                The Managing Committee of Hindu Kanya<\/p>\n
College,   Kapurthala     has     approached        this   Court   in<\/p>\n
challenge to Order dated 1.1.2009 (Annexure P-7),<\/p>\n
Order dated 11.1.2009 (Annexure P-8) and Order dated<\/p>\n
20.2.2009 (Annexure P-10).\n<\/p>\n
                Vide     Order        dated   1.1.2009,     Annexure<\/p>\n
P-7, Guru Nanak Dev University, Amritsar, addressed<\/p>\n
a Memo to the petitioner. It has been stated therein<\/p>\n
that   University      Syndicate,       in    its    meeting   dated<\/p>\n
9.3.2008 had taken a decision that all colleges must<\/p>\n
appoint regular Principals on or before 31.7.2008.<\/p>\n
In the absence thereof, Rs.50,000\/- per month shall<\/p>\n
be recovered as penalty. The petitioner – College
\n CWP No.3118 of 2009                                           [2]<\/p>\n
had been informed on 25.3.2008 and reminder had been<\/p>\n
given on 3.11.2008 in regard to the decision of the<\/p>\n
Syndicate. Penalty was imposable on the petitioner<\/p>\n
for the period 1.8.2008 to 31.12.2008. The deposit<\/p>\n
was required to be made by 15.1.2009.<\/p>\n
                       Vide Order dated 11.1.2009, Annexure<\/p>\n
P-8, the University again informed the petitioner in<\/p>\n
regard     to    its    conduct      in    delaying       appointment         of<\/p>\n
regular     Principal          and   violating           mandate       of    the<\/p>\n
Syndicate dated 9.3.2008. In addition to what was<\/p>\n
stated     in    Annexure       P-7,      the    petitioner          had    been<\/p>\n
warned that the roll numbers of the students would<\/p>\n
be with-held in case the requisite penalty is not<\/p>\n
paid.\n<\/p>\n
                       Under   the     third      impugned          order   i.e.<\/p>\n
Annexure P-10 dated 20.2.2009, again the University<\/p>\n
informed        the    petitioner         that    the     petitioner         had<\/p>\n
caused delay in appointment of regular Principal. A<\/p>\n
decision had been taken by the University to with-<\/p>\n
hold roll numbers of the students for non-payment of<\/p>\n
the penalty as the penalty had not been paid till<\/p>\n
issuance of order\/ Memo, Annexure P-10.<\/p>\n
                       Learned counsel for the petitioner has<\/p>\n
not been able to dispute that there has been delay<\/p>\n
on   the        part    of     the     petitioner         –     College       in<\/p>\n
appointing a regular Principal. All that has been<\/p>\n
argued is that the officials of petitioner were busy<\/p>\n
in   finalising         admission      and       hence    the       delay.   No<\/p>\n
other argument has been addressed.\n<\/p>\n
 CWP No.3118 of 2009                                                 [3]\n\n\n\n                           A     College,         obviously            cannot        run\n\n<\/pre>\n
without an administrative head who is also required<\/p>\n
to have better academic qualifications as against<\/p>\n
the other persons in the faculty. The petitioner –<\/p>\n
College       is       a        degree     college         and     is     imparting<\/p>\n
education in all the courses. The explanation for<\/p>\n
delay is not acceptable in view of the fact that no<\/p>\n
such    ground         was        taken    by     the      petitioner        in      the<\/p>\n
representation made to the University for waiver of<\/p>\n
penalty i.e. Annexure P-9. The conduct of petitioner<\/p>\n
indicates callous approach although the importance<\/p>\n
of   having        a       Principal        of       an    institution       is      of<\/p>\n
paramount       importance               not     only      for     administrative<\/p>\n
control       over             the     institution         but     also      because<\/p>\n
absence of a regular Principal would marginalise the<\/p>\n
level of imparting quality education by members of<\/p>\n
the faculty.\n<\/p>\n
                           I    have     considered         the    issue.       It    is<\/p>\n
clear     from         the       record        that       the     petitioner         was<\/p>\n
informed       about             the     decision         of     the      University<\/p>\n
Syndicate dated 9.3.2008 well in advance. Despite<\/p>\n
such being the facts, no appropriate or speedy steps<\/p>\n
were    taken      for          appointment          of    Principal       from      May<\/p>\n
2008 till September 2008. Sufficient opportunity was<\/p>\n
given    to     the            petitioner       as    is    evident        from      the<\/p>\n
impugned orders themselves.\n<\/p>\n
                           No ground for judicial review of the<\/p>\n
impugned orders is made out.\n<\/p>\n
                           The petition is dismissed.\n<\/p>\n
 CWP No.3118 of 2009                                         [4]\n\n\n\n                      Learned    counsel       for    the         petitioner\n\nstates    that    since    last       date    of    deposit        is   today\n\n<\/pre>\n
(4.3.2009), the University might not even consider<\/p>\n
issuance of roll numbers even after payment by the<\/p>\n
petitioner.\n<\/p>\n
                      Keeping    in    view    the        future     of   the<\/p>\n
students, it is directed that the University would<\/p>\n
accept    the    penalty        amount   in        case    the     same   is<\/p>\n
deposited today and issue roll numbers.<\/p>\n
                      Copy of the order be given under the<\/p>\n
signatures of the Reader.<\/p>\n
