The unit was set up in Plot No.412 and, thereafter,<br \/>\n\twith the change in the name of the Company, it was also proposed to<br \/>\n\thave Plot No.413. The intimation was also given to the<br \/>\n\tpetitioner-Company that some work is being carried on.\n<\/p>\n<p>As<br \/>\n\treflected from the impugned order, the Junior Engineer as well as<br \/>\n\tExecutive Engineer had visited the premises of the respondent no.1<br \/>\n\tand had not found anything objectionable or have not reported any<br \/>\n\tirregularity and, hence, they had not taken any steps. However<br \/>\n\tsubsequently, as could be found from the assessment and the bill<br \/>\n\tdated 24.02.2009(Annexure-B) which has been issued, the assessment<br \/>\n\twas made, which has been challenged before the respondent<br \/>\n\tno.2-authority by the respondent no.1-Consumer. The respondent<br \/>\n\tno.2-authority has discussed in the impugned order in detail after<br \/>\n\tconsidering the rival view points and passed the impugned order<br \/>\n\treferring to the calculation, which has been arrived at. It is<br \/>\n\treferred to in the affidavit-in-reply filed by the Deputy General<br \/>\n\tManager of the respondent no.1 that as per the provisions of Section<br \/>\n\t126 of the Electricity Act, the assessment has been made, however,<br \/>\n\tthe petitioner-Company has not been able to point out as to the<br \/>\n\tirregularity, which is alleged to have been made or committed where<br \/>\n\tthe officers of the petitioner-Company had visited the premises and<br \/>\n\tthey have not taken any steps. Moreover, while passing the impugned<br \/>\n\torder, the respondent no.2-authority has taken care to direct the<br \/>\n\trespondent no.1 to deposit 50% of the bill amount. The method of<br \/>\n\tcalculation, which has been arrived at, is also reflected, which<br \/>\n\tcannot be said to be erroneous as the respondent no.2-authority,<br \/>\n\twhich is fully conversant with the technical aspect, has arrived at<br \/>\n\tthis assessment.\n<\/p>\n<p>The<br \/>\n\treliance placed by the learned counsel, Ms.Bhaya upon the order of<br \/>\n\tthis Court passed in Letters Patent Appeal No.546 of 2010 in Special<br \/>\n\tCivil Application No.679 of 2009 with Civil Application No.3118 of<br \/>\n\t2010 in Letters Patent Appeal No.546 of 2010 dated 11.05.2010 will<br \/>\n\thave no application to the present case as the facts were totally<br \/>\n\tdifferent as there it was specifically observed with regard to the<br \/>\n\tunauthorized use of power and dishonesty, which is not the case<br \/>\n\there.\n<\/p>\n<p>Therefore,<br \/>\n\tthe present petition deserves to be dismissed and is accordingly<br \/>\n\tdismissed. Notice is discharged.
