Justice P.R.RAMACHANDRA MENON\n\n Dated :25\/11\/2010\n\n O R D E R\n   J.Chelameswar, C.J. &amp; P.R.Ramachandra Menon, J.\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Contempt Case (Civil) No. 1248 OF 2010\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 25th day of November, 2010\n\n                              JUDGMENT\n<\/pre>\n<p>Ramachandra Menon, J.\n<\/p>\n<p>            The petitioners have approached this Court with this<\/p>\n<p>Contempt Petition stating that only scant regards have been<\/p>\n<p>paid to the verdict passed by this Court on 24.11.2009, where,<\/p>\n<p>an undertaking was given on behalf of the Government and<\/p>\n<p>also on behalf of the Water Authority that, completion of the<\/p>\n<p>pipe line laying works from sewage treatment plant, Kozhikode<\/p>\n<p>Medical College to Canoly Canal will be completed and<\/p>\n<p>commissioned after trial run by the 4th week of July, 2010.<\/p>\n<p>            2.    During the course of the proceedings, the<\/p>\n<p>learned    Government         Pleader      submitted       that   the 1st<\/p>\n<p>respondent\/contemnor is actually in no way connected with the<\/p>\n<p>matter. In the said circumstances, the petitioners have filed<\/p>\n<p>an Interlocutory Application bearing No., I.A. 591 of 2010 to<\/p>\n<p>substitute the 1st respondent, which was allowed and the 1st<\/p>\n<p>respondent was substituted as per order dated 13.10.2010.<\/p>\n<p>Contempt Case(Civil) No. 1248 of 2010<br \/>\n<span class=\"hidden_text\">                                    -:2:-<\/span><\/p>\n<p>But no draft memo of charges has been filed in respect of the<\/p>\n<p>said substituted respondent.            The learned counsel for the<\/p>\n<p>petitioners submits that the grievance projected will stand<\/p>\n<p>confined only to the 2nd respondent and that the matter need not<\/p>\n<p>be dealt with, against the 1st respondent.<\/p>\n<p>           3.     The substituted 1st respondent has filed an<\/p>\n<p>affidavit. It is revealed from the affidavit that the construction<\/p>\n<p>of the sewage treatment plant was completed; its trial run was<\/p>\n<p>successfully conducted and the remaining work is with regard to<\/p>\n<p>the laying of pipe lines.\n<\/p>\n<p>           4. The 2nd respondent, has filed a counter affidavit<\/p>\n<p>pointing out the sequence of events as to the steps taken to<\/p>\n<p>comply with the undertaking given. It is stated that, the work<\/p>\n<p>was entrusted by the Water Authority, on tender, to one<\/p>\n<p>Mr.T.Ramachandran, a Contractor, who commenced the work.<\/p>\n<p>However, the work was intercepted by the local public and a<\/p>\n<p>series of proceedings by way of negotiations, meetings,<\/p>\n<p>conferences etc;       at the instance of the District Collector,<\/p>\n<p>Kozhikode, Mayor of Kozhikode Corporation and also the MLA of<\/p>\n<p>Contempt Case(Civil) No. 1248 of 2010<br \/>\n<span class=\"hidden_text\">                                    -:3:-<\/span><\/p>\n<p>Kozhikode Assembly Constituency were held at different points of<\/p>\n<p>time.    It is also brought to our notice that some of the local<\/p>\n<p>residents had approached this Court by filing a writ petition,<\/p>\n<p>seeking an alternate route to drain out the treated water from<\/p>\n<p>the treatment plant. It is also pointed out in the counter affidavit<\/p>\n<p>that earnest efforts have been made to obey the undertaking<\/p>\n<p>given while finalising the proceedings as per the verdict dated<\/p>\n<p>24.11.2009 and that there is no willful disobedience in any<\/p>\n<p>manner.\n<\/p>\n<p>           5.      After hearing the learned counsel for the<\/p>\n<p>petitioners, the learned Government Pleader appearing on behalf<\/p>\n<p>of the 1st respondent and also the learned Counsel for the 2nd<\/p>\n<p>respondent, we find that no further proceedings are required to<\/p>\n<p>be pursued in this matter; but for observing that the work shall<\/p>\n<p>be finalised without any further delay.\n<\/p>\n<p>           6.   The learned counsel for the 2nd respondent who<\/p>\n<p>happens to be the Standing Counsel for the Water Authority<\/p>\n<p>submits that they require six months&#8217; time to complete the work.<\/p>\n<p>However, taking note of the actual facts and figures and the<\/p>\n<p>Contempt Case(Civil) No. 1248 of 2010<br \/>\n<span class=\"hidden_text\">                                    -:4:-<\/span><\/p>\n<p>steps already taken, we find it fit and proper to grant three<\/p>\n<p>months&#8217; time from today, so as to have the entire works<\/p>\n<p>completed and the project commissioned.<\/p>\n<p>           With the above observation and direction, the<\/p>\n<p>Contempt of Court Case is closed.\n<\/p>\n<\/p>\n<p>                                           J.Chelameswar,<br \/>\n                                           Chief Justice.\n<\/p>\n<p>                                      P.R.Ramachandra Menon,<br \/>\n                                              Judge.\n<\/p>\n<p>ttb<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.Suresh Kumar vs Manoj Joshy on 25 November, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Con.Case(C).No. 1248 of 2010(S) 1.
