DAVE\n\t\t\n\t\n\n \n\nDate\n: 30\/08\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with First Information Report registered as<br \/>\nI-C.R. No. 4 OF 2011 with Vadinar Police Station, Dist. Jamnagar for<br \/>\nthe offences punishable under Sections 302, 34, 504 and 506 of the<br \/>\nIndian Penal Code and Section 135 of the Bombay Police Act.\n<\/p>\n<p>2.\tLearned<br \/>\nCounsel appearing for the applicant submitted that now charge-sheet<br \/>\nis filed and the case of the prosecution reveals around<br \/>\ncircumstantial evidence and the applicant is alleged to have remained<br \/>\npresent but no overt act is attributed and hence, by imposing<br \/>\nsuitable conditions for securing presence during trial and in absence<br \/>\nof any other material at this stage implicating the applicant, the<br \/>\napplicant may be enlarged on bail.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned Counsels for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the applicant, by imposing suitable<br \/>\nconditions, I deem it just and proper to enlarge the applicant on<br \/>\nbail.\n<\/p>\n<p>5.\tLearned<br \/>\nCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith First Information Report registered as I-C.R. No. 4 of 2011 with<br \/>\nVadinar Police Station, Dist. Jamnagar on executing a bond of<br \/>\nRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\namount to the satisfaction of the Trial Court and subject to the<br \/>\nconditions that he shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>7.\tThe<br \/>\nauthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
