\n<p>towards some other room in front of chamber&#8217;-of&#8217;~a&#8217;cc&#8217;used<\/p>\n<p>No.1, PW7 gave pre-determined signal to <\/p>\n<p>other members of raiding party-&#8216;apprehe\u00e9ndedf i\\&#8217;&#8211;o.2j&#8217; <\/p>\n<p>and recovered Rs.7,500\/&#8211; from<br \/>\nPW12 apprehended<br \/>\nphenoiphthalein testzby  {inger\u00a7.,p&#8217;f..,I9%th hands of<br \/>\naccused No.1 into 251  Sodium carbonate<br \/>\nsolution.  into pink colour and<\/p>\n<p>resu1tant\u00ab*soFutio.ri. Wa;s._co&#8211;].iectecEVvin aiseparate bottle and the<\/p>\n<p>same&#8217; ~;xra&#8217;s.    aisoucon\ufb02ducted phenoiphthalein test<br \/>\nby dipping hands of accused No.2 into a bowl<br \/>\ncontaining  Vearbonate solution. The resultant<\/p>\n<p>.soiutiori.Vturned&#8217;  pink colour and the same was collected<\/p>\n<p>&#8216; .V.VAi11.a&#8217;isepara:zte- bottle and the same was sealed. Further, shirt<\/p>\n<p>&#8221; . bocket  No.2 was also dipped into a separate bowl<\/p>\n<p>coiitaining sodium carbonate soiution, the resultant solution<\/p>\n<p>&#8212; \u00bb  &#8216;t&#8221;urned into pink colour and the resuitant wash was collected<\/p>\n<p>  a separate bottle and the same was sealed. Accused No.2<\/p>\n<p>made a statement that tainted currency notes were given by<\/p>\n<p>PW? towards arrears of rent of shop No.14.\u00bb of Town<br \/>\nMunicipality Complex at Sira. Accused No.1  a<\/p>\n<p>statement that he has been falsely imp!i_catedV:&#8217;*&#8211;::d.u&#8217;ef&#8217;to<\/p>\n<p>previous enmity. PW12 completed forI11a&#8211;iities&#8221;~..:a1id __se&#8217;n1;<\/p>\n<p>incriminating articles to Forensic Science. La15oratory.&#8217;iiA;Aiter <\/p>\n<p>obtaining necessary sanctioiifroni to<br \/>\nNo.1 and necessary  frorna   prosecute<br \/>\naccused No.2,  &#8216;filed&#8217; charge sheet<br \/>\nagainst accused 1 &lt;3:\n<\/p>\n<p>4.   oniibegtiali&#8217; of prosecution, PW}. to PW13<br \/>\nwere e&#8217;2;ani.ined.ar&#8217;id&#8217;  as per EX.P.1 to Ex.P.22 were<\/p>\n<p>marlcetd so alsornaterial objects as per M.O.1 to i\\\/1.0.56 were<\/p>\n<p>  learned trial Judge on appreciation of evidence<\/p>\n<p>  * gs: 2.\n<\/p>\n<p>and on hearing learned counsel for parties a guittedaccused<\/p>\n<p>6. In View of acquittal of accused 1 &lt;3: 2, the following<br \/>\npoints would arise for detez&#039;mination:~<\/p>\n<p>[1) Whether the prosecution has proVedV..th&#039;at&#039;:&#039;o.f;..  V.<br \/>\n21.06.2001, accused No.1 being<br \/>\nOfficer of Town Municipality :at&#039;= $L,;1&#8211;._,,f1ad V<br \/>\ndemanded illegal gratiiication<br \/>\nfrom PW&quot;? as a motiveffior fre_\\ivard<br \/>\nthe agreement of._v&#039;s~a.le in respect&#039;)<br \/>\nNo.14 and receivedfvf\u00e9afpisum &#8212; as<\/p>\n<p>illegal gratification&quot;on the same day&#039;? V<\/p>\n<p>{2} Whether the_:&#039;pVros&#039;ecutionfVliagf proved in<\/p>\n<p>&#039;_fur.theravn&#039;ce.:of&#039;_.such&#8211; demand, on 28.06.2001,<br \/>\nif in ffown Municipality at Sira,<br \/>\n demanded and received<br \/>\nreniaining illegal gratification of Rs.7,500\/&#8211;<br \/>\n&quot;as a&quot; \u00abmotive or reward to execute the<br \/>\n :vag:.re&#8211;ement of lease in favour of PW7 and<br \/>\n  No.2 abetted commission of<br \/>\n&#039; .ai&quot;orestated offences by keeping aforestated<br \/>\ncurrency notes in his pocket, thereby accused<br \/>\n1 &amp; 2 committed offences under sections 7 &amp;<br \/>\n13[1)[d}{ii), punishable under section 13(2) of<\/p>\n<p>the Prevention of Corruption Act, 1988&#039;?<\/p>\n<p>E &amp;<br \/>\nKg * (\\\u00a3;\\Q\\_,L_&quot;(=&#039;.,\\~.\n<\/p>\n<p>\u00bb\u00bba<\/p>\n<p>(3) Whether the prosecution has<br \/>\naccused No.1 by misusing his officiai;&#8211;~p0sitio&#8217;1{  0 i.<br \/>\nhad obtained pecuniary  of 0&#8242;<br \/>\nRs. 15,000 \/ ~ from PW&#8217;? coniniittedl J<br \/>\noffence under section &gt;1&#8242;:&#8217;3(1:}(d)&#8217;tii),:&gt;.pLiI1i.Si}.E1Ei\u00e9~_:~.,\/..<br \/>\nunder section  of tithe  of M<\/p>\n<p>Corruption Act,  _<\/p>\n<p>(4) Vifhether the irlarried %.j_t1fiai&#8217;&#8211;.Jf.id&#8217;g,e has properly<br \/>\nappreciated eyidenced  reco1&#8243;d_?..\n<\/p>\n<p>(5)    &#8216;judgment calls for<\/p>\n<p>1&#8217; int.-ei&#8217;feren&#8217;ce?&#8217;\u00a7.f;. . :\n<\/p>\n<p>7., , Before acirertingdddddto appreciation of evidence adduced<\/p>\n<p>&#8216;   ijrosecutiondVvddirikitnesses and findings recorded by the<\/p>\n<p>  trialvidgiudge, certain admitted facts estabiished from<\/p>\n<p>Aeydidencet&#8217; record, which have not been disputed by either<\/p>\n<p>parties are stated as fo11ows:&#8211;\n<\/p>\n<p>PW7 Was the successful. bidder of shop No.14 in<\/p>\n<p> public auction held in the month of January 2000 and he had<\/p>\n<p> cawfi,<\/p>\n<p>09 _<\/p>\n<p>agreed to deposit a sum of Rs.4,25,000\/- as se.o&#8217;arit3ui;:ie&#8217;posit<\/p>\n<p>and pay monthly rent of Rs.2,000\/-. PW7 &#8216;iatas  <\/p>\n<p>pay security deposit within 15 d-ay&#8217;s&#8217;~from&#8217;_&#8217;the of -a.ue&#8217;t&#8211;ion&#8217;.f <\/p>\n<p>On the other hand, PW? paid&#8217;b&#8217;:&#8217;sVeei1_i:rAity Zdepios\ufb01,<\/p>\n<p>instalments as shown in  reading. Vas.:he~r\u00e9uI1d&#8217;er:&#8211; &#8221;<\/p>\n<p> V  ,<\/p>\n<p>1 338977 03.022000&#8242;   i&#8217;2;\u00a7~00.&#8217;00<\/p>\n<p>QR,<\/p>\n<p>._J<\/p>\n<p>6:: (&#8216;3 330513 was<\/p>\n<p>.2 5<\/p>\n<p>.  Qaiaosir <\/p>\n<p>&#8216;T     (mm O\ufb01d<br \/>\n2 3400:\u00ab7\u00ab.._V  i=0.04.2.000,_ ._5\u00bbr90,;000.00 saga ,@&amp;&#8217;}(j<\/p>\n<p>3 34&#8217;10&#8217;0a.\u00a3&#8217;*-*?&#8221;..__ i&#8217;\u00a70;5.i2000&#8243;&#8221;y_  .1,&#8217;:&gt;.2,500.00 &#8216;*9&#8242; M&#8217; mg)<\/p>\n<p>4,25,000.00<\/p>\n<p>8.  &#8216;was, Vreiwgular in payment of rents. As per<\/p>\n<p>_proc1iiced..&#8211;.by PW&#8217;? marked as EX.P.8 to Ex.P.10, he<\/p>\n<p>&#8216; paiti\ufb01iis.-.?.O,O00\/W towards rent though he was due in a<\/p>\n<p>* . .s&#8217;s&#8217;m Vst&#8217;-&#8220;;0fs;.ss,000\/- as on 28.07.2001. PW?&#8217; for the reasons<\/p>\n<p>host to him had not paid rents regularly to Town<\/p>\n<p>2 s. it &#8216;i1&#8217;v&#8217;\u00a7t1nieipa1ity at Sira.\n<\/p>\n<p> 9. it is clear from the evidence of PW6 (the then Assistant<\/p>\n<p>Operator in Town Municipality at Sira} that PW? was<\/p>\n<p>i :\n<\/p>\n<p>  .-,4 L-\u00e9\u00e9k \u00b0<\/p>\n<p>tn: 1;; _<\/p>\n<p>of commission of aforestated offences by accused No.1. Even<br \/>\nwhen accused No.2 was examined under section 313<\/p>\n<p>Cr.P.C., he was not questioned about his  of<\/p>\n<p>commission of aforestated offences by acc&#8221;u~&#8211;s&#8217;ed.A_l.&#8217;No.1.z <\/p>\n<p>learned trial Judge has proceeded&#8217; on assu:rn.ptionuVg_that<\/p>\n<p>accused 1 8: 2 have committed offences under&#8217; sectioris<br \/>\n13[1](d)[ii), punishable underisection &#8216;1.3_{2} fof &#8220;Act. in a<br \/>\nway, the learned trialgudgellhaysltreated accused No.2, who<\/p>\n<p>was an attender on  :accuse_&#8217;dVbN__o.1, who was the<\/p>\n<p>Chiei&#8221;Oiiicei&#8217;\ufb01 of  at Sira.\n<\/p>\n<p>11. &#8216;\u00abIii._notice&#8221;ifro&#8217;rri ,.th*e_meiridence, none of the prosecution<\/p>\n<p>witnesses .1 ha_sV&#8221;deposed that accused No.2 had concealed<\/p>\n<p>  currency notes in his shirt pocket, knowing full well<\/p>\n<p>  had accepted bribe amount from PW&#8221;\/&#8217;.<\/p>\n<p>Af3\u00abVenV__vif  assumed that accused No.1 had received bribe,<\/p>\n<p> AA noneof the prosecution witnesses has deposed that accused<\/p>\n<p>  &#8221; \u00abNo.i2 knowing Eull well that accused No.1 had received bribe<\/p>\n<p> of Rs.7,5()()\/~\u00bb had concealed the same in his shirt pocket to<\/p>\n<p>aid or abet commission of aforestated offences Virtually,<\/p>\n<p>A} (~$@\\..p..[&gt;)\\_.44 &#8216; i<\/p>\n<p>&#8211;12<\/p>\n<p>there is no incriminating evidence against accused No&#8217;.j\u00a7Z.&#8221;&#8216;[he<\/p>\n<p>Court below has ignored to frame speci\ufb01c&#8221;&#8221;&#8216;.c:harged&#8217; <\/p>\n<p>accused No.2. In the circumstances, &#8216;is do  g\ufb01nd any&#8217;. i<\/p>\n<p>reasons to interfere with the acquittaioi&#8217;   d&#8217;<\/p>\n<p>12. Now adverting to evidvence  accused<br \/>\nNo.1, I find that proVs&#8217;ecution&#8221;has.:  on&#8217; evidence given<br \/>\nby PW}, PW?&#8217; &amp; Pwta.  by PW2 to PW-4<br \/>\nrelates to  of Lokayukta to<br \/>\ntrap the been seriously controverted<br \/>\nby   given by PW5 is also not in<br \/>\ndiSpu\u00a3ek_%kS   PW6 has given evidence relating<\/p>\n<p>to;unauthorisedconstruction raised by PW7 and demolition<\/p>\n<p> A at the instance of accused No. 1.\n<\/p>\n<p>I  he  iv~T}&#8217;atvVeV&#8217;thAe-relevant time, PW8&#8211;Jagadish Jois, was working<\/p>\n<p>  Secretary in the Department of Urban<\/p>\n<p> AA Deveiotpment. PW8 has deposed about sanction accorded by<\/p>\n<p>&#8221;  in the name and by order of the Governor of Karnataka,<\/p>\n<p> to prosecute accused No.1. PW8 has been cross&#8211;eXamined<\/p>\n<p>I<br \/>\n5,\/x-..g9~v t &#8212;~<br \/>\ni A<\/p>\n<p>;g&#8217;\\ S<\/p>\n<p>&#8211;13<\/p>\n<p>regarding procedure to be followed for accordingsariction to<\/p>\n<p>prosecute accused No.1. 1 do not \ufb01nd any&#8221;&#8216;i.nfirjriiity <\/p>\n<p>sanction order. PW8 has de}iiose&#8217;d&#8217;\u00abt_h&#8217;at had&#8221;&#8211;:Vpla&#8217;ced7. <\/p>\n<p>relevant records before the couVncei&#8221;&#8211;ne&#8217;d  if<br \/>\nverification of records accorded  prosecute<br \/>\naccused No. 1. Thereafter, }?W&#8221;lssuedsancAti\u00a7on order by<br \/>\norder and in the name  ltarnataka.\n<\/p>\n<p>14. as  witnesses in the<br \/>\nraiding   &#8221;   d\n<\/p>\n<p>15. hi had accorded sanction to<br \/>\nprosecute.  o ;  \u00e9<\/p>\n<p>  E  the discu_ssion made supra. I have held that there is<\/p>\n<p>&#8216; {I10 mate&#8217;1&#8217;i.alv worth of consideration against accused no.2,<\/p>\n<p>&#8220;.feVen&#8217;vtlienVf=l5W10 has deposed that on consideration of<\/p>\n<p>redlepvazgthvrecords, he was satisfied that there is prima facie<\/p>\n<p>if &#8216;lease against accused No.2 and accorded sanction to<\/p>\n<p> prosecute accused No.2 for offences under sections 7 and<\/p>\n<p>13{1](d}(ii], punishable under section 13(2) of the Act, which<\/p>\n<p>I\\w7*&lt;9G&#039;\/&quot;1&quot;-*&quot;d7u<\/p>\n<p>, 15 i,<\/p>\n<p>at Sira. On the said application, accused No.  an<\/p>\n<p>endorsement, directing PW? to produce stamp<\/p>\n<p>papers to execute the agreement of leas.e.&quot;._From_.Vthe. contents <\/p>\n<p>of Ex.P.13, I \ufb01nd, PW7 had,comrnit.te&#039;d.zdefauljtin<br \/>\nrents. PW? was not even  to. &#039;rent of<br \/>\nRs.2,000\/&#8211; per month..,_&amp;&#039;PW&#039;7&#039;l&quot;was&#039;jnotapayingvrents regularly.<br \/>\nAs already stated,  of Rs.16,000\/&#8211;\n<\/p>\n<p>towards of  PW?&#8217; has admitted<br \/>\nthat he   papers for execution of<br \/>\nthe   paid\ufb02rents regularly. PW? has not<br \/>\ndeposed &#8220;that  had told PW7 to pay illegal<\/p>\n<p>grati\ufb01catiuon.,_:vofi.i{s.lF,$d0.0\/&#8211; on 21.06.2001. Therefore, it is<\/p>\n<p> , qIl;\u00a3ar:\u00bb\u00a2hat,ppwfwas aware of defaults committed by him.<\/p>\n<p>~,.al_&#8217;;:3o aware that he should have produced<\/p>\n<p>stamp papers for the execution of agreement of<\/p>\n<p>lease.
