LTD. &amp; 1 - Respondent(s)\n \n\n=========================================================\nAppearance : \nMR\nJD AJMERA for\nPetitioner(s) : 1, \nMRS MAUNA M BHATT for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/05\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed for the following reliefs;\n<\/p>\n<p> (a)\tBe pleased to<br \/>\nadmit this petition.\n<\/p>\n<p>(b)\tBe pleased to quash<br \/>\nand set aside the action of the respondent-Corporation in not<br \/>\nremoving the anomaly in the basic pay of the petitioner and not<br \/>\nfixing the basic pay of the petitioner higher than his juniors, by<br \/>\nissuing a writ of mandamus and \/ or any other appropriate writ,<br \/>\ndirection or order under Article 226 of the Constitution of India.\n<\/p>\n<p>(c)\tBe pleased to direct<br \/>\nthe respondent-Corporation to suitably adjust the basic pay of the<br \/>\npetitioner by adding an increment in the basic pay and by giving<br \/>\nproper stepping up, by issuing a writ of mandamus and \/ or any other<br \/>\nappropriate writ, direction or order under Article 226 of the<br \/>\nConstitution of India.\n<\/p>\n<p>(d)\tBe pleased to direct<br \/>\nthe respondent-Corporation to give the aforesaid benefit of increase<br \/>\nin the basic pay from the date on which his junior started drawing<br \/>\nhigher basic pay, by issuing a writ of mandamus and \/ or any other<br \/>\nappropriate writ, direction or order under Article 226 of the<br \/>\nConstitution of India.\n<\/p>\n<p>(e) &amp; (f) &#8230;&#8230;.\n<\/p>\n<p>2.\tThe facts in brief are<br \/>\nthat the petitioner was appointed as an Office Assistant in<br \/>\nrespondent-Corporation in the year 1963. In pursuance of the Circular<br \/>\ndated 16.08.1991 issued by the respondent revising the salaries of<br \/>\nthe employees of the respondent-Corporation, the pay-scale of the<br \/>\npetitioner was revised to Rs.4600-6790 w.e.f. 01.01.1987.\n<\/p>\n<p>3.\tIt is the case of the<br \/>\npetitioner that while revising his pay-scale, injustice has been done<br \/>\nto him by the respondent-Corporation inasmuch as an employee junior<br \/>\nto him has been granted more benefits than him. The petitioner made<br \/>\nrepresentation to the respondent-Corporation against the said pay<br \/>\nanomaly. However, the same was not considered. Hence, this petition.\n<\/p>\n<p>4.\tHeard learned counsel for<br \/>\nthe respective parties. It appears from the record that the case of<br \/>\nthe petitioner is not similar to that of the co-employee, B.G. Patel<br \/>\ninasmuch as the said employee was given two promotional increments in<br \/>\nthe revised scale with higher incremental benefits. Moreover, the<br \/>\npetitioner has also not disclosed the fact regarding personal pay<br \/>\ndrawn by him. Both the petitioner and said B.G. Patel, on becoming<br \/>\nManager, were drawing equal basic pay w.e.f. 08.08.1991. Therefore, I<br \/>\ndo not find anything on record from which it could be inferred that<br \/>\ninjustice has been done to the petitioner. Apart from that it is open<br \/>\nto the petitioner to claim reversion, particularly, when he has<br \/>\nenjoyed the promotional post for a considerable long period.\n<\/p>\n<p>5.\tIn view of the above, the<br \/>\npetition, being devoid of any merits, is rejected. Rule is<br \/>\ndischarged.
