No.28141 of 2010\n                MONU @ MANORANJAN @ MANORANJAN KUMAR\n                                         Versus\n                                  STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>2   27.8.2010              Both these applications are taken up together for<\/p>\n<p>                hearing.\n<\/p>\n<p>                           Heard counsel for the petitioners and the State.<\/p>\n<p>                           The petitioners are accused in a case under sections<\/p>\n<p>                363, 366, 376, 420\/34 of Penal Code.\n<\/p>\n<p>                           It is alleged that the victim girl Saneha Rani married<\/p>\n<p>                with one Deepu Thakur. Thereafter, she separated from him and<\/p>\n<p>                solemnized her second marriage with one Sanjay Thakur. It is<\/p>\n<p>                further alleged that accused Jitendra Kumar kidnapped her and<\/p>\n<p>                kept in the house of accused Monu @ Manoranjan. Thereafter, she<\/p>\n<p>                was subjected to rape by the accused Jitendra Kumar, Rupesh<\/p>\n<p>                Kumar and others.\n<\/p>\n<p>                           Learned counsel for the petitioner submits that the<\/p>\n<p>                victim girl in her statement recorded under section 164 Cr.P.C. has<\/p>\n<p>                not named these petitioners rather she stated that she had<\/p>\n<p>                solemnized marriage with one Udai Shankar and expressed her<\/p>\n<p>                desire to live with him. He further submits that co-accused<\/p>\n<p>                Jitendra Kumar having similar allegation to that of the petitioners<\/p>\n<p>                has been granted bail by a bench of this court by order dated<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>       2.8.2010 passed in Cr.Misc.No.24604 of 2010. The petitioners are<\/p>\n<p>       in custody since 22.5.2010.\n<\/p>\n<p>                   Considering the facts and circumstances of the case,<\/p>\n<p>       the petitioners Rupesh Kumar and Monu @ Manoranjan @<\/p>\n<p>       Manoranjan Kumar are directed to be released on bail in<\/p>\n<p>       connection with Ahiyapur P.S.
