Respondent.\n                                           ----\n                CORAM :            HON'BLE THE CHIEF JUSTICE\n                                          ---\n                For the Appellant:            Mr.D.K.Dubey\n                For the Respondents:          -------\n                                        -----\n\n\n17\/27.01.2010<\/pre>\n<p>              This appeal has been preferred against the judgment and<br \/>\n                 order dated 31.05.2006 passed by the Subordinate Judge-I, west<br \/>\n                 Singhbhum     at Chaibasa in Misc. Case no.12\/2005 by which the<br \/>\n                 award passed by the Arbitrator in favour of the respondent for a total<br \/>\n                 sum of Rs.3,01,800\/- plus future interest has been upheld.\n<\/p>\n<p>                          From the materials on record it appears that the respondent<br \/>\n                 had been awarded a contract for the construction of Public Health<br \/>\n                 Centre building at Chotanagra in the district of West Singhbhum<br \/>\n                 which was to be completed within a period of one year and for this<br \/>\n                 purpose, an agreement also had been executed between the<br \/>\n                 appellant-State of Bihar (now Jharkhand) and the respondent-<br \/>\n                 Contractor.\n<\/p>\n<p>                            It is stated that the work under the contract was started<br \/>\n                 on 10.02.1992 and in course of execution of the contract certain<br \/>\n                 demands were made by the respondent-contractor but finally a<br \/>\n                 dispute between the appellant-State and the respondent-contractor<br \/>\n                 arose due to which the matter was referred to an Arbitrator in<br \/>\n                 pursuance to the agreement which admittedly envisages a provision<br \/>\n                 for appointment of an Arbitrator in view of existence of a dispute.\n<\/p>\n<p>                          The Arbitrator, after adjudication of the matter, finally<br \/>\n                 passed an award for a sum of Rs.3,01,800\/- with which the<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>appellant-State felt aggrieved and hence filed objection before the<br \/>\ncourt of Subordinate Judge-I at Chaibasa. The Subordinate Judge,<br \/>\nthereafter scrutinized the award passed by the Arbitrator and was<br \/>\npleased to dismiss the Misc. Petition filed by the appellant-State after<br \/>\nrecording a finding that the learned Arbitrator has not misconducted<br \/>\nhimself while conducting the proceeding and further was pleased to<br \/>\nhold that the award had not been procured improperly by the<br \/>\nrespondent. Thus, the award passed by the Arbitrator was ordered to<br \/>\nbe made a rule of the Court. The appellant-State still felt aggrieved<br \/>\nwith the judgment and order passed by the Subordinate Judge and<br \/>\npreferred this appeal.\n<\/p>\n<p>        Having   heard       the   Standing   counsel   representing   the<br \/>\nappellant-State and on perusal of the impugned judgment and order<br \/>\npassed by the Subordinate Judge nothing material was found which<br \/>\ncould persuade this Court to hold that the impugned award passed<br \/>\nby the Arbitrator required interference by the Subordinate Judge<br \/>\nwhile entertaining objections against the award nor anything could<br \/>\nbe inferred as to how the Subordinate Judge has erred by refusing to<br \/>\ninterfere with the award passed in favour of the respondent.\n<\/p>\n<p>       In fact, the Standing counsel also, on perusal of the impugned<br \/>\njudgment and order, could not establish in any manner as to what<br \/>\nexactly were the objections which had been raised by the<br \/>\nrespondent-State while assailing the award before the Subordinate<br \/>\nJudge. The objection that had been raised by the appellant-State<br \/>\nbefore the court below was merely a theoretical submission that the<br \/>\nArbitrator had misconducted himself in passing the award in favour<br \/>\nof the respondent without explaining in what way or manner the<br \/>\nArbitrator had misconducted. It is perhaps for this reason that in the<br \/>\nimpugned judgment and order, there is absolutely no mention of the<br \/>\nobjection which had been raised by the appellant-State and it was<br \/>\nmerely submitted that the award was fit to be quashed and set aside<br \/>\nsince the Arbitrator has misconducted himself in passing the award in<br \/>\nfavour of the respondent without indicating in any manner as to how<br \/>\nthe Arbitrator was in error in delivering the award so as to pursuade<br \/>\nthe Court to interfere with the same. At the stage of appeal also<br \/>\nnothing could be pointed out indicating that the award passed by the<br \/>\nArbitrator was erroneous in any manner so as to hold that the<br \/>\nArbitrator has misconducted himself in confirming the award and<br \/>\nmaking the same a rule of the Court.\n<\/p>\n<p><span class=\"hidden_text\">                                                                   2<\/span><br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>              Under the circumstance, it is difficult to entertain this<br \/>\n    appeal.
