Justice M.SASIDHARAN NAMBIAR\n\n Dated :27\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.3309 OF 2009\n              ------------------------------------------\n\n               Dated       27th October 2009\n\n\n                           O R D E R\n<\/pre>\n<p>          As per order in          Crl.M.P.1891\/2009, Judicial<\/p>\n<p>First  Class  Magistrate-I,           Sulthan        Bathery   granted<\/p>\n<p>interim  custody    of      vehicle         KL-01\/N-2660      to   the<\/p>\n<p>petitioner on executing        a bond for Rs.2,00,000\/- with<\/p>\n<p>two solvent sureties for the like sum.                      The State<\/p>\n<p>challenged that   order before Sessions court, Wayanad<\/p>\n<p>in  Crl.R.P.13\/2009.       By     Annexure-D           order,  learned<\/p>\n<p>Sessions  Judge   modified        that       order      directing  the<\/p>\n<p>petitioner to furnish bank guarantee for Rs.75,000\/-.<\/p>\n<p>This petition is filed challenging Annexure-D order<\/p>\n<p>contending  that     learned         Sessions          Judge  has   no<\/p>\n<p>jurisdiction  to    revise       the      order       passed  by   the<\/p>\n<p>Magistrate under Section 451 of the Code of Criminal<\/p>\n<p>Procedure.\n<\/p>\n<p>         2.   Learned         counsel         appearing      for   the<\/p>\n<p>petitioner and learned Public Prosecutor were heard.<\/p>\n<p>         3.   Maruti car KL-01\/N-2660, belonging to<\/p>\n<p>the petitioner was taken into custody by the Circle<\/p>\n<p>Crmc 3309\/09<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>Inspector     of  Police,  Sulthan   Bathery  in   crime<\/p>\n<p>No.200\/2009 registered    under Section 22(c) of N.D.P.S<\/p>\n<p>Act. By order in C.M.P.1891\/2009, Judicial First Class<\/p>\n<p>Magistrate-I, Sulthan Bathery granted interim custody<\/p>\n<p>on conditions under Section 451 of Code of Criminal<\/p>\n<p>Procedure.     The only question for consideration is<\/p>\n<p>whether     the  learned  Sessions   Judge  could   have<\/p>\n<p>exercised the revisional powers as against an order<\/p>\n<p>passed under Section 451 of the Code.<\/p>\n<p>            4.  The Question is settled by the decision<\/p>\n<p>of this court in <a href=\"\/doc\/1145174\/\">Vasu v. Unnikrishnan<\/a> (1983   KLT 310).<\/p>\n<p>It was    held that if a Magistrate once passes an order<\/p>\n<p>under Section 451 of the Code, it cannot be said that<\/p>\n<p>till the final disposal of the case he cannot pass any<\/p>\n<p>other order and there may be a case, where    a   person<\/p>\n<p>to whom the Magistrate directed the      property to be<\/p>\n<p>given   be reluctant   to continue in custody after some<\/p>\n<p>time. He is then at liberty to approach the court to<\/p>\n<p>relieve    him  of  the  custody  and  necessarily,  the<\/p>\n<p>Magistrate has to pass     another order afresh. It was<\/p>\n<p>also noted that there may be a case where a person who<\/p>\n<p>was given custody under Section 451 of the Code is not<\/p>\n<p>taking care of the property or is misusing it and in<\/p>\n<p>Crmc 3309\/09<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>such circumstances, it would warrant a    fresh order or<\/p>\n<p>a modified order passed by the Magistrate and in such<\/p>\n<p>circumstances, it cannot be said that an order once<\/p>\n<p>passed under Section 451 of the Code is a final   order.<\/p>\n<p>It  was    therefore held  that  it  necessarily  is  an<\/p>\n<p>interlocutory    in character  and  therefore,  revision<\/p>\n<p>petition is not competent against the order passed<\/p>\n<p>under Section 451 of the Code. In view of the decision,<\/p>\n<p>learned Sessions Judge could not have modified the<\/p>\n<p>order    by   exercising   the  revisional   powers   in<\/p>\n<p>Crl.R.P.13\/2009.\n<\/p>\n<p>            Petition is allowed.
