Justice S.SIRI JAGAN\n\n Dated :16\/02\/2011\n\n O R D E R\n                                S.SIRI JAGAN, J.\n\n                        ==================\n\n                          W.P.(C).No. 1909 of 2011\n\n                        ==================\n\n               Dated this the 16th day of February, 2011\n\n                                J U D G M E N T\n<\/pre>\n<p>      The petitioners were promoted as Junior Heath Inspector Grade<\/p>\n<p>I by Ext.P1 order and were allotted to Malappuram District. But in<\/p>\n<p>Malappuram district, they were not given posting for want of vacancies<\/p>\n<p>in that district. They were realloted to Palakkad district. But they have<\/p>\n<p>not been given any posting in that district also for want of vacancies.<\/p>\n<p>In the meanwhile, by Exts.P1 and P3 orders, juniors of the petitioners<\/p>\n<p>were given postings. It is under the above circumstances, the<\/p>\n<p>petitioners have filed this writ petition seeking the following reliefs;<\/p>\n<blockquote><p>     &#8220;i      a writ of mandamus to the 1st respondent to forthwith issue<br \/>\n             allotment orders for posting the petitioners to any of the<br \/>\n             districts where there are vacancies of Junior Health Inspectors<br \/>\n             Grade I.\n<\/p><\/blockquote>\n<blockquote><p>      ii.    a writ of mandamus to the 1st Respondent to revert juniormost<br \/>\n             promotees and to issue orders allotting the petitioners to those<br \/>\n             vacancies, in case there are no open vacancies.\n<\/p><\/blockquote>\n<blockquote><p>      iii.   a writ of mandamus to the 1st respondent to take up and pass<br \/>\n             orders on Exts.P5 to P7 forthwith.\n<\/p><\/blockquote>\n<blockquote><p>      iv.    a writ of mandamus to the 1st respondent to grant all service<br \/>\n             benefits to the petitioners on the basis of promotion by Ext.P1<br \/>\n             order.&#8221;<\/p><\/blockquote>\n<p>      2.    Today, the learned Government Pleader produces before<\/p>\n<p>me a copy of order No.EG2-79648\/08\/DHS dated 10.02.2011. The<\/p>\n<p>learned Government Pleader hands over a copy of the same to the<\/p>\n<p>learned counsel for the petitioners. As per the same, the petitioners<\/p>\n<p><span class=\"hidden_text\">w.p.c.1909\/11                        2<\/span><\/p>\n<p>have been allotted to PHC K.P. Colony, Idukki, PHC Deviyar Colony,<\/p>\n<p>Idukki and PHC K.P.Colony, Idukki, respectively. The same is recorded.<\/p>\n<p>It would be open to the petitioners to join duty at their place of posting<\/p>\n<p>on the strength of the copy of the said order thus handed over to the<\/p>\n<p>counsel for the petitioners, if they have not yet received the same.
