Justice ANTONY DOMINIC\n\n Dated :05\/11\/2009\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                    ================\n                W.P.(C) NO. 14920 OF 2009 (H)\n               =====================\n\n         Dated this the 5th day of November, 2009\n\n                        J U D G M E N T\n<\/pre>\n<p>     Petitioner is a Deputy Chief Engineer under the respondent<\/p>\n<p>Board.\n<\/p>\n<p>     2.    He worked as Chairman of the Consumer Grievance<\/p>\n<p>Redressal Forum, Norther Region during the period from<\/p>\n<p>22\/5\/2008 to 22\/9\/08 on which date, by Ext.P6 order, he was<\/p>\n<p>placed under suspension. That was challenged before this Court in<\/p>\n<p>WP(C) No.28918\/08. That writ petition was disposed of by Ext.P7<\/p>\n<p>judgment directing the Board to consider whether the petitioner<\/p>\n<p>could be posted in any capacity other than the Chair Person of the<\/p>\n<p>CGRF. Accordingly, the petitioner was reinstated in service as<\/p>\n<p>Deputy Chief Engineer.\n<\/p>\n<p>     3.    In the meantime, Ext.P8 memo of charges was issued,<\/p>\n<p>to which, petitioner submitted Ext.P9 reply. The proceedings<\/p>\n<p>concluded by Ext.P10 order passed by the Chairman, the relevant<\/p>\n<p>portion of which reads as under:\n<\/p>\n<blockquote><p>            The undersigned has examined the contentions<br \/>\n      made by Sri.T.R.Murukesan, Deputy Chief Engineer in<br \/>\n      the written statement of defence as well as that during<br \/>\n      the course of personal hearing, which was granted to<br \/>\n      him on 21.01.2009, in detail, with reference to the<\/p>\n<p>WPC 14920\/09<br \/>\n<span class=\"hidden_text\">                                   :2 :<\/span><\/p>\n<p>       relevant records of the case. It is found that the entire<br \/>\n       incident ought to have been handled in a more mature<br \/>\n       manner by the delinquent officer.            However no<br \/>\n       deliberate misconduct inviting major punishment is<br \/>\n       seen happened on the part of the delinquent regarding<br \/>\n       the case. Therefore Sri.T.R.Murukesan, Deputy Chief<br \/>\n       Engineer is cautioned to act with greater composure<br \/>\n       while interacting with the members of the public and<br \/>\n       further action against him in this regard is dropped.\n<\/p><\/blockquote>\n<blockquote><p>              The disciplinary action against Sri.T.R.Murukesan,<br \/>\n       Deputy Chief Engineer, Office of the Chief Engineer<br \/>\n       (Transmission North), Kozhikode (formerly Chairperson,<br \/>\n       Consumer Grievance Redressal Forum, Kozhikode) is<br \/>\n       finalized accordingly. The period spent by him under<br \/>\n       suspension will be treated as eligible leave.\n<\/p><\/blockquote>\n<blockquote><p>      4.    Petitioner challenged Ext.P10 by filing Ext.P11 appeal.\n<\/p><\/blockquote>\n<p>The appeal was rejected and the decision was communicated to<\/p>\n<p>him by Ext.P12 order, which only said that the Board in its<\/p>\n<p>meeting held on 28\/4\/2009 examined the appeal in detail with<\/p>\n<p>reference to the connected file and relevant records of the case<\/p>\n<p>and decided to uphold the orders passed by the Chairman and to<\/p>\n<p>reject the appeal petition.\n<\/p>\n<p>      5.    Invoking the provisions of the Right to Information Act,<\/p>\n<p>petitioner applied for the minutes of the Board meeting which<\/p>\n<p>dealt with his appeal and accordingly, Ext.P13 minutes of the<\/p>\n<p>meeting held on 28\/4\/2009 has been issued, which shows that<\/p>\n<p>without any discussion on the merits of the contentions raised in<\/p>\n<p>WPC 14920\/09<br \/>\n<span class=\"hidden_text\">                                 :3 :<\/span><\/p>\n<p>the appeal filed by the petitioner, it is recorded as &#8220;rejected&#8221;. It is<\/p>\n<p>in these circumstances, the writ petition is filed.<\/p>\n<p>     6.    Although the counsel for the petitioner has raised<\/p>\n<p>several contentions against Ext.P10 order to the extent it orders<\/p>\n<p>that the period the petitioner was kept under suspension will be<\/p>\n<p>treated as eligible leave, having regard to the facts of this case, I<\/p>\n<p>do not think it necessary for this Court to deal with those<\/p>\n<p>contentions. This is for the reason that even on a plain reading,<\/p>\n<p>Exts.P12 and P13 by which Ext.P11 appeal filed by the petitioner<\/p>\n<p>was rejected, the order is unsustainable. The appellate authority<\/p>\n<p>is not expected to rewrite a full judgment on the appeal in a case<\/p>\n<p>where the appellate authority is endorsing views of the original<\/p>\n<p>authority.    But however, the proceedings of the appellate<\/p>\n<p>authority should reflect application of mind to the contentions<\/p>\n<p>raised in the appeal. In this case, both Exts.P12 and P13 show<\/p>\n<p>that the contentions raised by the petitioner have not been<\/p>\n<p>considered at all and there is total non application of mind. If that<\/p>\n<p>be so, the appeal filed by the petitioner was not properly<\/p>\n<p>considered and for that reason Ext.P12 deserves to be set aside.<\/p>\n<p>     7.    Accordingly, I set aside Ext.P12 and direct the 1st<\/p>\n<p>WPC 14920\/09<br \/>\n<span class=\"hidden_text\">                                 :4 :<\/span><\/p>\n<p>respondent, the appellate authority, to reconsider Ext.P11 appeal<\/p>\n<p>filed by the petitioner and pass fresh orders in the matter with<\/p>\n<p>notice to the petitioner.
