ABDUL REHIM, J.\n                -----------------------------------------------------\n                     WP(C) No. 35680 of 2010\n               ------------------------------------------------------\n          Dated this the 23rd day of December, 2010\n\n                              J U D G M E N T\n<\/pre>\n<p>     The petitioner is the mother of the 3rd respondent.<\/p>\n<p>Petitioner is challenging the proceedings initiated by<\/p>\n<p>respondents 1 and 2 against the 3rd respondent under the<\/p>\n<p>Securitisation and Reconstruction of Financial Assets and<\/p>\n<p>Enforcement of Security Interest                       Act, 2002 (SARFAESI<\/p>\n<p>Act). The 3rd respondent had defaulted repayment of a<\/p>\n<p>loan availed from             respondents 1 and 2, and as a<\/p>\n<p>consequence the immovable property, which is the secured<\/p>\n<p>asset, was proceeded against. Ext.P3 is the notice issued<\/p>\n<p>by the first respondent under Section 13(2) of the Act.<\/p>\n<p>     2. According to the petitioner she has got life interest<\/p>\n<p>in the residential building contained in the immovable<\/p>\n<p>property which is now being proceeded against. It is stated<\/p>\n<p>that the petitioner along with others have executed Ext. P1<\/p>\n<p>partition deed settling the property in favour of the 3rd<\/p>\n<p>WP(C) No. 35680 of 2010<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>respondent,      with a reservation of the rights of the<\/p>\n<p>petitioner to reside in the house till her life. Contention is<\/p>\n<p>that, since the petitioner has not joined as a guarantor in<\/p>\n<p>the loan transaction, her interest could not be affected by<\/p>\n<p>virtue of the impugned proceedings.\n<\/p>\n<\/p>\n<p>     3. It is noticed that the proceedings initiated is only at<\/p>\n<p>the stage of notice issued under Section 13(2). It is always<\/p>\n<p>left open to the respondent Bank to proceed with further<\/p>\n<p>steps without prejudice to rights if any available to the<\/p>\n<p>petitioner for continuing residence in the house in question.<\/p>\n<p>Admittedly, the title of the property vests with the 3rd<\/p>\n<p>respondent and the petitioner is claiming only a limited<\/p>\n<p>right of residence. As long as no steps is initiated to evict<\/p>\n<p>the petitioner from the residential building it could not be<\/p>\n<p>said that the petitioner is in any way affected by the<\/p>\n<p>proceedings impugned. Therefore I am not impressed with<\/p>\n<p>the contentions that the proceedings now initiated is liable<\/p>\n<p>WP(C) No. 35680 of 2010<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>to be interfered with at this stage. However, the petitioner<\/p>\n<p>will be at liberty to raise appropriate challenge if any action<\/p>\n<p>is initiated for dispossessing her from the residential house.<\/p>\n<p>      The   writ    petition is  disposed   with   the   above<\/p>\n<p>observations.\n<\/p>\n<\/p>\n<p>                                     C.K.
