Justice V.GIRI\n\n Dated :01\/12\/2008\n\n O R D E R\n                       V.GIRI, J.\n       -------------------------\n           W.P.(C).No.22534 of 2008\n       -------------------------\n        Dated this the 1st day of December, 2008.\n\n\n                     JUDGMENT\n<\/pre>\n<p>       The     petitioner         challenges      certain<\/p>\n<p>conditions  contained       in    Ext.P1   order  issued<\/p>\n<p>under Section 22(3) of the Mines Act, 1952 by<\/p>\n<p>the  Village     Officer,        Moonnilavu,     Kottayam<\/p>\n<p>District.\n<\/p>\n<p>       2. It is pointed out, in paragraph 23 of<\/p>\n<p>the counter affidavit filed on behalf of the 1st<\/p>\n<p>respondent, that Section 22(4) of the Mines Act<\/p>\n<p>provides for an appeal by the owner, agent,<\/p>\n<p>manager of the mine against the order issued<\/p>\n<p>under Section 22(3) of the Act to the Chief<\/p>\n<p>Inspector of Mines. In these circumstances, I am<\/p>\n<p>not  inclined    to     consider      the   petitioner&#8217;s<\/p>\n<p>contention on merits. But, it is made clear that<\/p>\n<p>if the petitioner files an appeal against the<\/p>\n<p>order, the appellate authority shall treat the<\/p>\n<p>same as presented within time and proceed to<\/p>\n<p>dispose it of without further delay, at any<\/p>\n<p>W.P.(C).NO.22534\/08<\/p>\n<p>                         :: 2 ::\n<\/p>\n<p>\nrate, within three months from the date of<\/p>\n<p>receipt of a copy of this judgment.<\/p>\n<p>         Writ petition is disposed of as above.<\/p>\n<p>Petitioner shall produce a copy of this judgment<\/p>\n<p>and a copy of the writ petition, along with the<\/p>\n<p>appeal.
