Justice S.SIRI JAGAN\n\n Dated :04\/01\/2008\n\n O R D E R\n                               S.SIRI JAGAN, J.\n\n\n                           =======================\n\n                             W.P.(C) No. 522   of 2008 (K)\n\n                           =======================\n\n\n                     Dated this the   4th  day of January, 2008\n\n\n\n\n                                    JUDGMENT\n<\/pre>\n<p>      By   Ext.P15   order,   the   2nd   respondent   terminated   the<\/p>\n<p>service   of   the   petitioner   as   a   teacher   of   the   1st   respondent&#8217;s<\/p>\n<p>school.   According to the petitioner, this action of respondents 1<\/p>\n<p>and 2 is actuated by malafides.   Therefore, the petitioner seeks<\/p>\n<p>the following reliefs:\n<\/p>\n<blockquote><p>        &#8220;i)   Issue   a   writ   of   certiorari   calling   for   the   records<\/p>\n<p>            leading   upto   Exhibit   P15   and   quash   the   same   as<\/p>\n<p>            being malafide, based on extraneous considerations,<\/p>\n<p>            ultravires   the   powers   of   the   2nd   respondent,<\/p>\n<p>            contrary to the byelaws relating to affiliation to the<\/p>\n<p>            CBSE as also in violation of Article 14 and 16 of the<\/p>\n<p>            Constitution.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>       ii) Issue a writ of mandamus commanding the 1st and<\/p>\n<p>            2nd respondent to reinstate the petitioner in service<\/p>\n<p>            as   teacher   in   the   Saraswathy   Vidyalaya   with   all<\/p>\n<p>            consequential benefits.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>       iii)   Issue   a   writ   of   mandamus   commanding   the   3rd<\/p>\n<p>            respondent   to   take   necessary   steps   to   ensure   that<\/p>\n<p>            the   petitioner   is   reinstated   in   service   with   all<\/p>\n<p>            consequential benefits thereof.&#8221;<\/p><\/blockquote>\n<p>      2.      I   feel   that   it   is   more   appropriate   that   the   3rd<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 522\/2008\/K                        -2-<\/span><\/p>\n<p>respondent considers the matter first, in view of the fact that at<\/p>\n<p>the   time   of   earlier   termination   of   service   of   the   petitioner,   this<\/p>\n<p>Court has directed so.   Accordingly, this writ petition is disposed<\/p>\n<p>of with the following directions:\n<\/p>\n<p>        The petitioner shall file a suitable representation before the<\/p>\n<p>3rd   respondent   within   two   weeks   from   the   date   of   receipt   of   a<\/p>\n<p>copy   of   this   judgment.     On   receipt   of   the   same,   the   3rd<\/p>\n<p>respondent   shall   consider   the   same   and   pass   a   just   and<\/p>\n<p>reasonable order after affording an opportunity of being heard to<\/p>\n<p>the petitioner as well as the 3rd respondent.
